2024 KKOA Leadsled Special Conditions Special Event Permit #SEP-2024-030 Event: KKOA Leadsled Spectacular Drag Races Event Sponsor: Jerry Titus & DeVona Titus d/b/a Kustom Kemps of America and Kustom Kemps of America, Inc., a Kansas corporation Location: East Crawford Recreation Area(ECRA) Date: Friday, July 26, 2024 Hours of Event: 4:00 p.m. to 9:00 p.m. Description: Drag Races Site Map: See attached"Site Map" Insurance: See attached Certificate of Liability Insurance Special Conditions I. Definitions "Participant"refers to: (a) a registered participating driver or crew member wearing an identifying bracelet issued at event registration; (b) authorized event staff clearly identified as such by clothing and/or badge; and (c) authorized city staff with official City I.D. "Participant Spectator" refers to a registered spectator associated with a Participant and wearing an identifying bracelet issued at event registration. "Spectator" refers to a member of the general public observing the event from either the paid or non- paid spectator areas. "City's Designated Representative"refers to the City's Parks Superintendent, Dennis Arnold. "Event Sponsor's Designated Representative"refers to Jerry Titus. II. Public Health and Safety Requirements The Event Sponsor shall be responsible for abiding by and enforcing the following public health and safety requirements as a condition of conducting the Event at the City's public facilities. Failure to adequately enforce the conditions outline below shall be basis for termination of the Event at any time during the Event upon notification by the City's Designated Representative to the Event Sponsor's Designated Representative. A. No alcoholic beverages or cereal malt beverage 1. No person shall be allowed to possess or consume alcoholic liquor or cereal malt beverage as defined by Kansas law at any location at the event site. Special Event Permit Special Conditions Page 2 B. Access to Track—Viewing Areas 1. Event Sponsor shall assure that only Participants are on the track or the "burn out area" designated on the Site Map. 2. The Event Sponsor shall assure that all Participant Spectators and Spectators observe the races from a distance of no less than fifty feet (50') from the track. Spectators shall observe from the gated spectator area or the public area on the west side of the track as designated on the Site Map. Participant Spectators shall observe from the participant viewing or parking areas designated on the Site Map. C. Emergency Medical, Security, and Traffic Control 1. The Emergency Medical Service (EMS) will maintain a fully staffed ambulance plus ATV with additional crew at the location depicted on the Site Map at all times during the event at the expense of the Event Sponsor. 2. The Saline County Sheriff's Department will provide event security with deputies stationed at the locations depicted on the Site Map at the expense of the Event Sponsor. 3. The Salina Police Department will provide traffic control on Markley Road with officers stationed at the locations depicted on the Site Map. D. Drivers 1. All drivers of cars participating in the drag races must have signed a waiver of liability in a form approved by the City at the time of event registration. 2. Event Sponsor shall be responsible for conducting a driver safety meeting with all participating driver prior to the races. 3. NO PASSENGERS. No persons other than the drivers shall be allowed in a car while racing. 4. All drivers shall cease acceleration and begin braking after crossing the finish line. E. Track conditions 1. Event Sponsor shall adequately staff the start and finish lines to identify and direct removal of any debris from the track. 2. Event Sponsor shall adequately staff and supply fire extinguishers, oil dry, and brooms to clean up spills and keep the track in a dry, safe condition. 3. Racing shall be interrupted to the extent necessary to safely remove either debris or spills from the track. Racing shall not be diverted from the designated track to avoid debris or spills. 2 Special Event Permit Special Conditions Page 3 4. The City retains the right to temporarily delay or terminate racing due to adverse weather conditions, at the discretion of the City's Designated Representative. F. Event Management 1. Event Sponsor shall supply designated members of its staff with radios and shall identify those persons to the City's Designated Representative. 2. Event sponsor shall supply no fewer than seven (7) portable restrooms to be placed at the locations designated on the Site Map. 3. All food vendors shall abide by all applicable health regulations. 4. Event Sponsor agrees to arrange contract and pay for sanitation services to promptly clean up, remove and dispose of all paper or debris caused by Event Sponsor's use of the area and understands that if such clean up, removal and disposal is not promptly undertaken the City reserves the right to do the cleaning, removal and disposal and to charge the Event Sponsor. 5. Event Sponsor shall have event staff at the entrance to the event site. 6. Event Sponsor shall provide the number of volunteers (with appropriate vests) determined necessary by the City's Designated Representative to assist spectators and participants in assuring safe, efficient and well-organized parking. III. Indemnification Event Sponsor shall indemnify, defend and hold harmless the City, its officers, officials, employees and agents from and against any liability, loss, damage, expense and costs (including without limitation costs and fees of litigation) of every nature arising out of or in connection with the events conducted hereunder, including, but not limited to, injuries or damages caused to participants, officials, and spectators, or damage to any property, or its failure to comply with any of its obligations contained in the application or this permit, except such loss or damage which was caused by the sole negligence or willful misconduct of the City.
