RESOLUTION NUMBER 96-5041
A RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE A
CORRECTED SPECIAL WARRANTY DEED TO CPV HEALTH CARE CENTER, INC.
WHEREAS, on December 18, 1995, the City Commission adopted
Resolution Number 95-4964 approving the proposed sale of College Park Village
Retirement Center -Nursing Center and Community Center, and authorized the
mayor to execute a Special Warranty Deed to CPV Health Care Center, Inc.;
and
WHEREAS, that Special Warranty Deed was signed by the mayor,
delivered to the trustee, and recorded following closing of the transaction; and
WHEREAS, after the recording of the deed one of the dimensions in
the legal description appeared to be incorrect; and
WHEREAS, further investigation revealed that correction deeds were
recorded for the transfer of title from College Park to College Park Village
Limited Partnership, and in turn from College Park Village Limited Partnership
to the City of Salina; and
WHEREAS, neither the City Attorney nor the Trustee was aware at
the time of preparation of the deed from the City to CPV Health Care Center,
Inc., that the corrected recordings had been made on the earlier
transactions. SO NOW THEREFORE
BE IT
RESOLVED by the governing body of the
City of Salina,
Kansas:
Section
1.
The proposed
Corrected Special
Warranty Deed
includes the identical
legal description
as the rerecorded deed
conveying title
from College Park
Limited
Partnership to
the City in 1985.
Section
2.
The Mayor is
authorized to execute
the Corrected
Special Warranty Deed
conveying title to
the Facility from the City to CPV.
Section
3.
This resolution
shall be in full force
and effect from
and after its adoption.
Adopted by the Board of Commissioners and signed by the Mayor
this 5th day of August, 1996.
