LOWER SMOKY HILL WATER SUPPLY ACCESS CONTRACT
This Addendum is executed and entered into this 04
day of February, 2020,
memorializes certain understandings between the Kansas Water Office ("KWO") and the Lower
Smoky Hill Water Supply Access District("Access District")to amend the Lower Smoky Hill Water
Supply Access Contract ("Supply Access Contract").
WHEREAS, the KWO and Access District entered into the Lower Smoky Hill Water Supply
Access Contract on December 29, 2016, to purchase specified amounts of Conservation Storage
water supply space in Kanopolis Reservoir("Reservoir"); and
WHEREAS, the KWO, Access District, and Kansas Department of Agriculture, Division of
Water Resources entered into the Lower Smoky Hill Water Supply Access District Operations
Agreement ("Operations Agreement"); and
WHEREAS, pursuant to K.S.A.82a-2311,the Access District has requested an opportunity
to renegotiate the existing contract for purchase of additional water supply; and
WHEREAS, the Director of the KWO has been authorized by the Kansas Water Authority
(KWA)to negotiate and enter into this Addendum to the Supply Access Contract; and
WHEREAS, this Addendum to the Supply Access Contract is in the interest of the people
of the State of Kansas and will advance the purposes set forth in Article 9 of Chapter 82a of Kansas
Statutes Annotate,as amended; and
WHEREAS, each member of the Access District has implemented a water conservation
plan that has been approved in accordance with guidelines adopted by the KWO;
NOW, THEREFORE, in consideration of the foregoing, the parties mutually agree as
follows:

Article 1. Construction and Applicability
(a) Any term defined in Article 1 of the Supply Access Contract shall be given the same
meaning in this Addendum.
(b) The parties specifically agree that this Addendum supersedes and replaces the
obligations of KWO set forth in the Supply Access Contract with respect to the percentage of the
Reservoir dedicated to Conservation Storage water supply space for the use of the Access District
as well as the Access District's corresponding obligations to pay for additional storage purchased.
(c) In all other respects, except as herein specifically amended, the parties ratify and
confirm that all other provisions of the Supply Access Contract remain in full force and effect.
Article 2. Specific Provisions Amended
(a) The parties agree to substitute Article 4 of the Supply Access Contract with the
following:
"In consideration of payments made by the Access District to the KWO
pursuant to the Supply Access Contract,the KWO agrees to dedicate Conservation
Storage water supply space to the use of the Access District in the Reservoir as
follows: undivided 24.23 percent(estimated to contain 11,327 acre-feet in 2019,
after adjustment for sediment deposits;see First Amended Exhibit A)of the usable
storage space in the reservoir between elevations 1,431 and 1,463 mean sea level.
This storage space is designated for the sole use and benefit of the Access District."
(b) The parties agree to substitute Exhibit A to the Supply Access Contract with
First Amended Exhibit A,which is attached to this Addendum.The First Amended Exhibit A shall
be incorporated into the Supply Access Contract,and all references in the Supply Access Contract
to Exhibit A shall be replaced with "First Amended Exhibit A."

(c) The parties agree to add paragraph (1)(C) to Article 5 of the Supply Access Contract.
Article 5, paragraph (1)(C) shall provide:
"(C) Attached to this agreement is Exhibit B that sets forth the
amortization schedule detailing the periodic payments that Access District shall
transmit. Exhibit B is incorporated herein by reference and made part of this
contract."
Exhibit B is attached to this Addendum and incorporated herein by reference. Exhibit B
shall be incorporated into the Supply Access Contract.
Signatures:
