Field Training Agreement FIELD TRAINING AGREEMENT
This Field Training Agreement ("Agreement") is entered into November 6ji , 2017, by and
between the City of Salina, Kansas ("Salina") and the City of McPherson, Kansas ("McPherson").
Recitals
A. Salina operates the Building Services Division of the Department of Development Services,
which provides inspection services related to city ordinances and duly issued building permits.
B. McPherson operates a similar building and permits division, and has recently hired one or
more new employees who will be responsible for building code enforcement within the City of McPherson.
C. McPherson desires to utilize Salina's employees and their expertise for purposes of
observing Salina inspectors in the field to assist in training its new building inspector.
D. Salina is willing to assist with the proposed training, subject the terms and conditions
herein.
The parties, in consideration of the mutual promises set forth in this Agreement, agree and
covenant:
1. Field Training. Salina agrees to allow McPherson's employees to field train with Salina's
employees in the Building Services Division (the "Training"). McPherson acknowledges and agrees that
all individuals assigned to participate in the Training shall be then-current employees of McPherson, and
such individuals shall be acting within the scope of their employment with McPherson at all times during
the Training.
2. Term. The term of this Agreement shall commence upon execution of this Agreement by
both parties, and shall continue until either party provides written notice to the other party of its desire to
terminate the Agreement.
3. No Employment with Salina. This Agreement does not and shall not be construed to
create any principal/agent, master/servant, employer/employee or partnership relationship of any kind
between Salina and McPherson. No individual shall have any rights by reason of participation in the
Training against Salina for any salary remuneration or compensation, or any employment benefits, social
security, worker's compensation coverage, disability or unemployment insurance benefits, or any other
remuneration of any kind whatsoever. Any services rendered to Salina by McPherson employees shall be
considered incidental to the educational content of the Training.
4. Indemnification. McPherson agrees to defend, indemnify, and hold harmless Salina, its
agents, representatives, officers, officials and employees from and against all claims, damages, losses and
expenses(including but not limited to attorney fees and court costs) arising out of, or in connection with, or
incident to, Salina's performance of this Agreement or participation in the Training by McPherson's
employees.
