WHEREAS, Article 12, § 5 of the Constitution of the State of Kansas (the "Act") empowers cities to deter- mine their local affairs and government and provides that such power and author- ity granted thereby to cities shall be liberally construed for the purpose of giving to cities the largest measure of self-government, including passing charter ordinances which exempt such cities from non-uniform statutes and acts of the Kansas Legis- lature; and WHEREAS, the City of Salina, Kansas (the "City") is a City, as defined in the Act, duly created and orga- nized, under the laws of the State of Kansas; and WHEREAS, K .S.A. 13-10240 is part of an enactment of the Kansas Legislature (K.S.A. 13 1024a et seq.) relating to general improve- ments and the issuance of bonds for such purposes, which enactment is applica- ble to the City, but is not uniformly applicable to all cities within the State of Kansas; and WHEREAS, the City has previously passed Charter Ordinance No. 39, providing different and additional provisions to K.S.A. 13-10240 ; and WHEREAS, the governing body of the City desires to repeal Charter Ordinance No. 39 and, by new charter ordinance, exempt the City from the provisions of K .S.A. 13-10240 and provide substi- tute and additional provi- sions therefor. NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF SALINA, KANSAS: Section l . Exemption K.S.A. 13-1024a. The City of Salina, Kansas (the "City") by virtue of the powers vested in it by Article 12, Section 5, of the Constitution of the State of Kansas, hereby elects ta exempt itself from and hereby make inapplicable to it Section 13- 1024a, Kansas Statutes Anno- tated, that applies to the City, but is part of an enact- ment which does not apply uniformly to all cities, and thereby provides substitute and additional provisions on the same subiect as here- inafter provided. Section 2. Substitute and Additional Provisions. The City of Salina, Kansas hereby adopts the following substitute and additional prov1s1ons of Section 13- 1024a, Kansas Statutes Anno- tated: As a complete alternative to all other methods provided by law, the city may borrow money and issue its bonds for the purpose of paying the proiect costs (which may include acquisition of inter- ests in real estate and archi- Page 2 of3 tectural, engineering, and other professional services) for the following categories of pro i ects: Project Category Description A. ~. Construction, reconstruction, improvement or repair of any street or roadway located within or partially within the city limits and not designated as a main trafficaway pursuant to K.S.A. 12-685 et seq. B. .aw1ges and Viaducts. Construction, reconstruction, improvement or repair of any bridge or viaduct located within or partially within the city limits and not located on a street designated as a main trafficway pursuant to K.S.A. 12-685 et seq. C. Public Parks. Acquisition of land for public park purposes and acquisition, construction, reconstruction, improvement and repair of park and recreation facilities other than those more specif- ically addressed under cate- gories G, H and I below, whether located inside or outside the city limits. D. Public Bujldjng~. Acquisi- tion, construction, recon- struction, improvement or repair of public buildings or acquisition of land for the construction, reconstruction, improvement or repair of public buildings, whether located inside or outside the city limits. E. Storm Water Drainag~ .S.Y~ Improvements, extension, or repair of the storm water drainage systems, whether located inside or outside the city limits. F. Water Works and/or Sanj- 111.r.Y Sewer Sy~. Improvements, extension, or repair of the city-owned water works and /or sanitary sewer systems, and appurte- nances thereto, whether located inside or outside the city limits. G. ti!rnil.Y_filluatic Park. Financing, constructing, equipping, supplying and maintaining a family aquatic park. H. Public Building for Recre- ational Pur~. Acquisition or construction of a public building for recreational purposes and acquisition of land for the construction of a public building for recre- ational purposes I. Bgsebgll/Sottball Facilih'. l.mr:irovements. Reconstruc- tion, improvements, and repair of City owned Base- ball/Softball facilities as intended in the Public Private Partnership Agree- ment with Salina Athletic Partners. Issuance of bonds by the City pursuant to this charter ordi- nance shall require autho- rization by a majority of the votes cast at an election held for that purpose, except, however, that in any calen- dar year the City may issue bonds pursuant to this char- ter ordinance without an election, as follows: ( lJ a maximum of $1 ,000,000 under each of project cate- gories A through E; (2) a maximum of $2,000,000 under each of project cate- gory F ; (3) a maximum of $12,500,000 under each of project cate- gory G; (4) a maximum of $7,000,000 under eoch of proiect cate- gory H; and (SJ a maximum of $4,000,000 under each of project cate- gory I. Page 3 of3 Section 3. Repeoler. Subject to the effectiveness of this Chorter Ordinonce, Chorter Ordinonce No. 39 of the City is hereby repeoled. Section 4. Severability. If any provision or section of this Charter Ordinance is deemed or ruled unconstitu- tional or otherwise illegal or invalid by any court of competent jurisdiction, such illegality or invalidity shall not affect any other provi- sion of this Charter Ordi- nance. In such instance, this Charter Ordinance shall be construed and enforced as if such illegal or invalid provi- sion had not been contained herein. Section 5. Effective Date. This Charter Ordinance shall be published once a week for two consecutive weeks in the official City newspaper, and shall take effect sixty-one (61) days after final publica- tion, unless a petition signed by a number of electors of the City equal to not less than ten percent ( l 0% l of the number of electors who voted at the last preceding regular City election shall be filed in the office of the Clerk, demanding that this Charter Ordinance be submitted to a vote of the electors, in which event this Charter Ordinance shall take effect when approved by a majority of the electors voting at an election held for such purpose. WHEREAS, a petition was filed with the City Clerk for the City of Salina, Kansas {the "City") on April 20, 2022, proposing certain improve- ments pursuant to K.S.A. l2- 6a0l et seq. {the "Petition"); and WHEREAS, the Petition sets forth : {a) the general nature of the proposed improve- ments; {bl the estimated or probable cost of the proposed improvements; (c) the extent of the proposed improvement district to be assessed for the cost of the proposed improvements; (d) the proposed method of assessment; (el the proposed apportionment of the cost between the improvement district and the City at large; and (fl a request that such improve- ments be made without notice and hearing as required by K.S.A. l2- 6a04(a); and WHEREAS, the owners of record of l 00% the property liable to be assessed under the Petition have signed the Petition ; and WHEREAS, no signatures have been withdrawn from the petition before the Governing Body began consideration of the Petition; and WHEREAS, K.S.A. l2-6a04 provides that the Governing Body may authorize and order public improvements without notice and hearing after a sufficient petition has been filed; and WHERE AS, the Governing Body has reviewed and considered the Preliminary Engineering Estimate and Feasibility Report prepared by the City Engineer and agrees with the conclusions set forth therein. NOW THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF SALINA, KANSAS, AS FOLLOWS: Section l . The Governing Body hereby finds that the Petition is sufficient, and further finds and determines that it is necessary and advisable to make the follow-ing improvements: {a) The nature of the improvements are as follows: The curb, gutter, pavement, and grading for approxi- mately l ,460 lineal feet of Crystal Lake Drive, 980 lineal feet of Shoreline Drive and 220 lineal feet of Crystal Place (the "Street Improve-ments"). The installation of approxi- mately l,330 lineal feet of storm sewer pipe, inlets, manholes and all appurte- Page 2 of3 nonces thereto (the "Storm Drainage Improvements"). The installation of approxi- mately 1,490 lineal feet of eight-inch water main, fire hydrants, valves, fittings, and all appurtenances thereto (the "Water System Improvements"). The installation of approxi- mately 1,520 lineal feet of eight-inch sanitary sewer main, service connections for sewer lines, manholes, and all appurtenances thereto (the "Sanitary Sewer I mprovements"l. (collectively, the "Improve- ments"). (b) The estimated cost of the Improvements is: One million seven hundred eleven thousand eight hundred ninety dollars and four cents ($1,711,890.04). (c) The extent of the improvement district to be assessed are: Block 4, Lots 16 through 20, Block 6, Lots 2 through 6, Block 7, Lots 1 through 7 and Block 8, Lots 2 through 21, all in the Stone Lake Addi- tion to the City of Salina, Saline County, Kansas. (the District"). "Improvement (d) The apportionment of cost between the Improve- ment District and the city at large is: One hundred percent (100%) of the total cost of the Improvements shall be assessed to the Improvement District and zero percent (0%) shall be paid by the City at Large. (e) The method cf assess- ment against property within the Improvement District shall be : The costs of the Improve- ments shall be assessed to the Improvement District as shown below (shewn as a percentage of the total actual costs of the Improvements assessed per lot): *Computation intended as follows: Total cost of Improvement x % of Cost Assessed Per Lot -Cost to be assessed to lot In the event a II or part cf the lots or parcels in the proposed Improvement District are replotted before assessments have been levied, the assessments against the replotted area shall be recalculated on the basis of the method of assessment set forth herein. Where the ownership of a single lot is or may be divided into two or more parcels, the assessment to the lot so divided shall be assessed to each ownership or parcel on a square foot basis. Section 2. The Governing Body hereby declares that the Improvements described in this Resolution are neces- sary, and authorizes them to be made in accordance with the Petition and the findings set forth in this Resolution, and further authorizes the levying of assessments and the issuance of bonds there- Page 3 of3 for, all in accordance with K.S.A. 12-6a01 et seq. Section 3. The City expects to make capital expenditures from and after the date of this Resolution in connection with the Improvements described herein, and intends to reimburse itself for such expenditures with the proceeds of one or more series of general obligation bonds and temporary notes {collectively, the "Bonds") of the City in the maximum principal amount of $1 ,711,890.04. The Bonds may be issued to reimburse expenditures made on or after the date which is 60 days before the date of this Resolution, pursuant to Trea-sury Regulation 1.150-2. Section 5. The City Clerk shall file o certified copy of this Resolution with the Register of Deeds of Saline County, Kansas. Section 6. WHEREAS, a petition was filed with the City Clerk for the City of Salina, Kansas (the "City") on April 19, 2022, proposing certain improve- ments pursuant to K.S.A. 12- 6a01 et seq. (the "Petition"); and WHEREAS, the Petition sets forth: (a) the general nature of the proposed improve- ments; (bl the estimated or probable cost of the proposed improvements; (cl the extent of the proposed improvement district to be assessed for the cost of the proposed improvements; (d) the proposed method of assessment; (e} the proposed apportionment of the cost between the improvement district and the City at large; and (fl a request that such improve- ments be mode without notice and hearing as required by K.S.A. 12- 6o04(o}; and WHEREAS, the owners of record of 100% the property liable to be assessed under the Petition have signed the Petition; and WHEREAS, no signatures hove been withdrawn from the petition before the Governing Body began consideration of the Petition; and WHEREAS, K.S.A. 12-6a04 provides that the Governing Body may authorize and order public improvements without notice and hearing after a sufficient petition has been filed; and WHEREAS, the Governing Body hos reviewed and considered the Preliminary Engineering Estimate and Feasibility Report prepared by the City Engineer and agrees with the conclusions set forth therein. NOW THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF SALINA, KANSAS, AS FOLLOWS: Section l. The Governing Body hereby finds that the Petition is sufficient, and further finds and determines that it is necessary and advisable to make the follow- ing improvements: (a} The nature of the improvements are as follows: The curb, gutter, pavement, and grading for approxi- mately 383 lineal feet of Kosyn Lone, 595 lineal feet of Huntwood Drive, 136 lineal feet of Deer Hollow Lone, and 71 lineal feet of Dunnwood Drive (the "Street Improvements"} and The installation of approxi- mately 121 lineal feet of storm sewer pipe, inlets, Page 2 of 3 manholes and all appurte- nances thereto (the "Storm Drainage Improvements"). The installation of approxi- mately 797 lineo I feet of six- inch and 140 lineal feet of eight-inch water main, fire hydrants, valves, fittings, service connections for water lines and all appurtenances thereto (the "Water System I mprovements"J. The installation of approxi- mately 806 lineal feet of eight-inch sanitary sewer main, service connections for sewer lines, manholes, and all appurtenances thereto (the "Sanitary Sewer Improvements"). (collectively, the "Improve- ments"). (b) The estimated cost of the Improvements is: Seven hundred seventy-nine thousand two hundred fiftY- one dollars and twenty-five cents ($779,251.25). (c) The extent of the proposed improvement district to be assessed is: Block 5, Lots 6 through 9; Block 6, Lots 2 through 3; Block 7, Lots 1 through 9; Block 8, Lot 1. all in Magno- lia Hills Estates Addition No. 2 to the City of Solina, Saline County, Kansas. (collectively, the "Improve- ment District"). (d) The apportionment of cost between the Improve- ment District and the City at Large is : One hundred percent (100%) of the tote I cost of the Improvements shall be assessed to the Improvement District and zero percent (0%) shall be paid bY the City at Large. Each platted lot in the Improvement District shall be assessed equally per lot. In the event a 11 or part of the lots or parcels in the proposed Improvement District are replotted before assessments have been levied, the assessments against the replotted area shall be recalculated on the basis of the method of assessment set forth herein. Where the ownership of a single lot is or may be divided into two or more parcels, the assessment to the lot so divided shall be assessed to each ownership or parcel on a square foot basis. The Governing Body hereby declares that the Improvements described in this Resolution ore neces-sary, and authorizes them to be mode in accordance with the Petition and the findings set forth in this Resolution, and further authorizes the levying of assessments and the issuance of bonds there- fore, all in accordance with K.S.A. 12-6001 et seq ..
