Samuelson outlining certain conditions and understandings relating to the annexation of property located at the northwest corner of Water Well Road and Ohio Street in Saline County. Information Roger A. and Marjory W. Samuelson of Thornton, Colorado have requested that a 79 acre tract they own be annexed into the city. The Samuelson's have filed a voluntary petition requesting annexation of a total of 79 acres at the northwest corner of Water Well Road and Ohio Street in order to have access to city utilities and services. There are no immediate plans to rezone or plat this property. The Samuelson's are desirous of making the property marketable for future industrial development. The annexation of the entire Samuelson property is beneficial to the city because it provides a planning framework for nearly 300 acres of land between Ohio Street and the Union Pacific Railroad tracks south of Schilling Road. The proposed Annexation Agreement will also provide the City with the right-of-way needed to complete the construction of north-south drainage ditch to carry runoff all the way from Water Well Road to the Schilling Road ditch and allow the Samuelson property to be included in a sanitary sewer benefit district. Pre-planning for development of this tract at this time, significantly ahead of their development plans could have negative cost impacts to the Samuelsons unless the City takes some cost deferral action. The Samuelsons are agreeable to annexation provided that their share of the cost of a proposed sanitary sewer extension and future Ohio Street public water line improvements can be deferred until building permits are actually issued on the property. Staff believes that an agreement setting out the terms under which the Samuelson Tract is being annexed should be executed and recorded so that there is a record of what the two parties have agreed to. Recording of the agreement would also put future buyers on notice that there are deferred assessments and future hookup fees associated with development of this property. The terms, conditions and public improvement financing options in the attached agreement are almost identical to the terms of the annexation agreement covering the Applequist property to the north.
