BACKGROUND: On July 25, 1994, the Salina City Commission approved a final plat in Saline County of South Industrial Area No.2 (the current site of Crestwood Cabinets). As part of that plat 70 ft. of road right- of-way was dedicated to the public for a north-south public street (Commerce Street) that was designed and intended to provide access to property north of Water Well Road and east of the Union Pacific railroad tracks. On May 20 1996, the Salina City Commission approved a final plat of South Industrial Area No.3 which extended the right-of-way for Commerce Street another 736 ft. to the north. City Commission approval of these plats was required under the terms of an Interlocal Agreement with Saline County which requires joint approval of plats outside but within 1 mile of the city limits. NATURE OF CURRENT REQUEST: A 45 acre tract of land owned by the Salina Economic Development Corporation was annexed into the city in May of this year. This annexation included the 70 ft. right-of-way for Commerce Street adjacent to the North 1/2 of the South Industrial Area No.3 Subdivision. The 75 acre Samuelson Tract located east of Commerce Street was annexed into the city in September of this year. As part of the annexation agreement between the City and the Samuelsons, they agreed to dedicate a 120 ft. wide strip of right-of-way east of Commerce Street for a major drainage channel that would be built, owned and maintained by the City. The Saline County Commission is now requesting that the City annex and take over maintenance of the remainder of the Commerce Street adjacent to South Industrial Area No.2 and No.3 (see attached letter). If this request is approved this section of Commerce Street right-of-way would come under the City's jurisdiction for maintenance, signage, traffic control and other code enforcement purposes. EXTENSION OF SERVICES PLAN: Commerce Street was constructed from Water Well Road to a point 1 ,400 feet north and financed privately by the Salina Economic Development Corporation. The paving surface is 8" of asphalt on a stabilized base but it is a rural design and has roadside ditches instead of curb and gutter. The current paving width is 28 ft. widened out to 36 ft. at the intersection with Water Well Road. The roadway was never accepted for maintenance by Saline County. The primary financial impact on the City would be adding 1,400 lineal feet of roadway to the city street system for maintenance. Future extensions and improvements to the existing Commerce Street would likely be financed through the creation of a special assessment benefit district. PUBLIC SAFETY NOTE: Staff is concerned that the current platted street name Commerce Street has the potential to be confused with Commerce Circle which is located off of Centennial Road if there was a call for emergency service. There are no buildings or facilities that currently have a Commerce Street address and staff believes a street name change should be considered prior to second reading of the annexation ordinance and before street signs are put up and any addresses are assigned. RECOMMENDED ACTION: Adopt the annexation ordinance on first reading. Second reading is tentatively scheduled for November 8, 2004.
