96-4985 Eminent DomainCanW&10 Salina (Published in the Salina Journal March / , 1996) RESOLUTION NUMBER 96-4985 A RESOLUTION DECLARING THE NECESSITY OF AND AUTHORIZING A SURVEY AND DESCRIPTION OF THE LAND TO BE CONDEMNED FOR THE PURPOSE OF CONSTRUCTION OF A SANITARY SEWER SYSTEM PUMP STATION TO BE LOCATED NEAR THE SOUTHEAST CORNER OF THE INTERSECTION OF PLAZA DRIVE AND WEST CRAWFORD STREET. WHEREAS, the City of Salina has a crucial need for the construction of a sanitary sewer system pump station near the intersection of Plaza Drive and West Crawford Street; and WHEREAS, the subject property is currently owned by the Union Pacific Railroad Company; and WHEREAS, efforts to negotiate acquisition of the necessary real estate are ongoing, but have thus far been unsuccessful; and WHEREAS, in the interest of the public health, safety, and welfare of its citizens, it is necessary that the City of Salina appropriate the necessary property for use by the City in constructing the sanitary sewer pump station. Kansas: SO NOW, THEREFORE, BE IT RESOLVED by the Governing Body of the City of Salina, Section 1. It is hereby declared to be necessary for the City to appropriate property owned by the Union Pacific Railroad Company located at the intersection of Plaza Drive and West Crawford Street in the City of Salina, Kansas, for the purpose of constructing a sanitary sewer pump station. Section 2. The City Engineer is authorized to make a survey and description of the land to be condemned and to file such survey and description in the office of the City Clerk. Section 3. This resolution shall be effective upon its publication once in The Salina Journal. Adopted by the Board of Commissioners and signed by the Mayor this 26th day of February, 1996.
