RESOLUTION NUMBER 95-4943
A RESOLUTION DEFERRING THE PAYMENT OF SPECIAL ASSESSMENTS ON
CERTAIN PROPERTY LOCATED WITHIN THE PROPOSED BENEFIT DISTRICT FOR
THE MAGNOLIA ROAD AND I-135 INTERCHANGE IMPROVEMENT PROJECT.
WHEREAS, under KSA 12-6.110 et al the governing body of a city may defer special
assessments for the cost of public improvements in unplatted and undeveloped areas of the city for
up to 15 years or until the property is platted or developed; and
WHEREAS, Robert L. Marietta has requested deferral of special assessments levied on his
property for a portion of the cost of constructing the Magnolia Road and I-135 Interchange
improvement project; SO NOW, THEREFORE
BE IT RESOLVED by the Governing Body of the City of Salina, Kansas;
Section 1: That it is hereby declared to be the intent of the City of Salina to grant a deferral
of special assessments levied for the Magnolia Road and I-135 Interchange improvement project
on the following described property:
TRACT NO. 26
A tract of land located in the Northeast Quarter of Section 35, Township 14 South,
Range 3 West of the Sixth Principal Meridian in Saline County, Kansas, more
particularly described as follows:
Commencing at the Northwest corner of the NE 1/4 of said Section 35;
Thence South along the West line of said NE 1/4 on an assumed bearing of
S 00° 05'04" E, a distance of 53.76 feet to the Point of Beginning;
Thence N 89° 38'00" E, a distance of 58.55 feet;
Thence S 81' 25' 18" E, a distance of 604.86 feet;
Thence S 26° 06' 58" E, a distance of 310.39 feet;
Thence S 41' 29'26" E, a distance of 490.48 feet;
Thence S 31 ° 03' 05" E, a distance of 253.16 feet to a point on the westerly
right-of-way of 1-135 Highway;
Thence South along said westerly R/W on a non -tangent curve to the right
having a radius of 5579.58 feet, an arc distance of 406.86 feet, said
curve having a long chord of 406.77 feet and a bearing of S 10' 29'
03" E;
Thence S 89° 53' 15" W, a distance of 1320.52 feet to a point on the West
line of the NE 1/4 of said Section 35;
Thence N 00° 05'04" W along said West line, a distance of 1355.41 feet
back to the Point of Beginning.
The above described tract of land contains 1,357,792 square feet or 31.17
acres, more or less.
Section 2 That said deferral shall be granted for a period of 15 years or until such property
is platted or developed whichever occurs first.
Section 3. That said deferral shall be subsequently granted by ordinance following
establishment of the special assessment benefit district and annexation of said property into the city
limits of the City of Salina.
