An ordinance ordering the condemnation and acquisition of certain real estate.
Background
This ordinance relates to the City's acquisition of the approximately 87.5 acre tract of land located southeast of
the intersection of Magnolia Road and Ohio Street (generally known as the Knox Sandpit), for the purpose of
storm drainage detention or storage.
On September 28, the Commission adopted Resolution No. 98-5338 determining the necessity of acquiring the real
estate and authorizing the City Engineer to prepare and file with the City Clerk a survey and legal description of
the property. That certificate has been filed and is attached as an exhibit to the proposed ordinance.
The proposed ordinance directs the City Attorney to file the verified petition initiating the eminent domain
procedure in which three court appointed appraisers will determine the value of the property through an
administrative procedure that occurs under the supervision of the Saline County District Court.
A portion of the cost of acquisition of the Knox Sandpit will be specially accessed against the Eastview Estates
Addition. As required by state law, the ordinance also identifies the designated benefit district.
Recommendation
Staff recommends approval of Ordinance No. 98-9895.
