TERM: The Easement shall be perpetual. UNVNERSHIP: Grantors covenant that Grantors own the Real Estate and have the right, title,and capacity to grant the Easement. USE AND MAM- MANCE: Grantors acknowledge that Grantors'Use of the Real Estate shall be consistent and not interfere with the Easement and that the Easement shall not affect the Grantors' obligation to maintain the Real Estate. IlVIPROVEMENTS: Grantors agree that notwithstanding the Provisions of Salina Code Sec. 42-63 as it may be amended fi+om time to time,Grantors are probit ited from constructing any building or structure, installing fencing or laru scaupix% or creating or allowing any other interference or impediment to the City's use of the Easement for access to the Water Well. SURFACE GRADE: Grantors shall neither alter nor permit others to alter the surface grade of the Real.Estate without the prior written approval of time City. BINDING EFFECT: The Easement shall be binding upon and shall run with the Real Estate.
