First reading Ordinance Number 05-10274, providing for the annexation of certain land in Section 36,
Township 13 South, Range 3 West of the Sixth Principal Meridian in Saline County, Kansas.
BACKGROUND:
On December 17, 2001, Ordinance Number 01-10068 was passed on second reading. This
ordinance annexed approximately one hundred sixty-four (164) acres of land along North Ohio Street
into the city. This annexation involved requests from eight (8) separate property owners along the
North Ohio corridor between Stimmel Road and 1-70. The purpose of these requests was to allow
those properties to connect to the City's water and sanitary sewer systems upon completion of a
proposed public water line and sewer line project on North Ohio Street. Annexation was required to
allow connection to City utilities and to be included in the benefit district that was created to finance
the utility line extensions. Flying J, Harley-Davidson and Kenworth are connected to public utilities.
The remaining properties received agricultural deferrals. All properties in the corridor chose to annex
their property and participate in the benefit district except for the owner of the home at 2077 North
Ohio. Staff was unable to make contact with that owner during the project timeframe.
Since that time a rural water district line serving the property at 2077 North Ohio has been removed
and relocated. Because the City of Salina is the sole service provider the home is now hooked up to
the City's water system. The owner is now desirous of connecting to the City's sanitary sewer system
and has filed an application to annex his property into the city to allow that connection to be made.
On September 25, 2001, pursuant to a request from the City Commission, the Board of County
Commissioners found that the annexation of this area would not hinder or prevent the proper growth
and development of the area or that of any other incorporated city located in Saline County and
approved the request by resolution. County approval was needed because these properties on either
side of Ohio Street were not and still are not contiguous to the existing city limits. No further County
action is required with respect to this property.
RECOMMENDATION:
Adopt the attached ordinance annexing the Koster property at 2077 North Ohio Street into the city
limits of the City of Salina.

ORDINANCE NUMBER 05-10274
AN ORDINANCE PROVIDING FOR THE ANNEXATION OF A CERTAIN
TRACT OF LAND, IN SALINE COUNTY, KANSAS IN CONFORMITY WITH THE
PROVISIONS OF K.S.A. 12-519 TO 12-526, INCLUSIVE.
BE IT ORDAINED by the Governing Body of the City of Salina, Kansas:
Section 1. That the following described tract of land, to-wit:
A tract of land located in the NE 1f4 of the SE 1f4 of Section 36, Township 13 South,
Range 3 West of the Sixth Principal Meridian in Saline County, Kansas, more
particularly described as follows:
Commencing at the Northeast corner of said SE 1f4 thence West along the North line of
said SE 1f4 a distance of37.50 feet to a point on Ohio Street right-of-way; thence South
along said Ohio Street right-of-way parallel with the East line of said SE 1f4 a distance of
748.00 feet to the point of beginning; thence continuing South along said right-of-way
parallel with said East line of said SE 1f4 a distance of354.00 feet; thence West on a line
which is at right angles to said East line of said SE 1f4 a distance of 391.65 feet; thence
North parallel with said East line of said SE 1f4 a distance of354.00 feet; thence East at
right angles with said East line a distance of391.65 feet to the point of beginning. Said
parcel of land contains 138,644 square feet, more or less.
meeting one or more of the classifications for annexation prescribed by K.S.A. 12-519 to 12-526,
inclusive, is hereby annexed and made a part of the City of Salina, Kansas.
Section 2. That this 3.18 acre tract shall be zoned RS Residential Suburban District upon
annexation.
Section 3. That the certain tract of land included in this annexation is addressed as
follows:
2077 N. Ohio Street
Section 4. That this ordinance shall be in full force and effect from and after its adoption
and publication once in the official city newspaper.
