AGENDA SECTION NO: ORIGINATING DEPARTMENT: APPROVED FOR AGENDA: 7 PUBLIC WORKS ITEM NO. 2 BY: Brad Johnson BY: ITEM: Resolution No. 04-6123 A RESOLUTION SETTING OCTOBER 25, 2004 AS THE PUBLIC HEARING DATE ON THE ADVISIBILITY OF A SPECIAL ASSESSMENT PROJECT INVOLVING IMPROVEMENTS TO A SECTION OF SOUTH MARYMOUNT ROAD. BACKGROUND: Kansas State law (K.S.A. 12-6a01 et seq.) establishes procedures for public improvement projects to be financed by special assessments. Phase II of Marymount Road improvements is planned for 2004-2005 as a special assessment project. This phase is similar to Phase I, completed in 2002. The project involves curb, gutter, drainage and sidewalk improvements on the remaining southern section of South Marymount, between Cedar Ridge Drive and Riverrun Drive. Properties abutting Marymount will benefit, as well as properties in the Riverrun Addition and the Elks Country Club. By prior Annexation Agreements with the City, each of these property owners has agreed to be a part of the special assessment benefit district. Special assessment public improvement projects may be initiated by property owner petition, or initiated by the City. As in this case, when the City initiates a project, a public hearing is required. The formal hearing is planned for the October 25 City Commission meeting. Following that hearing, the Commission may proceed with resolutions of advisability and authorization. Project plans are nearly complete with project bidding and contract award planned prior to year-end; construction would be complete in Spring 2005. FISCAL NOTE: Total project cost is estimated at just under $283,000. Financing details will be provided for the October 25 public hearing. RECOMMENDED ACTION: Consider Resolution No. 04-6123 setting a public hearing date for a proposed South Marymount Road Phase II special assessment project. ADOPTION OF ASSESSMENT The assessment with accrued interest to be levied as a special assessment tax upon the property included within the benefit district concurrent with the general property tax and shall be payable in fifteen(15) equal annual installments. The method of assessment shall be based upon equal assessments for each residential unit within the improvement district. The assessments for Elk's Home Association (Tract #1) is based on the average lot size in Riverrun Addition and are configured on the 500' x 600' tract, less street RIW. The assessments for the RiverRun Addition townhome area (Lot 1, Block 5) are also based on the average lot size in RiverRun Addition and are configured on the Lot 1, Block 5 area, less street RIW.
