PERMANENT EASEMENT FOR ROAD/BRIDGE RIGHT-OF-WAY
For valuable consideration, the receipt of which is hereby acknowledged, by and between
the CITY OF SALINA, KANSAS, hereinafter called "Grantor." and the BOARD OF COUNTY
COMMISSIONERS OF SALINE COUNTY, KANSAS, hereinafter called "Grantee":
WHEREAS, Grantor owns Section Seven (7). T15S-R3W of the Sixth P.M. (the "Real
Estate").
WHEREAS, it has been found necessary by Grantee to improve a certain public road or
highway known as:
Water Well Road, between Section Six (6) and Seven (7), T15S-R3W of the Sixth P.M.
GRANT: Grantor grants and conveys to Grantee a permanent easement (the "Easement")
to be usable by Grantee for road/bridge right-of-way, together with the right of ingress and egress to
and from the Easement from Water Well Road, solely for the purpose of constructing, improving,
reconstructing and maintaining a road and/or bridge project as a public right-of-way, described in
Schedule "A", attached hereto and incorporated herein, to have and to hold the same forever,
together with all rights and appurtenances thereto.
SUBJECT TO PERMANENT UTILITY EASEMENT: Grantee acknowledges and
agrees that Grantor's grant of the Easement is subject to the Permanent Utility Easement dated May
5. 2008 and recorded May 9, 2008 at Book 1172, pp. 1455-58 of the records of the Saline County
Register of Deeds and the rights of any public utilities with installations located therein.
TERM: The Easement shall be perpetual.
IMPROVEMENTS: Grantor warrants that it shall not build, erect, maintain or permit any
structure, improvement or obstacle on that portion of the Real Estate subject to the Easement that
blocks, impedes or otherwise interferes with Grantee's rights under the Easement as reasonably
determined by Grantee. Grantee, in its sole discretion, shall have full right to eliminate, remove or
abate such obstacle at Grantor's sole expense.
MAINTENANCE. Grantee shall be responsible for maintaining the full width of the
Easement and its improvements constructed thereon to its customary maintenance standards.
BINDING EFFECT: The Easement shall be binding upon and shall run with the Real
Estate.

A tract of land in Section Seven(7), Township Fifteen South(TI5S), Range Three West(R3 W)of
the Sixth Principal Meridian in Saline County, Kansas, more particularly described as follows:
Commencing at the northwest corner of said Section; thence S. 0° OF 57" E., on an assumed bearing, along
the west line of said Section, a distance of 20.00 feet; thence N. 89° 26' 10" E. a distance of 24.75 feet to a
point on the east right of way line of Lightville Road and the south right of way line of Water Well Road,
said point being the POINT OF BEGINNING; thence N. 89° 26' 10" E. along said south right of way line,
a distance of 2710.92 feet; thence continuing along said south right of way line N. 89° 50' 49" E. a
distance of 2427.57 feet; thence S. 0° 08' 58" E. a distance of 20.00 feet; thence S. 89° 50'49" W. parallel
with said south right of way line, a distance of 2427.62 feet; thence continuing parallel with said south line
