RESOLUTION NUMBER 97-5101
A RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE A LICENSE
AGREEMENT BETWEEN THE CITY OF SALINA, KANSAS AND MOWERY CLINIC,
L.L.C. TO PLACE A PRIVATE COMMUNICATION CABLE IN THE PUBLIC
RIGHT-OF-WAY AND TO ALLOW CONSTRUCTION OF A BUILDING OVER AN
EXISTING UTILITY EASEMENT.
I Kansas:
BE IT RESOLVED by the Governing Body of the City of Salina,
Section 1. That the Mayor is hereby authorized to execute a license
agreement between the City of Salina, Kansas and Mowery Clinic, L.L.C. to
place a private communication cable in the public right-of-way and to allow
construction of a building over an existing utility easement, subject to the
following conditions:
A. That the existing electrical and telephone utility lines located
in the easement are relocated; and
B. That the existing sanitary sewer line located in the easement be
encased, at the expense of Mowery Clinic, L.L.C., in accordance
with specifications determined by the City Engineer.
Section 2. That this resolution shall be in full force and effect
from and after its adoption.
Adopted by the Board of Commissioners and signed by the Mayor
this 6th day of January, 1997.
