2021-05-13 SFC Global Supply Chain Executed AgreementDESIGNATION OF TEMPORARY CROSSWALKS AND AGREEMENT FOR INSTALLATION OF RELATED TRAFFIC CONTROL DEVICES, MARKINGS, AND SIGNAGE This Designation of Temporary Crosswalks and Agreement (“Agreement”) is entered into this 13th day of May, 2021, between the City of Salina, Kansas (the “City”) and SFC Global Supply Chain, Inc. (“Schwan’s). Section 1. Designation of Temporary Crosswalks. Pursuant to Salina Code §38-1.2, and based upon the increased interaction between pedestrians and vehicular traffic during the Schwan’s construction project, the City Manager designates temporary crosswalks at the locations in the City’s right-of-way depicted on the attached and incorporated Exhibit A (the “Temporary Crosswalks”) for a term commencing upon the City Engineer’s approval of Schwan’s installation of the related traffic control devices, markings, and signage as provided in Section 2 and ending upon completion of the Schwan’s construction project or December 31, 2022, whichever is earlier (the “Temporary Crosswalk Designation”). Section 2. Installation of Traffic Control Devices, Markings, and Signage. Schwan’s agrees to be responsible, at its cost, for the acquisition, installation, and maintenance of the specified traffic control devices, markings, and signage (the “Temporary Improvements”) required by the City to provide for the safe utilization of the Temporary Crosswalks. The Temporary Improvements shall be installed according to the plans shown on the attached and incorporated Exhibit B (the “Plans’) and in compliance with the specifications identified on the attached and incorporated Exhibit C (the “Specifications”). Upon completion of the installation of the Temporary Improvements in compliance with the Plans and Specifications, Schwan’s shall notify the office of the City Engineer to request an inspection of the installation. The City acknowledges that the Temporary Improvements shall remain the property of Schwan’s for all purposes under this Agreement. Section 3. Maintenance During Temporary Crosswalk Designation. Schwan’s shall be responsible for diligently monitoring and promptly maintaining the Temporary Improvements to the satisfaction and approval of the City Engineer. GENERAL All traffic control devices placed within the right of way shall be compliant with the most recent version of the Manual on Uniform Traffic Control Devices, which compliance can normally be ascertained from the suppliers. 2. TEMPORARY PAVEMENT MARKING TAPE Temporary pavement marking tape shall be any temporary pavement marking tape made by 3M (www.3m.com), Advanced Traffic Markings (www.trafficmarkings.com), Swarco (www.swarco.com), or approved equal. 3. RECTANGULAR RAPID FLASHING BEACONS Rectangular rapid flashing beacons shall be item CCRS004-RFB-PB-BB sold by LED Lighting Solutions (www.ledlighting-solutions.com) or approved equal.
