These requirements are found in Chapter 8, Article III; Sections 8-171 through 8-200.4 of the Salina Municipal Code (SMC). The ordinance established licensing categories, testing requirements, insurance requirements, and continuing education requirements, as well as enforcement, discipline, expiration and renewal of a licenses. The Building Advisory Board (BAB) played an active role in making final recommendations to the City Commission following BAB public meetings and study sessions over a period of time beginning in the spring of 2005 and concluding in the fall of 2006. The enclosed charts show current licensing categories, and summarize general requirements and the available test for each license category. • A test administered by a nationally recognized testing agency (Test) or possession of a bachelor's degree in engineering, architecture, construction management or construction science from an accredited college or university (Related Degree) is required for all Class A, B, & C Contractors and all Specialty Contractors. Specific tests are required and are shown on Exhibit A. A minimum score of 75% is required to be considered a passing test score. • Specialty Contractors are listed as concrete, framer or erector, roofing, masonry, fire sprinkler, fire alarm & communications, demolition, sign, right -of way and swimming pool. • A, B, & C contractors can perform any of the specialty contractor or registered craftsman work except for swimming pools, lawn/landscape irrigation, fire alarm & communication systems, fire sprinkler systems, and hood and spray booth suppression systems. • Continuing Education requirements apply to the Class A, B, & C contractors which are general building contractors. Six hours per year, or 18 hours of continuing education over the 3 year licensing period is required to be met by the declared qualified individual as listed on the license. • Specialty Contractors are not required to obtain continuing education credits. • Proof of minimum liability insurance is required for all licensed contractors and registered craftsmen. Current requirement: $500,000 general liability insurance. Current Problem Prometric is the testing company that the City of Salina refers contractors to in order to take construction exams for Specialty Contractors not offered by the International Code Council (ICC) or the National Institute for Certification in Engineering Technologies (NICET). ICC provides testing for A, B & C Contractors as well as Specialty License types of Concrete and Roofing. NICET provides testing for hood and spray booth suppression, fire sprinkler, and Fire alarm/ communication. Prometric provided testing for Framers/Erectors, Masonry, Demolition, Swimming Pool and Lawn/Landscape Irrigation. Under the current code, Class A, B, C contractors can perform specialty contractor scopes of work with the exception of, fire alarm & communication systems, fire sprinkler systems, and hood and spray booth suppression systems. Of that list, Swimming Pools and Lawn/Landscape Irrigation have no test available to grant a specialty contractor license. (SMC Section 8-172.1 Chart 1 Specialty Contractors) The table below shows how surrounding communities that have contractor licensing are handling the lack of testing options. Kansas Plumbing Heating and Cooling Contractors (KPHCC) provides an exam created by K -State for Lawn/Landscape Irrigation and Irrigation.org offers a class and test to be Certified Irrigation Designer (CID). Other communities let licensed plumbing contractors install irrigation systems. For Swimming Pool Contractors, other communities allow class A, B, & C General Contractors install swimming pools and do not require special testing. Partly because there is no test readily available and because the skills needed are similar to other construction requirements. A licensed electrician is still required to perform all electrical, grounding and bonding of the pool work and nearby surfaces. At this time there are no other testing options available for Framers/Erectors, Masonry, or Demolition contractors, but these types of specialty disciplines can legally be done by A, B, & C General Contractors as currently written in Salina Municipal Code. Current license holders in the city include: 6 Masonry, 7 Framer/Erector, and 3 Demolition contractors. As noted in the draft ordinance, these specialty contractor license holders who took the Prometric test will remain valid, provided they renew their licenses without interruption. If new specialty contractors come to Salina and apply for license, they will need to either provide certification of passage of A, B, & C General Contractor test (Provided by ICC) or provide proof of a related degree. Another option brought to the BAB was to allow the Specialty Contractor license types affected to become Registered Contractors. This means that no testing would be required and only proof of insurance would be needed to obtain a license. After much discussion, the Board agreed to not recommend any changes to other license types and keep the requirement that without available testing, Class A, B & C Contractors, or currently licensed Specialty Contractors would be needed to perform specialty work. The board decided by a vote of 7-0 to recommend adoption of ordinance #22-11095 Staff has prepared SMC chapter 8 code amendments for review that would allow A, B, & C General Contractors to install swimming pools. Mr. Pilcher stated correct that was the code amendment they are being asked to review today. He added that they were also being asked to consider other testing options for contractors who no longer have Prometric testing available. Kevin Cool asked if plumbing contractors could do lawn/landscape irrigation work now. Mr. Pilcher stated plumbing contractors can only install the backflow preventer for the system, but can't install the whole system. David Miller asked for clarification on amendment of the code regarding lawn/landscape irrigation contractors. Mr. Pilcher stated that was correct, they had to take a Prometric test and carry their own license to do that scope of work. He added that no continuing education was required, but testing was. David Miller asked if that test was one not available now. Mr. Pilcher stated correct, Prometric no longer offers that test. David Holmgren asked if there were other testing options. Mr. Pilcher stated K -State made a test for lawn/landscape irrigation contractors, but Kansas Plumbing, Heating & Cooling Contractors (KPHCC) are the ones who provide the test. Mike McCall asked if that test was different than the irrigation test offered by Prometric. Mr. Pilcher stated they were two different tests, but were similar in nature. David Miller stated he would still like to see a test offered for lawn/landscape irrigation contractors. Mr. Pilcher stated he's looked at the overview for the test, but hasn't seen the actual test. He added the Prometric test and K -State test are similar in nature and should accomplish the same thing. Mr. Pilcher stated if the Board is fine with that staff will move forward with referring contractors to that test option in the future. David Miller asked if any action was needed. Mr. Pilcher stated no action is needed unless they would prefer to allow plumbing contractors to do lawn/landscape irrigation work, which would then require a code change. Greg Nichols asked if the original lawn/landscape irrigation test was only offered by Prometric. Mr. Pilcher stated it was the only one the City accepted. He added that nobody had provided any test or credential other than that one. BUILDING ADVISORY BOARD I MINUTES <Date> Page 2 of 6 Greg Nichols asked if that was the only authorized test and it's no longer available then contractors now have no ability to obtain a lawn/landscape irrigation license. He then asked if that means action needs to occur for them to continue being able to obtain licensing. Mr. Pilcher stated it doesn't require a code change, so no action is really needed. He added that the question today is if they want to accept other tests or follow in the footsteps of other communities that allow plumbing contractors to do the work. Greg Nichols asked for clarification that a code change is not needed to change the testing option and can be done administratively. Mr. Pilcher stated that was correct. David Miller asked if plumbing contractors needed to take the test to allow them to do irrigation work, or would they be grandfathered in. Mr. Pilcher stated a plumber carries a separate license, so no they would not be grandfathered in. William McBride stated he prefers the plumbing contractors and lawn/landscape irrigation contractors stay separate as well. Mr. Pilcher asked for confirmation that they were just changing the testing options at this time. The Board agreed on changing the testing options for lawn/landscape irrigation contractors. Mr. Pilcher stated that item didn't require any action, however, the item that requires action pertains to allowing general contractors to build swimming pools. MOTION: Greg Nichols moved to accept the draft ordinance that removes swimming pool exceptions for Class A, B and C contractors. SECOND: David Holmgren VOTE: Motion Carried (7-0) Mr. Pilcher stated framers/erectors, demo and masonry contractors no longer have a test option, however, that scope of work is already covered under Class A, B and C contractors. He added that if someone wishes to obtain any of those specialty licenses they would need to pass a Class A, B or C contractor test of have a related degree. Mr. Pilcher stated there was also talk of listing those specialty contractors as registered craftsman without a test requirement. Mr. Pilcher stated the amendment pertaining to allow swimming pool work under a Class A, B or C contractor license will go before the City Commission on January 3, 2022 in order to allow input from the Board first. Greg Nichols stated framing/erecting is already an important part of holding a Class A, B or C contractor license. He added he is not worried about the demolition one if someone is demolishing an entire structure, but would be concerned if it was only a partial demolition due to the structural integrity of the rest of the building that a contractor would need to know how to handle. Greg Nichols stated masonry would fall under Class A, B and C as well. BUILDING ADVISORY BOARD I MINUTES <Date> Page 3 of 6 Mr. Pilcher asked if the Board was in favor of not changing the code on those licenses either and leaving it as is until other testing options are available for those specialty contractors. David Miller asked what the possibility was of new tests coming in. Mr. Pilcher stated swimming pools was the closest one to offering a test with another being offered by PSI. He added that they do some construction testing currently and close to having one for swimming pools, however, he isn't aware of any other test options. David Miller asked if insurance companies look at these companies before insuring them to verify competency. Mr. Pilcher stated he wasn't sure what these companies looked at as far as competency. David Miller stated he would hate to see someone come from out of town without the same credentials as the local contractors. He added that it seems there is no choice but to stay with requiring testing or credentials similar to A, B or C contractors. Mr. Pilcher stated a contractor can still submit a related degree in lieu of taking a test for any of those specialty contractor licenses. Greg Nichols stated a framer/erector can still come in and work under a general contractor's license still giving them insurance coverage from that general contractor. Mr. Pilcher said that would generally work unless it is a smaller project where only that specialty is needed and there is no general contractor. Administrative Items (3.3.1) New foundation design Sean Pilcher, Building Official, presented the staff report contained in today's meeting packet David Miller brought up previous discussions regarding the perforated pipe drain and that he recalls it being decided to be placed inside under the slab due to groundwater hitting the slab before it gets to the drain. Mr. Pilcher stated drains are typically installed inside and that the drain is required whether inside or outside. He added that most of the time it is placed inside due to the radon mitigation system requirement. Mr. Pilcher clarified that it should state it is optional inside or outside and will have staff watch out for that in the field. Greg Nichols asked if when it states "optional" if that means whether they need it or not. Mr. Pilcher stated it's optional either inside or outside, however, both are required if close to the levee. He added there's no action needed it is just informational about what is going on in the department.
