Engineering Agreement with Wilson and Company for design services to relocate city utilities for the
North Ohio Overpass Project No. 00-1248.
BACKGROUND:
The waterline and sanitary sewer force main relocations are in preparation for the North Ohio
Overpass Project. Portions of a 6-inch and a 12-inch waterline and portion of 20-inch sanitary sewer
force main are in conflict with the proposed construction and must be relocated by March 31, 2005,
three months prior to the bid letting date for the North Ohio Overpass Project. This requirement is
made by KDOT to avoid conflicts between existing utilities and the upcoming overpass construction.
The area for relocation of utilities is generally north of North Street and south of Prospect Avenue.
The waterline relocations include approximately 850 linear feet of 12-inch and 300 linear feet of 6-
inch waterlines. The sanitary sewer force main relocation includes approximately 550 linear feet of
20-inch force main.
The agreement is written in a "cost plus fixed fee" format with an amount not to exceed $12,315.00.
The "cost" includes all direct payroll, direct non-payroll and overhead (indirect costs). The "fixed fee"
is a lump sum amount, agreed upon during negotiations to cover any non-reimbursable costs, pre-
tax profit and readiness to serve. The fixed fee does not change regardless of variations in cost.
The "cost not to exceed" is just that, a total amount that cannot be exceeded without a supplemental
agreement and prior approval of the City Commission. The attached contract also addresses the
scope of work, consultant responsibilities, City responsibilities and general provisions.
FISCAL NOTE:
If approved, the funds for this engineering contract will be allocated from the 2004 Capital
Improvement Programs in the Water and Wastewater System Enhancements category.
RECOMMENDATION:
It is recommended that the City Commission approve the Engineering Agreement with Wilson and
Company in the amount of $12,315.00.
