Ordinance Number 97-9823 providing for the vacation of a portion of public right-of-way on South Ninth Street in front
of Kraft Manor.
Backoround
This ordinance was presented for first reading on August 11, 1997 and was approved for second reading on August
18, 1997. Upon being recorded a the Register of Deeds office, it was discovered that the legal description was
incorrect. The distance of 700 feet which appears twice in this ordinance was shown as 310 feet in the original. This
increases the square footage of the area from 7,084 to 15,995.
As the public hearing notice did not state the legal description, there is no need to hold another public hearing. The
area shown to the Commissioners, staff and public on the maps during the hearing was the correct area.
Since this is a simple correction to the ordinance, it is recommended that both the first and second readings be done
today.
Recommendation
Approve Ordinance Number 97-9823 for first reading.
Declare an emergency exists in order to have second reading on the same day.
Adopt Ordinance Number 97-9823 on second reading.
