A RESOLUTION SETTING OUT THE FINDINGS AND
DETERMINATIONS OF THE GOVERNING BODY OF THE CITY OF SALINA,
KANSAS, ON THE ADVISABILITY OF CERTAIN CURBING, GUTTERING,
PAVING, GRADING, STORM WATER DRAINAGE, LATERAL SANITARY SEWER
AND WATER MAIN AND SERVICE IMPROVEMENTS IN THE VALLEY VIEW
ESTATES ADDITION OF THE CITY OF SALINA, KANSAS.
WHEREAS, the Governing Body did on August 7, 1995, find and
determine, and does find and determine, in accordance with K.S.A. 12-6a01 et
seq . , all as hereinafter set forth;
NOW, THEREFORE BE IT RESOLVED BY THE GOVERNING BODY OF
THE CITY OF SALINA, KANSAS:
Section 1. That the Governing Body hereby finds, and finally
determines, that it is advisable to make the following improvements:
VALLEY VIEW ESTATES ADDITION
Curbing, guttering, paving, grading of:
Foxtail Drive from the south line of Valley View Estates Addition to
the south line of Redtop Ridge;
Redtop Ridge from the west line of Markley Road to the cul-de-sac;
Bluestem Lane from the south line of Cloud Street to the cul-de-sac;
and
the installation of sanitary sewer main and water main systems,
to serve Lots 1 through 17, Block 1 and Lots 1 through 10, Block 2,
Valley View Estates Addition.
Section 2. The estimated and probable cost of such improvement
is $530,140.00.
Section 3. The improvement district is Lots 1 through 17, Block
I and Lots 1 through 10, Block 2, all in the Valley View Estates Addition.
Section 4. The method of assessment shall be that 100% of the
total cost assessed against the property shall be based upon equal assessments
for each lot of land for street, drainage, water and sanitary sewer assessments.
Section 5. The proposed apportionment of cost between the
improvement district and the city -at -large is:
1. The costs assessed against the improvement district shall be 100%
of the total cost of street and drainage improvements, including
grading, pavement, curb and gutter, storm inlets and pipelines and
any incidentals thereto to complete the street and drainage
improvements, 100% of the cost for the installation of water mains,
fittings, hydrants, water services, valves and any incidentals thereto
to complete the water system; and 100% of the total cost of sanitary
sewer pipeline, manholes, service connections and any incidentals
thereto to complete the sanitary sewer system, except the following:
2. The costs assessed the city -at -large shall be the difference in
cost between a 6" water main and an 8" water main and all pipeline,
fittings, hydrants and valves north of Cloud Street and any
incidentals thereto.
Section 6. That the advisability of the improvement above is
hereby established without notice and hearing as authorized by K.S.A. 12-6a01
et seq.
Adopted and passed this 7th day of August, 1995.
