ITEM Report on petition for public improvements and approval of resolution of advisability and authorization for project. BACKGROUND On September 8, 199'7, the City Commission approved a change order on the 1997 Storm Drainage Improvement Project to allow construction of a gabion wall for erosion control in an existing drainage channel paralleling South Eastborough Road. This project was requested by the adjacent property owner, Mr. Stan Lauer. Since that meeting, city staff has been working with Mr. Lauer on an agreement and payment schedule for the project. The project is proposed to be financed 50% by Mr. Lauer and 50% by the City at-large. During our discussions with Mr. Lauer, he requested that the special assessment method of financing be used for the project and that his lot would be the only property in the benefit district. The City Attorney reviewed this option and found it to be acceptable in this case, provided that a petition be submitted by Mr. Lauer and that the appropriate resolutions be approved by the City Commission. The signed petition and resolutions are attached. If approved, 50% of the cost of the project, or $10,460, will be assessed to Mr. Lauer's lot to be repaid over ten years with interest. RECOMMENDATION It is recommended that the City Commission approve the resolution of advisability and authorization for the project.
