97-5116 Eminent Domainco��oiwaib.s�o�a (Published in the Salina Journal February 13 , 1997) RESOLUTION NUMBER 97-5116 A RESOLUTION DECLARING THE NECESSITY OF AND AUTHORIZING A SURVEY AND DESCRIPTION OF LAND TO BE ACQUIRED BY EMINENT DOMAIN FOR THE PURPOSES OF CONSTRUCTING A FIRE DEPARTMENT TRAINING FACILITY IN THE 300 BLOCK OF NORTH SEVENTH STREET AND CONSTRUCTING IMPROVEMENTS TO THE INTERSECTION OF SOUTH OHIO STREET AND BELMONT BOULEVARD. WHEREAS, the City of Salina has a need to construct a fire department training facility on what is now privately owned property located in the 300 block of North Seventh Street; and WHEREAS, the City of Salina has a need to construct improvements to the intersection of South Ohio Street and Belmont Boulevard on what is now privately owned property located on the southwest corner of that intersection; and WHEREAS, efforts to negotiate acquisition of both tracts of real estate referred to above have thus far been unsuccessful; and WHEREAS, in the interests of the public health, safety, and welfare of its citizens, it is necessary that the City of Salina appropriate the necessary property for use by the City in constructing the improvements referred to above. SO NOW THEREFORE, BE IT RESOLVED by the Governing Body of the City of Salina, Kansas: Section 1. It is hereby declared to be necessary for the City to appropriate privately owned property located in the 300 block of North Seventh Street in the City of Salina, Kansas, for the purpose of constructing a fire department training facility. Section 2. It is hereby declared to be necessary for the City to appropriate privately owned property located on the southwest corner of the intersection of South Ohio Street and Belmont Boulevard for the purpose of constructing improvements to that intersection. Section 3. The City Engineer is authorized to make surveys and descriptions of the private property to be acquired through eminent domain necessary to complete the projects described above and to file such surveys and descriptions in the office of the City Clerk. Section 4. That this resolution shall be effective upon its publication once in The Salina Journal. Adopted by the Board of Commissioners and signed by the Mayor this 10th day of February, 1997.
