Page 1 1 // BY: Brad JOhnSOn~ / BY:~ ITEM: Public hearing to consider a petition requesting the vacation of the public street right-of-way on Fourth Street from North Street to Pine Street. HISTORICAL BACKGROUND: The right-of-way for this section of Fourth Street was dedicated as part of the plat of the Original Townsite of Salina in 1862. Research by staff has determined that in 1877 the Salina City Council approved an agreement with the Union Pacific Railroad that allowed track to be built within the 80 ft. right-of-way for Fourth Street. Under the agreement usage of the right-of-way by the railroad was deemed to be a public use and benefit. This block of Fourth Street has never been improved or opened to public traffic. Right-of-way conditions have remained substantially unchanged since the rail line was installed in approximately 1877. This portion of the Original Townsite was replatted in 1975 as part of the Northeast Industrial Park Urban Renewal project and is now know as Block 10 of the Northeast Industrial Park. This triangular lot was purchased from the City's Urban Renewal Agency in 1977 by the Central Supply Company and 4,000 square foot warehouse building was constructed on the site the same year. PURPOSE OF PETITION: Petition No. 4257 was filed on November 10, 2005 by Mr. Richard Rew on behalf of West Street Enterprises doing business as Rew Materials in Salina. Rew Materials has a warehouse facility at 310 E. North Street that is landlocked. It is bounded by North Street on the north, Fourth Street on the west and railroad right-of-way on the east and south. Rew Materials has been engaged in discussions with Union Pacific about leasing some additional land from the railroad to construct a storage shed and improve the circulation on their site. Specifically, they are proposing to construct a three sided storage building for material storage that would face east and be accessible for loading and unloading on that side. They are attempting to push it as far south and west as possible to maintain adequate loading area. The boundaries of the lease areas were based on the railroads needing to maintain a 25 ft. clear zone on both sides of the track to conduct their operations. The petitioners shared their preliminary plans with staff and staff identified a conflict with Lease Area No. 2 where platted right-of-way for Fourth Street abuts the west side of the property. Staff informed representatives of Rew Materials that Union Pacific was offering to lease them publicly dedicated right-of-way and that no construction could occur in this area until and unless the right-of-way was vacated and reverted to private ownership. Staff discouraged any piecemeal vacation of street right-of-way and at staff's recommendation a petition was filed requesting that all of the unbuilt street right between Pine Street and North Street be vacated. The Roger Morrison Trust was identified as the abutting owner on the west side of Fourth Street but they were not approached by the applicants about joining in the petition. Page 2 BY: Brad Johnson BY: EXISTING UTILITIES: Staff researched the status of existing utilities in this area and the only utility that exists is a Westar down guy wire and anchor that extends approximately 30 ft. south of the North Street right-of-way in the east half of the Fourth Street existing right-of-way. Should the proposed right-of-way vacation occur, they would request that their facilities be protected by maintaining a utility easement in this area. FISCAL NOTE: The City of Salina will have no financial responsibility with respect to this action. RECOMMENDATION: Based on the research conducted after submittal of the vacation petition, staff has concluded that there is still a public purpose being served by the Fourth Street right-of-way in this location and that any reversion to private ownership could jeopardize Union Pacific's right to maintain track and operate in this rail corridor. Therefore, staff would recommend denial of Petition No. 4257. In the alternative, staff would recommend approval of a license agreement with the current owner and tenant to allow the area identified as Lease Area No.2 to be utilized for private purpose. It is unlikely that Fourth Street would ever be built and opened as a public Street and Union Pacific has determined that use of the described area will not interfere with their rail operations.
