95-4898 Surplus PropertyE401934 (Published in The Salina Journal August /f, and August /9 , 1995) RESOLUTION NUMBER 95-4898 A RESOLUTION DETERMINING THAT CERTAIN REAL ESTATE IS NO LONGER NEEDED BY THE CITY OF SALINA AND THAT THE SALE OF THE PROPERTY THEREOF WOULD BE IN THE BEST INTEREST OF THE CITY. BE IT RESOLVED by the Governing Body of the City of Salina, Kansas: Section 1. That it is hereby determined that the following described real estate is no longer needed or required for park purposed of the City of Salina, Kansas: Beginning at a point on the East line extended of the North- South alley in Block Twelve (12), Oakdale Addition, said point being Seventy -Eight and Ninety Hundredths (78.90) feet South of an iron pin marking the Southwest corner of Lot Thirteen (13), Block Twelve (12), Oakdale Addition; Thence South along said East line extended, a distance of Thirty and Fifty Hundredths (30.50) feet to the high bank of the Old Smoky Hill River Channel; Thence Southwesterly along said high bank a distance of One Hundred Ninety -Three and Twelve Hundredths (193.12) feet to a point on the East line of vacated Penn Avenue; Thence North along the East line of vacated Penn Avenue a distance of Seventy (70) feet to the South right-of-way of Smoky Hill Drive said point being Seventy (70) feet South of the Southwest corner of Lot Twelve (12), Block Twelve (12), Oakdale Addition; Thence Easterly on a line Seventy (70) feet South of and parallel with the South line of said Lot Twelve (12) a distance of One Hundred Eighty -Seven (187) feet to a point on the East line extended of the North-South alley in Block Twelve (12), Oakdale Addition and the point of Beginning; The above described tract of land contains Eight Thousand Three Hundred Sixty -Eight (8368) square feet or Nineteen Hundredths (0.19) acres, more or less, and is subject to the following water line easement; Beginning at a point on the East line of vacated Penn Avenue, said point being Sixteen and Four Hundredths (16.04) feet South of the South right-of-way of Smoky Hill Drive; Thence South along the East line of vacated Penn Avenue a distance of Twenty -One and Ninety -Three Hundredths (21.93) feet; Thence Northeasterly a distance of Ninety -Five and Six Hundredths (95.06) feet to a point on the South line of Smoky Hill Drive, said point being Eighty -Six and Seventy Hundredths (86.70) feet East of the East line of Penn Avenue; Thence West along the South line of Smoky Hill Drive a distance of Fifty and Eight Hundredths (50.08) feet; Thence Southwesterly a distance of Forty and Fifteen Hundredths (40.15) feet back to the Point of Beginning. The above described easement contains One Thousand Three Hundred Fifty -Two (1352) square feet or Three Hundredths (0.03) acres, more or less. Section 2. That it would be in the best interest of the City of Salina, Kansas, that the above described land be sold. Section 3. That if within thirty (30) days from the date of the last publication of this resolution there has not been filed with the City Clerk a protest signed by the qualified electors of the City of Salina equal in number to not less than ten percent (10%) of the electors who voted in the last preceding regular city election as shown by the poll books, then the City of Salina will proceed to sell said property. Section 4. That this Resolution shall be in full force and effect from and after its publication twice in the official city newspaper.
