License Agreement with Kenneth Bieberly to allow a private sewer line extension in a public alley
right-of-way adjacent to 1221-A East Iron.
BACKGROUND:
The attached license agreement has been developed at the request of Mr. Kenneth Bieberly on
behalf of BEA/BURR/LEE Development Company for the installation of a private sewer line in a
platted alley. The private sewer main serves the property with sewer service and ties into the public
sewer main on Delaware Avenue. Please find attached details of the sewer extension and a map of
the area.
This type of license agreement requires the applicant to acknowledge liabilities associated with
private utilities placed in public rights-of-way. It also outlines the responsibilities of the owner for
maintenance of this line.
FISCAL NOTE:
There is no fiscal impact to the City of Salina for this agreement.
RECOMMENDATION:
It is recommended that the City Commission approve Resolution Number 04-6083 authorizing the
Mayor to sign the license agreement with BEA/BURR/LEE Development Company for the private
sanitary sewer line in the alley adjacent to 1221-A East Iron Avenue.
