BY: ITEM: Resolution No. 23-8115 Advisability and Authorization Resolution No. 23-8115 related to establishment of a special improvement district for Cedar Ridge Drive, water, sanitary sewer, street, and drainage improvements in Cedar Point Addition and authorization for city staff to accept bids for the improvements. BACKGROUND: Cedar Ridge Development, LLC (Kevin and Stephanie Cool) purchased a 9.82 tract of land located on the north side of Cedar Ridge Drive between the Grand Prairie Addition and Briargate Addition from Bob Haworth who was the developer of the Cedar Ridge Addition on the south side of Cedar Ridge Drive. Cedar Ridge Development, LLC also purchased the remaining undeveloped lots in the Cedar Ridge Addition from Mr. Haworth. On September 27, 2021, the City Commission approved Resolution No. 21-2983 to establish a special improvement district for streets, water and sanitary sewer improvements in Phase II of the Cedar Ridge Addition. This development phase contains 14 building lots. As part of their purchase agreement with Mr. Haworth, the Cools completed the final platting of the Cedar Point Addition on the north side of Cedar Ridge Drive. The plat of Cedar Point Addition subdivided this 9.82 acre tract into 22 building lots for single-family home construction. Special Assessment Policy, Resolution No. 18-7556 sets out a two-step review process for the utilization of special assessment financing. The developer first submits an Application and signed Form of Petition requesting approval to utilize special assessment financing for public improvement installation (step one). The initial request for authorization to prepare a preliminary engineer's cost estimate and feasibility report did not include the unimproved portion of Cedar Ridge Drive abutting Cedar Point as staff had not received accurate cost estimates for the Cedar Ridge Drive improvements. Cedar Ridge Development, LLC is responsible for improving Cedar Ridge Drive to City standards either through creation of a separate benefit district or if a benefit district is not approved it would have to be financed privately. No building permits can be issued in the Cedar Point Addition until these street improvements are made. The external improvements to Cedar Ridge Drive will be brought forward as a separate item at a later date. This approach was requested by the applicant, Cedar Ridge Development, LLC. The city commission approved the first phase of this process at their December 20, 2021 meeting on a 4-0 vote. The first phase authorizes city staff to prepare an engineering feasibility report for the public improvements to serve the Cedar Point Addition. Staff has worked with the developers, their engineer and Bond Counsel as plans and cost estimates for the project, including the Cedar Ridge Drive improvements, were developed. FISCAL APPROVAL: BY: FINAL APPROVAL: BY: Nature of Current Request The attached Petition No. 4416 was submitted by Stephanie Cool, managing member of Cedar Ridge Development, LLC on March 2, 2023, requesting certain street, drainage, water, and sanitary sewer improvements to serve 22 residential lots in Cedar Point Addition. The petition, feasibility report and resolution include the improvement to Cedar Ridge Drive. Please see the attached petition and preliminary engineering feasibility report for a detailed description of the benefit district. It is prescribed by Kansas statutes that the City Commission consider a petition for street, drainage, sewer, and water improvements and establish sufficiency on the basis that any one of the following three conditions be met: 1. The petition is signed by a majority of the resident owners of record of property liable for assessment under the proposal. 2. The petition is signed by the resident owners of record of more than half of the area liable for assessment under the proposal. 3. The petition is signed by the owners of record, whether resident or not, of more than half of the area liable to be assessed under the proposal. In this case, Condition No. 3 above is met and therefore meets the statute requirements for sufficiency. The Saline County Treasurer has indicated there are no delinquent special assessment taxes on any property owned by the petitioners. The engineering feasibility report for these public improvements is attached for your review. The report describes the scope of the project, the improvement district, the method of assessment, cost estimate breakdowns for each improvement, and identifies and describes the properties in the benefit district. One -hundred percent (100%) of the cost of the improvements are proposed to be assessed to the benefit district. Costs include construction, engineering, construction contingency, inspection, design, and bonding/interest costs. The property owners may choose to pay their share of the project costs as a lump sum payment or as a special assessment tax over a 20 year period beginning on the date that General Obligation bonds are issued by the city. Resolution 18-7556 regarding financial guarantees provides that the developer must submit a letter of credit, cash or financial securities equal to 20% of the project costs prior to the City awarding any construction contract for the project. FISCAL NOTE: One hundred percent (100%) of the estimated costs of $1,382,204.72 are to be assessed against the improvement district, with a per lot assessment estimated at $62,827.49 ($262/mo). This project will be financed through a temporary note, and rolled into long term bonds when construction is completed and costs finalized. Property owners will have the opportunity to pay the assessment in full prior to the bond issue. If they elect not to do so, the assessment plus related interest costs will be spread over 20 years in equal annual installments. WHEREAS, a petition (the "Petition') was filed with the City Clerk of the Salina, Kansas (the "City") proposing certain internal improvements; and said Petition sets forth: (a) the general nature of the proposed improvements; (b) the estimated or probable cost of the proposed improvements; (c) the extent of the proposed improvement district to be assessed for the cost of the proposed improvements; (d) the proposed method of assessment; (e) the proposed apportionment of the cost between the improvement district and the City -at -large; and (f) a request that such improvements be made without notice and hearing as required by K.S.A. 12-6a0I et seq.; and WHEREAS, the governing body of the City hereby finds and determines that said Petition was signed by the owners of 100% of the property or properties proposed to be included in the improvement district liable for assessment for the proposed improvements, and is therefore sufficient in accordance with the provisions of K.S.A. 12-6a0I et seq. (the "Act"). THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF SALINA, KANSAS: Section 1. Findings of Advisability. The governing body hereby finds and determines that: (a) It is advisable to make the following improvements (the "Improvements"): The curb, gutter, pavement, and grading for approximately 379 lineal feet of Cedar Point Court, 520 lineal feet of Cedar Point Place, and 435 lineal feet of Cedar Ridge Drive (the "Street Improvements"). The installation of approximately 717 lineal feet of storm sewer pipe, inlets, manholes and all appurtenances thereto (the "Storm Drainage Improvements"). The installation of approximately 1,773 lineal feet of eight -inch water main, fire hydrants, valves, fittings, service connections for water lines and all appurtenances thereto (the "Water System Improvements"). The installation of approximately 1,569 lineal feet of eight -inch sanitary sewer main, service connections for sewer lines, manholes, and all appurtenances thereto (the "Sanitary Sewer Improvements"). 600596.20234\RESOLUTION - CEDAR POINT ADDITION (b) The estimated or probable cost of the proposed Improvements is One million three hundred eighty-two thousand two hundred four dollars and seventy-two cents ($1,382,204.72). (c) The extent of the improvement district (the "improvement District") to be assessed for the cost of the Improvements is: Block 1, Lots 1 through 13, and Block 2, Lots 1 through 3 and Lots 5 through 10, all in the Plat of Cedar Point Addition to the City of Salina, Saline County, Kansas. (d) The method of assessment is: Each platted lot in the Improvement District shall be assessed equally per lot. In the event all or part of the lots or parcels in the proposed Improvement District are replatted before assessments have been levied, the assessments against the replatted area shall be recalculated on the basis of the method of assessment set forth herein. Where the ownership of a single lot is or may be divided into two or more parcels, the assessment to the lot so divided shall be assessed to each ownership or parcel on a square foot basis. (e) The apportionment of the cost of the Improvements between the Improvement District and the City -at -large is: 100% to be assessed against the Improvement District and 0% to be paid by the City - at -large. (f) The signers of the Petition, in the aggregate, are the owners of 100% of the property or properties proposed to be included in the Improvement District, and have acknowledge that: (i) The Petition is one submitted pursuant to subsection (c) of K.S.A. 12-604, and amendments thereto; (ii) The proposed Improvement District does not include all properties which may be deemed to benefit from the proposed Improvements; and (iii) The signers' names may not be withdrawn from the Petition by the signers thereof after the Governing Body commences consideration of the Petition or later than seven days after such filing, whichever occurs first. Section 2. Authorization of Improvements. The abovesaid Improvements are hereby authorized and ordered to be made in accordance with the findings of the governing body of the City as set forth in Section I of this Resolution. Section 3. Bond Authority; Reimbursement. The Act provides for the costs of the Improvements, interest on interim financing and associated financing costs to be paid by the issuance of general obligation bonds or special obligation bonds of the City (the `Bonds"). The Bonds may be issued to reimburse expenditures made on or after the date which is 60 days before the date of this Resolution, pursuant to Treasury Regulation 1.150-2. Section 4. Effective Date. This Resolution shall be effective upon adoption. This Resolution shall be published one time in the official City newspaper, and shall also be filed of record in the office of the Register of Deeds of Saline County, Kansas.
