Agreements with the Union Pacific Railroad Company and the Kansas Department of Transportation
related to the North Ohio Street Overpass Project.
BACKGROUND
The attached two agreements address the issues of collaboration between the City of Salina, Union
Pacific Railroad Company (UPRR) and the Kansas Department of Transportation (KDOT) on the
North Ohio Street Overpass Project. City staff has been negotiating these agreements with UPRR
and KDOT since March 2001. Given the scope of the project and the direct correlation of these
improvements to UPRR operations in this area of Salina, a number of complex issues are addressed
in these agreements. These agreements must be executed before the North Ohio Street Overpass
Project may proceed to bid lettings in June and August, 2005. The City Commission reviewed and
approved an earlier draft of the two-party agreement on March 28, 2005.
The key elements in the agreements are:
. Relationship of KDOT/City/UPRR
. Acquisition of property by City and transfer of property to UPRR
. Construction of "eastern rail spur"
. KDOT project construction phasing for railroad spur
. UPRR share of $1.504 million in lieu of the federal requirement of 5% of project cost
. Abandonment of Ohio Street crossings around September, 2005 which results in a major
reduction of downtown train traffic
. Ohio Street Overpass issues
. Abandonment of western railroad line and crossings
RECOMMENDATION
It is recommended that the City Commission approve the resolutions authorizing the Mayor to sign the
agreements as follow:
1. Two-party agreement between the City and UPRR.
2. Three-party agreement between the City, UPRR and KDOT.
