FISCAL APPROVAL: BY: FINAL APPROVAL: BY: ITEM: Consider Authorizing the City Manager to execute a contract for traffic engineering services with Wilson & Company in an amount not to exceed $71,675 to study three intersections along Magnolia Road near the Central Mall and perform a signal warrant analysis at Schilling and Ohio. BACKGROUND: City Ordinance 21-11085 for the three Central Mall out -lots located on the north side of Magnolia Road was passed on October 25, 2021 allowing construction of a hotel (Atwell Suites) on the property. The Ordinance was conditioned on modifications being made to the Century Plaza Drive/Highland Avenue intersection at Magnolia Road prior to the issuance of a Certificate of Occupancy. Per the Ordinance language 3(e) "The property owner shall be responsible for making physical modifications to the Century Plaza Drive — Magnolia Road intersection to provide designated turn lanes for exiting vehicles. The intersection improvements must be completed prior to the issuance of a Certificate of Occupancy for the hotel building." Per both the Planning and City Commission concerns regarding traffic safety beyond the Atwell development but in cooperation with this project, the City requested statements of experience, qualifications and interest from consulting engineers for traffic services for the following. 1. Magnolia and Century Plaza Drive/Highland/Mall entrance — possible geometric improvements to delineate north side intersection lanes in conjunction with a new hotel development traffic impact 2. Magnolia and 9th Street — explore dual westbound/southbound left turn lanes and investigate site distance concern/coordination with Century Drive/Highland intersection 3. Ohio and Schilling — perform signal warrant analysis due to increased traffic for possible safety improvements to the intersection Wilson and Company, Inc., Engineers and Architects (WCEA) was the Ione respondent to the request and meets the experience, technical expertise, ability, capacity, and schedule per the City's "Professional Services Selection Guidelines" WCEA has designed multiple road, drainage and intersection improvement projects for Salina including the original Magnolia and gth Street intersection. The attached agreement includes the scope of services summarized as follows. 24 and/or 48 hour with peak hour turning movement counts will be conducted at the below intersections utilizing video -based system deployment and processing a. Magnolia & 9th Street b. Magnolia & Highland/Mall entrance c. Magnolia & Rockhurst Rd/Mall entrance d. Technical memorandum summarizing the data, analysis, alternatives, and improvements with associated cost estimates FISCAL NOTE: Utilize funds from the Sales Tax Street Maintenance Capital Reserve Fund 753 of which $550,000 has not yet been appropriated. The consultant's compensation for four traffic services tasks (traffic counts and three intersections) are not to exceed $71,675. RECOMMENDATION: Staff has identified the following options for the City Commission's consideration. 1.) Approve the selection of Wilson & Company and authorize the City Manager to execute the engineering services agreement with WCEA for traffic related services, in an amount not to exceed $71,675. 2.) Approve the selection of Wilson & Company and authorize the City Manager to execute the engineering services agreement with WCEA for traffic related services with amendments as the City Commission deems appropriate 3.) Postpone consideration of the agreement to a specified date and time and provide staff direction regarding additional information or amendments the City Commission would like to request for further consideration. 4.) Do not approve engineering services agreement with WCEA and provide staff with further direction. Staff recommends Option #1. Task Order SALT22-001 work is defined as: 1. Proiect Initiation: Kickoff, Project Management Plan, QC setup 2. Data Collection: a. 24 -hr and Peak Hour Turning Movement Counts• Turning movement counts conducted (see Task SALT22-004), providing for a 24-hour period at the intersection for 2 Class Counts include Light (FHWA Classes 1, 2, 3, and 5 that are smaller than an ambulance) and Heavy (all other vehicles) classifications shall be utilized. b. Site Visit: Site visit to observe existing conditions and traffic operations. 3. Existing Data Analvsis and Investigation: a. Existing Traffic Analysis: Counts will be analyzed using the latest Synchro software. b. Crash Analysis: The latest 5 years of crash data will be provided by the City of Salina and/or KDOT sources. Crashes within the study area will be analyzed and a summary of the results will be provided. c. Intersection Geometry: Investigate site distance concerns with northbound/southbound left turn lanes. 4. Proposed Conditions: a. Dual westbound/southbound left turn lanes: Investigate constructability of dual lefts. Analyze LOS impacts. b. Northbound/Southbound left turn lane improvements: Review alternative improvements including protected only left turns, lane configuration/alignment changes. Analyze LOS impacts c. Cost Estimates: Prepare budget level cost estimates for improvements. 5. Technical Memorandum: Prepare a technical memorandum that summarizes the analysis and recommendations. 6. Project Management. and Quality Control: General Project Management Tasks, Periodic project updates, 2 review meetings with City of Salina, QA/QC Reviews 7. Assumptions: The scope and fee assume site visit, video -system deployment, and use of site photos, aerial photos, existing plans and mapping. Proposed Conditions: a. Turning Movement Investigation Highland Ave. Investigate safety impacts of full access, right-in/right-out, and left-in/right-in/right-out. b. Rockhurst Rd: Investigate signalization of the intersection. c. Geometric improvements: Review alternative improvements including WB right -in, and WB accel lane, median improvements. d. Implementation Year and No -Build Analysis: A no -build condition and a build condition will be analyzed and compared. e. Horizon Year and No -Build Analysis: A no -build condition and a build condition will be analyzed and compared. f. Cost Estimates: Prepare budget level cost estimates for improvements. 5. Technical Memorandum: Prepare a technical memorandum that summarizes the analysis and recommendations. 6. BE IT ORDAINED by the Governing Body of the City of Salina, Kansas: 4 a Section 1. Findings. In relation to the following described real estate: B Tracts 3, 4 and 5 in the Amended Final Development District Plan, in the Central Mall Subdivision, a replat of a replat of a portion of Meadowlark Acres Addition No. 3 to the City of Salina, Saline County, Kansas. (the "Property") The Governing Body makes the following findings: All conditions precedent for the amendment of the City's Zoning District Map and the rezoning of the Property have been timely met; 2. Because of its proximity to the South 9th Street and Magnolia Road intersection, the Property is more suitable for PDD (C-3) zoning district uses, including hotels, than professional and business offices and other PDD (C-1) zoning district uses. 3. The requested PDD (C-3) zoning would be compatible with the zoning of nearby property to the north and west and consistent with the existing development pattern on the north side of Magnolia Road. 4. Four (4) stories and a 47.50 ft. building height are needed to have a viable hotel project. 5. Needed public utilities and streets are in place to serve the proposed hotel development site. 6. The Property is located within the boundary of the Commercial land use designation, so the requested C-3 zoning of the Property is supported by the Future Land Use Plan map. 7. The current PDD (C-1) zoning district has limited the development options on the Property to the point that it has remained vacant since the Central Mall was originally constructed in the 1980's. Section 2. Amendment. DISTRICT PLANNED DEVELOPMENT C-3 (Shopping Center). The Zoning District Map of the City of Salina, Kansas is amended to rezone the Property as part of DISTRICT C-3 PLANNED DEVELOPMENT. Section 3. Conditions of Approval. Use of the Property shall be subject to all of the conditions, restrictions, and limitations applicable to planned development districts under Ordinance 8526, as amended and as codified in Chapter 42 of the Salina Code. Development of the Property shall be subject to and substantially conform to (a) the amended final development plan approved by the planning commission, incorporated as part of this ordinance, and on file with the zoning administrator and/or city clerk and (b) the following conditions: I . Zoning district regulations. Development and use of the property shall be limited to the w uses permitted in the C-3 (Shopping Center) district and shall be subject to the bulk regulations, use limitations and sign regulations applicable to the C-3 (Shopping Center) district, except as enumerated in sub -point 2 below. Y 2. Variations and modifications. Pursuant to Salina Code Sec. 42-403(a)(12), otherwise applicable district regulations shall be varied or modified as follows: a. A modification of the thirty-five foot (35') building height limitation in the C-3 district to allow a building with a height of forty-seven feet 8 inches (47'8") to be constructed on the property. 3. Additional conditions. Development and use of the Property shall be subject to the following additional conditions: a) A site drainage plan must be submitted, reviewed and approved by the City Engineering, confirming that the majority of the site drainage will be directed to the Central Mall PDD detention pond via the subdivision storm sewer system prior to the issuance of a building permit. b) The Base (100 Year) Flood Elevation (BFE) for this property is 1239 ft. The lowest floor elevation ofany building constructed on this lot shall be at least one (1) ft, above the BFE (at least 1240 ft.). An Elevation Certificate prepared by a Kansas licensed surveyor, confirming that the finished floor elevation and lowest adjacent grade next to the building are at least one (1) ft. above the BFE must be submitted for review and approval prior to beginning vertical construction. c) Signage on Tracts 3,4 and 5 shall be limited to a single monument sign not exceeding 8 ft. in height and wall signs as allowed in the C-3 district. d) All landscaping, sidewalk, circulation, parking, fencing and other improvements shown on the amended final development plan shall be completed prior to occupancy of the hotel building and shall be the responsibility of the property owner. e) The property owner shall be responsible for making physical modifications to the Century Plaza Drive — Magnolia Road intersection to provide designated tum lanes for exiting vehicles. The intersection improvements must be completed prior to the issuance of a Certificate of Occupancy for the hotel building. f) The hotel project shall be completed in substantial conformance with the approved final development plan, landscape plan and associated building elevation drawings which are hereby incorporated by reference. Section 4. Repealer. All prior ordinances relating to the Property are repealed to the extent they are in conflict with this ordinance. Section 5. Summary of ordinance for publication. This ordinance shall be infull force and effect from and after its adoption and publication once by summary in the official city newspaper. a N E F Ordinance No. 21-11085 Summary a On October 18, 2021, the City Commission passed Ordinance No. 21-11085. The ordinance changes the zoning district classification of three (3) Central Mall out lots on the north side of Magnolia Road which are the planned site of a new Atwell Suites hotel from PDD(C-1) Planned Development Restricted Business District to PDD(C-3) Planned Development Shopping Center District.
