BE IT RESOLVED by the Governing Body of the City of Salina , Kansas, as foliows: 21-7954 A RESOLUTION MAKING CERTAIN FINDINGS AND DETERMINATIONS AS TO TllE NEED FOR TllE HOUSING WITHIN THE CITY OF SALINA, KANSAS AND SETIING FORTll TllE LEGAL DESCRIPTION OF REAL PROPERTY PROPOSED Section 1. The Governing Body has previously adopted and incorporated by reference as part of this Resoluti-On the Ne~s Analysis, a copy of which is on file in the office of the City Clerk , and A map is available in the office of the Ctty Clerk, 300 W. Ash Street. (1 I) · based on a review of said Needs Analysis makes the following fi~dings and determinations . Section 2. The Governing . TO BE DESIGNATED AS A RURAL HOUSING INCENTIVE DISTRICT WITHIN TllE CITY. WHEREAS, K.S.A. 12·5241 et seq. (the 'Act') authorizes any city incorporated in accordance with the laws Body hereby finds and determines that there is a shortage of qual~y housing of various price ranges ill the City desptte tile best efforts of public and privale housing developers. The Governing Body hereby finds and determines that the shortage of qualtty housing can be expected to persist and that addttional finariciaf incentives are necessary in order to encourage the private sector to construct or renovate housing in the City. ol the State of Kansas (the 'State') wtth a population of less than 60,000 located in a colllty with a population of less than 80,000, to designate rural housing incentive districts within such city; and WHEREAS, prior to such designation ·the governing body of such city shall conduct a housing needs analysis to determine what , if any, housing needs exist wtthin tts community; and WHEREAS, after conducting such analysis, the governing body of such city may adopt a resolution making certain findings regarding the establishment of a rural housing incentive district and providing the legal description of property to be contained therein; and WHEREAS, after publishing such resolution, the governing body of such city shall send a copy thereof to the Secretary of Commerce of the State (tile 'Secretary') requesting that the Secretary agree wtth tile finding contained in such resolution; and WHE!WAS. ff the Secretary agree&>.With such findings, suCll qty may p1oceed with the ~islvnent of a rural housing -.cicentive district wtthin such city and adopt a . plan for the develop1nent .ar · redevelopment of housi'I and public faciltties in ttll proposed district; and . WHEREAS , tile City of Salina, Kansas (the 'Ctty') has an estimated population of 47,707 (2010) is located in Saline County, Kansas which has a population ol 55,606 (2010) and therefore constttutes a city as said term is defined in this act; and WHEREAS , the Governing Body of tile Ctty has performed a Housing Needs Analysis (Live Salina Housing Assessment ·and Strategic Plan) dated January 25 , 2016 (the 'NeeQ& ~lysis'), a copy of which is on file in the office of~ City Clerk ; and WHEREAS,· • based on the Needs Analysis, the Governing Body of the Ctty proposes !J commence proceedings necessary to create a Rural Housing Incentive District, in accordance wtth tile provisions of the Act. SO NOW, THEREFORE Section 4. The Governing Body hereby finds and determines that the shortage of qualtty housing is a substantial deterren! to future economic growth and development in the Ctty. Section 5. The Governing liody h81ehY finds and determines , that the Mure econom ie wellbeing of the Ctty depends on tile Governing Body providing addttional incentives for the . construction or renovation of qualtty housing in the Ctty. • Section 6. Based on the findings and determinations contained in Sections 2 through 5 of this Resolution , the Governing Body proposed to establish a Rural Housing Incentive District pursuant o the Act , wtthin boundaries of the ·eal estate legally described and 'depicted in tile map in Exh1btts 'A· 1' and 'A·2' attached hereto. Section 7. This Resolution shall take effect after tts adoption and publication c~ce in the official City newspaper.
