I would bet Scott Fromme (my BC of CRRD) and I discuss this more than I care to think about. We do use exception #2, but it does get squishy. Looking at the commentary it really does give the AHJ leeway to determine what"future" means and the likelihood of connecting developments. I think it ends up being subjective based on your department,the neighborhood, and your feel for how development is going to progress. Not too long ago we had a development going into a "inside 80" basically 80 acres that was surrounded on three sides by undeveloped/non-platted farm land. The developer had over 200 lots on this thing, and did have like 3 or 4 planned connections, but they were just stubs to fields for the foreseeable future. Our planning department suggested requiring a recorded covenant to restrict building over 30 lots until an additional connection was made. That went over like a turd in a punch bowl. 1. They cannot control land they do not own 2. This can negatively affect financing for the development of these types of properties. In the end the City Manager agreed to let the developer go to 60 before a connection was required IN THIS INSTANCE/CIRUCUMSTANC ONLY. This was not new policy,just a decision on that property. Well the developer found a way to give us an access point that though it did not meet the strict IA diagonal measurement, it did give us good dual access to the land. We try to look at each case and understand how they are developing in relation to the land around them. One problem is the late-comer to the area who does not have options to connect to adjacent plats. That is a failure of the planning dept in my eyes. Also when those stubs exist, but planning does not make the next plat connect...very frustrating. Our city has several examples of sub d's with more than 30 dwelling units and only one way in because emergency access easements were ignored, or never developed, or in some cases politically wiped away... We honestly struggle on the best way to keep the number below 30 until the secondary access is ready. Our building . dept will try to contact us about ensuring hydrants and roads are in before issuing the building permits, but they are not conditioned to worry about how many are there.... Exceptions: I. Where there are more than 30 dwelling units on a single public or private fire apparatus access road and all dwelling units are equipped throughout with an approved automatic sprinkler system in accordance with Section 903.3.1.1, 903.3.1.2 or 903.3.1.3 of the International Fire Code, access from two directions shall not be required. 2.The number of dwelling units on a single fire apparatus access road shall not be increased unless fire apparatus access roads will connect with future development, as determined by the fire code official. Do any of you use exception #2, if you do,when do you draw the line as to how many house can be built before the secondary access must be in? If you don't use the exception what is your best practice for working through difficult developments. Thanks so much for responses in advance.
