TRANSFER
OF CITY PARK LAND TO

At its regular meeting on
August 23, 2021, the Governing
Body of the City of Salina
authorized publication of notice
pursuant to K .S.A . 12-1301 of
the proposed transfer of a 3.66-
acre tract of land within Jerry
Ivey Park to USP 305,
including the existing four
tennis courts and sufficient
area north and east of the
existing tennis courts to
construct four new tennis
courts and a hitting wall (the
"Park Property') by Kansas
Limited Warranty Deed with
Reversionary and Limited
Warranty Covenants and
Retained Easement (the
"Deed"). Under the proposal,
USP 305 will assume
responsibility for repair,
maintenance, and replacement
costs associated with the
existing four tennis courts in
Jerry Ivey Park while assuring
that public access will be
maintained to the same
number of tennis courts,
subject to the terms of the
Deed . The existing send
volleyball court and basketball
court currently located on the
Park Property are tentatively
planned to be relocated within
Jerry Ivey Park, subiect to the
discretion of the City to
relocate, maintain, and/or
discontinue these sand
volleyball and basketball
courts in a manner similar to
other offerings throughout the
City's park system . The Deed
retains an easement for the
City for so long as the City
continues to operate and
maintain the existing wooded
walking trail, a portion of
which is located on the Park
Property, for public
recreational use. The Deed
provides that USP 305 shall be
required to convey the Park
Property back to the City if
USP 305 : (1) fails to resurface
the existing courts within 365
days after the recording date
of the Deed or within a revised
deadline under certain
conditions; (2) fails to allow
the City the first right of
r efusal at no cost for the
currently inoperable lighting
system at the existing courts if
and when the lighting system
is to be removed at the
discretion of the USP 305 ; (3)
fails to reconstruct the existing
courts to an equivalent
standard as the new courts
when constructing the new
courts or within a revised
deadline under certain
conditions; (4) fails to allow
year-round public access at no
cost to at least four tennis
courts for tennis play during
the same hours Jerry Ivey
Park is open to the public, with
certain exceptions for school-
related uses ; (5) fails to use
the tennis facilities other than
the public courts for tennis
play for a period of 18 months,
followed by written notice from
the City specifying the duration
of a cure period of no less than
six months during which USP
305 fails to resume use of the
tennis facilities other than the
public courts for tennis play ;
ar (6) contracts to convey,
attempts to convey, or does
convey title to the Park
Property to any other party .
