RESOLUTION NO. l U" A RESOLUTION DECLARING IT NECESSARY TO ALTER, REPAIR, RECONSTRUCT, EXTEND, ENLARGE AND IMPROVE THE COMBINED WATER AND SEWAGE SYSTEM OF THE CITY OF SALINA, KANSAS; TO ISSUE COMBINED WATER AND SEWAGE SYSTEM REVENUE BONDS OF THE CITY, IN AN AMOUNT NOT TO EXCEED $2,465,000, FOR THE PURPOSE OF PAYING COSTS THEREOF AND RELATED BOND RESERVES AND FINANCING COSTS; AND PROVIDING FOR THE GIVING OF NOTICE OF SAID INTENTION OF THE CITY. WHEREAS, the City of Salina, Kansas (the "City") presently owns and operates a combined water and sewage system (the "System"); and WHEREAS, the governing body of the City hereby finds and determines it to be necessary to alter, repair, reconstruct, extend, enlarge and improve the System, and that the costs thereof should be financed by the issuance of combined water and sewage system revenue bonds of the City, under authority of K.S.A. 12-856 el 5gq, and K.S.A. 10-1201 gl sq., all as amended and supplemented (collectively, the "Act"). THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF SALINA, KANSAS: SECTION 1. It is hereby deemed and declared to be necessary to alter, repair, reconstruct, extend, enlarge and improve the System in the following particulars, to -wit: Acquiring, constructing and reconstructing three pump stations and related telemetry equipment for the sewage portion of the System (the "Project") at an estimated acquisition and construction cost of $2,215,000 and to enter into contracts in connection with the Project. SECTION 2. It is necessary to issue combined water and sewage system revenue bonds of the City, in an amount not to exceed $2,465,000 (the "Bonds"), under authority of the Act, to pay the costs of the Project and related bond reserves and financing costs. SECTION 3. Before issuing the Bonds, there shall be published one (1) time in the official newspaper of the City, a notice of the intention of the governing body to undertake the Project and to issue the Bonds; and if within fifteen (15) days after the publication of such notice, there shall be filed with the City Clerk , a written protest against the Project or the issuance of the Bonds, signed by not less than twenty per cent (20%) of the qualified electors of the City, the governing body shall thereupon submit such proposed Project and the proposed Bonds to the electors of the City at a special election to be called for that purpose as provided by the Act. If no sufficient protest is filed with the City Clerk within the period of time hereinbefore stated, then the governing body of the City shall proceed to authorize the Project and to issue the Bonds. SECTION 4. The City expects to incur capital expenditures on and after the date of adoption of this Resolution (the "Expenditures") in connection with the Project, and intends to reimburse itself for such Expenditures with the proceeds of the combined water and sewage system revenue bonds of the City in the maximum principal amount of $2,465,000.
