97-5226 Sell PropertyCons Ida lk Salina RESOLUTION NUMBER 97-5226 A RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE A QUITCLAIM DEED AND RESERVATION OF PUBLIC DRAINAGE EASEMENT. WHEREAS the Kansas Department of Transportation has quit claimed to the City of Salina the following excess right-of-way located along Ninth Street (old U.S. Highway 81) north of Euclid Avenue in the City of Salina, Kansas, more specifically described as: A tract of land in the South Half of the Northwest Quarter of Section 1, Township 14 South, Range 3 West of the 6th P.M., Saline County, Kansas, described as follows: BEGINNING at a point on the North line 113.90 feet East of the Northwest corner of said South Half of the Northwest Quarter; thence on an assumed bearing of North 90 degrees 00 minutes 00 seconds East, 265.00 feet along said North line; thence South 00 degrees 00 minutes 00 seconds West, 187.80 feet; thence North 90 degrees 00 minutes 00 seconds West, 235.00 feet to a point 144.11 feet East of the West line of said Quarter Section; thence North 09 degrees 04 minutes 34 seconds. West, 190.18 feet to the point of beginning. The above contains 1.08 acres, more or less. (the "Real Estate"), and WHEREAS, the City has no economic investment in the Real Estate; and WHEREAS, the Real Estate is not suitable for development and has no development value; and WHEREAS, the public purpose is best served by the City's conveyance of any interest it holds in the Real Estate to the adjacent private property owner, with the reservation of a public drainage easement to be maintained by the adjacent property owner; and WHEREAS, the adjacent property owners are currently George Rickey Robertson and Martha S. M. Robertson, husband and wife. Those adjacent property owners have indicated a willingness to undertake possession and maintenance of the Real Estate; SO NOW, THEREFORE BE IT RESOLVED by the Governing Body of the City of Salina, Kansas: Section 1. The Mayor is authorized to execute a Quitclaim Deed and Reservation of Public Drainage Easement to George Rickey Robertson and Martha S. M. Robertson, husband _and wife, for the Real Estate.
