Filing of Evergy's Acknowledgement
JoVonna, as we discussed based upon Mike's direction, please file the attached documents together for safe keeping as
though they were an agreement between the City and Evergy Kansas Central, Inc. The Acknowledgement (first
attachment) now includes as its Exhibit A the Exhibit A attached to Evergy's Petition for Condemnation, as called for in
the Acknowledgement. I'm recommending that both documents be filed together because the Acknowledgement
makes reference to sections of the Petition for Condemnation.
Evergy's Condemnation Proceedings
Mike, when discussing the filing of Evergy 's Acknowledgement with JoVonna, I was able to see the pleadings that have
since been received in the Evergy Condemnation. Two matters seemed noteworthy:
1. Appraisers hearing . Judge Hickman appointed Jeff Holgerson, Jeff Maes, and Chris Rost as the appraisers. The
appraisers' hearing has been scheduled for 11:00 a.m. on Tuesday, June 22, 2021 at the Courtyard by
Marriott. With our success in obtaining Evergy's Acknowledgement addressing the relationship between the
easement Evergy is acquiring and the City's platted drainage easement, I expected the City would not be
pursuing compensation on the basis of any alleged detriment to the City's interest in the platted drainage
easement. If I'm incorrect, we should discuss how the City wishes to approach both the appraisers' hearing and
the Court's ultimate apportionment of the appraisers' award .
2. Dismissal of UPRR based upon its disclaimer of interest. It was good to learn from the Notice of Dismissal of
Defendant UPRR Company filed by Evergy's counsel on May 14, 2021 that UPRR filed a disclaimer of any right,
title, or interest in the real property affected by the Evergy condemnation. We were interested in learning of
UPRR's position in the matter, particularly because it potentially related to the status of the platting of Schilling
Subdivision No. 5, which included the abandoned railroad ROW south of Schilling Road and is the basis for the
platted drainage easement in which the Centennial Ditch enhancements are to be constructed .
I again want to thank everyone for their prompt assistance in addressing the concerns prompted by Evergy's

ACKNOWLEDGEMENT OF PLATTED DRAINAGE EASEMENT
IN RELATION TO CONDEMNED UTILITY EASEMENT
This -1st day of June 2021, Evergy Kansas Central, Inc., ("Evergy") makes the following
Acknowledgement of Platted Drainage Easement in Relation to Condemned Utility Easement
("Acknowledgement).
Evergy has filed its Petition for Condemnation in Saline County District Court Case No. 2021-
CV-000071-RD ("Petition") to acquire a Right-of-Way identified as "Permanent Easement No. 1" legally
described and depicted on Exhibit SAD-005 attached to and incorporated in the Petition as "Exhibit A,"
also attached and incorporated herein. Ambiguities in title caused the need for the Petition. Evergy
acknowledges that:
1. Permanent Easement No. 1 is located within a drainage easement depicted on pages 6 and 7
of the plat of Schilling Subdivision No. 5, City of Salina, Saline County, Kansas, recorded on
August 29, 1999 in Plat Book A-11 at Page 29 of the records of the Saline County Register of
Deeds (the "Drainage Easement");
2. The persons executing the plat certified: "This is to certify that [] the undersigned own a
portion of the land described in the plat, and that they have caused the same to be surveyed
and subdivided as indicated thereon , for the uses and purposes therein set forth and does
hereby acknowledge and adopt the same under the style and title thereon indicated. All street
rights-of-way as shown on this plat are hereby dedicated to the public. An easement or
license to the public to locate, construct and maintain or authorize the location, construction
and maintenance of poles, wires, conduits, water, gas and sewer pipes or required drainage
channels or structures under or upon the area marked for easements on this plat is hereby
granted.";
3. The description of prior easements in paragraph 7.I. of the Petition is intended to include the
Drainage Easement, always subject to Evergy and the City of Salina, Kansas ("City")
exercising their respective rights and privileges in a spirit of mutual accommodation; and
4. The anticipated enhancement by the City of what is commonly known as the "Centennial
Ditch" located within Drainage Easement to address the current intermittent flooding of
Centennial Road and its environs is substantially the same as the City's use of the Drainage
Easement existing at the time of the filing of the Petition.
This Acknowledgement is executed on the date first appearing above by a duly authorized
representative ofEvergy and shall be binding upon Evergy and its successors and assigns.

4. The taking of private property by eminent domain as described in this Petition is
for public use pursuant to K .S .A . § 26-50 I a , is for property to be used for the operation of
facilities necessary for the provision of Plaintifrs services , and is necessary to the lawful
corporate and public purposes of the Plaintiff to facilitate the expansion and
improvement of transmission and distribution of electric services .
5. The Plaintiff has performed all acts necessary to exercise the power of eminent
domain pursuant to K .S .A . §§ 26-501 , et seq. and has been authorized to take these actions.
6 . In order for the Plaintiff to carry out its lawful corporate purposes, powers and
duties as stated herein , it must acquire, by exercise of the right of eminent domain under K .S.A.
§§ 26-50 I , et seq., easements on the following described lots , parcels or tracts of land .
TRACT SAD-005
The ·'Entire Ownership Tract" upon which the Right-of-Way is located is described as:
All of Lot 2 , and that part of Lots 3, 4 and 5 , Block 13 , of "'Schilling Subdivision
No . 5", in the City of Salina, as recorded in Plat Book A-11 , at Page 29 of Saline
County, Kansas, and being a portion of the Northwest Quarter of Section 2,
Township 15 South, Range 3 West of the 6th Principal Meridian , and more
particularly described as follows :
Beginning at the Northeast Comer of said Lot 2 , also being a point on the South
Right-of-Way line of Schilling road, as now established; thence along the East

It being the intent of this instrument to extend the easement to include that land now lying
in the road, alley or railroad right of way which \vould revert in case of vacation or
abandonment thereof, said land being more particularly described as:
All that part of the Northwest Quarter of Section Two (2), Township Fifteen ( 15) South,
Range Three (3) West of the 6th P .M ., lying in existing road right of way area of
Schilling Road, per said "SCHILLING SUBDIVISION NO. 5" plat, and being more
particularly described as follows:
Beginning at the Northeast corner of said Lot 2; thence S89°34'02"W along the North
property line of said Lot 2, a distance of 70.00 feet; thence leaving said North property
line, N00°20' l 4"W a distance of 50 .12 feet to a point on the center line of said Schilling
Road right of way; thence along said center line, N89°39'46"E a distance of 70.00 feet to
a point on a projected line, being the East line of said Lot 2; thence leaving said center
line, S00°20'14"E along said projected line, a distance of 50.00 feet to the Point of
Beginning;
Said tract contains 0.08 acres, more or less.
The nature of the easement, interest and rights to be taken are described in this Petition
and below in Paragraph 7.

7. The nature of the pennanent easement, interest and rights acquired by Plaintiff, on
its own behalf and on behalf of its successors and assigns , (hereinafter collectively referred to as
the "Utility"), as to each applicable separate Entire Ownership Tract is as follows:
A. A PERMANENT EASEMENT to alter, conduct surveys, construct, erect, inspect,
install, maintain , operate, rebuild, reconstruct, relocate, remove, renew, repair and
replace electric transmission and distribution lines and their appurtenances under
varying conditions of operation, including the poles, towers , anchors , guys, crossanns,
insulators , conductors, conduit, ducts, cables, communication systems and other
fixtures and equipment appurtenant thereto for the transmission and/or distribution of
electric energy in , along, under, across, and over the Right-of-Way (individually and in
any combination referred to as the "Rights").
B. The right of ingress to and egress from the Right-of-Way on the Entire Ownership
Tract for the purpose of Utility exercising the Rights ("Access Rights"). Utility shall
exercise the Access Rights in a reasonable and appropriate manner as detennined in
the good faith exercise of its discretion, such as, for example, Utility will use existing
roads and lanes when practicable and otherwise use routes, in its discretion, that are
not unnecessarily disruptive to Defendants, according to their respective property
interests, and their respective heirs, successors and assigns (hereinafter referred to as
the "Defendant"), and shall not exercise such rights in or on buildings outside the
Right-of-Way .
C. The right to briefly enter onto the Entire Ownership Tract and make examination,
surveys and maps thereof, but only to the extent such entry and use does not deprive or
limit the use of any part of the Entire Ownership Tract, except as otherwise pennitted

under this Easement. Utility shall exercise its right of entry onto the Entire Ownership
Tract for examination, survey and mapping under this paragraph in a reasonable and
appropriate manner as determined in the good faith exercise of its discretion, such as,
for example, Utility will use existing roads and lanes when practicable and otherwise
use routes, in its discretion, that are not unnecessarily disruptive to Defendant, and
shall not exercise such rights in or on buildings outside the Right-of-Way.
D. The right to erect and use gates in all fences that cross or obstruct access or that shall
hereafter cross or obstruct access to the Right of Way on the Entire Ownership Tract.
Utility shall also have the right to trim, remove, eradicate, cut and clear away any
trees, limbs, brush and vines ("Woody Vegetation") on the Right-of-Way now or at
any future time, and to do same to Woody Vegetation adjoining the Right-of-Way
whenever in its judgment such Woody Vegetation will interfere with or endanger the
exercise of the Rights. All Woody Vegetation shall be burned or removed by Utility
unless otherwise agreed.
E. Defendant may cultivate, use and enjoy the land in the Right-of-Way ("Use"), subject
to the safe exercise of same and provided such Use shall not, in the reasonable
judgment of Utility, interfere with or endanger the Rights, and provided further that no
improvements (including buildings or structures) shall be located, constructed or
otherwise placed on the Right-of-Way without the prior written consent of Utility,
which consent shall not be unreasonably withheld. Utility shall have the right to
remove existing improvements owned by the Entire Ownership Tract's owner or
his/her/its tenants (including buildings or structures, but not including fences that are
under ten (10) feet in height) on the Right-of-Way whenever in Utility's judgment

such will interfere with or endanger the Rights.
F. As a non-exhaustive part of the Use, Defendant shall specifically be afforded
continued vehicular surface travel, livestock grazing and crossing, water detention and
retention (with Utility approval), flood protection systems, water flow and drainage ,
the loading or unloading of vehicles , parking, displaying and storing equipment and
noncombustible materials (with adequate clearances), frontage and ingress and egress
upon and across the Right-of-Way to existing public streets or rights of way,
substantially similar to Defendant's Uses existing at the time of the filing of this
Petition , subject to the safe exercise of same and Utility 's right to temporarily regulate
or restrict the Use when reasonably necessary for construction or work on the
easement, provided that such construction or work is performed with reasonable
diligence to minimize adverse effects on business operations and/or residences. Uses
other than as identified above arising after the time of filing shall be permitted in
compliance with this paragraph upon the prior written consent of Utility, which
consent shall not be unreasonably withheld.
G. As required under K.S.A . § 66-1 , 183 or otherwise in the event Utility causes
physical damage to the Right-of-Way or the Entire Ownership Tract from the
exercise of the Rights or Access Rights , Utility shall restore the land upon which
such line is constructed to its condition that existed prior to such construction by
either causing the physical, material damage to be repaired or paying landowner the
reasonable cost of such work, to the extent such damaged condition was caused by
Utility 's exercise of the granted rights .
H . No right , title or interest in or to the oil and gas minerals, under or in the lands

described herein, is condemned.
I. This easement shall not affect prior easements or leases possessed by Plaintiff or its
predecessors in interest, any encroachment agreements regarding such easements or leases,
or the rights of any easements or leases enforceable against third parties at the time of
the filing of this Petition (including but not limited to railroad, pipeline, district, public
utility, public right of way and/or private easements) and shall not be deemed to
abandon, extinguish or alter any of same, except as expressly stated to the contrary as to
specifically identified easements and leases.
J. The Rights and Access Rights shall be exercised in a reasonable and appropriate manner
(i) consistent with the terms and provisions set forth in this document, and (ii) so as to
cause reasonably minimized interference with the cultivation , use and enjoyment of the
dimensions of the Right of Way and Entire Ownership Tract by Defendant and others
lawfully present thereon.
WHEREFORE, Plaintiff, Evergy Kansas Central , Inc., requests that the Court find from this
Petition that the Plaintiff has the power of eminent domain and that the use of the power of eminent
domain to acquire any interest in real property is necessary to the lawful corporate purposes of
Plaintiff. The Plaintiff further requests that such findings be entered of record and that , after
entertaining suggestions from any party in interest relating to the appointment of appraisers , an
order be made appointing three disinterested residents of Saline County, Kansas, at least two of
the three of whom shall have experience in the valuation of real estate, to view and appraise the
value of the lots and parcels of land found to be necessary from the Petition and direct said residents
to determine the compensation and damages due the parties named herein resulting from the taking ,
fixing the time for the filing of the appraisers' report at a time not later than 45 days after the entry of
