I have lived at the address given below for more than twenty' years.
It is rq opinion that the hedge on the Lott property at 404 ~J'est Claflin
is being grown and maintained tor the purpose ot injuring the Coles. 'Ibis hedge
will soon comp1eteq block all the windowa on one entire side ot the Cole
residence, ruin a nice lawn and nowers, and damage a good portion ot their
garden spot on the extreme rear end ot the property. AlBo, the wlq it has
been maintained the past few years has been a great deal ot inconvenience
to the Coles.

Gentlemen:
Section 9-1 of the Salina Code provides that in
accordance with the provisions of Section 204 of the
Uniform Building Code, there is created a Board of
Appeals for the city which shall consist of five mem-
bers to be appointed by the Mayor and whose duties and
term of office and authority shall be as provided in
the Uniform Building Code.
Section 204 of the Uniform ~uildinp; Code provides
as follows:
"In order to determine the suitability
of alternate materials and methods of con-
struction and to provide for reasonable inter-
pretations of the provisions of this code,
there shall be and is hereby created a Board
of Appeals consisting of five members who are
qualified by experiencE: and training to pass
upon matters pertaining to the building con-
struction. The Building Official shall be
an ex officio member and shall act as Secre-
tary of the Board. The Board of Appeals shall
be appointed by the Mayor and shall hold of-
fice at his pleasure. The Board shall adopt
reasonable rules and regulations for the con-
ducting its investigation and shall render all
decisions and findings in writing to the
Building Official, with a duplicate copy to
the appellant and may recommend to the City
Council such new legislation as is consistent
therewith." '

As you will note, neither the Salina Code nor the
Uniform Building Code make any provisions for an appeal
from a decision of the Board of Appeals.
The above Board of Appeals should not be confused
with the ,Board of Zoning Appeals which is appointed
under our Section 25 of our Zoning Ordinance. The ord-
inance creating the Board of Zoning Appeals specifically
provided that any person who is aggrieved by the decis-
ion of that board may appeal such decision to the Board
of City Commissioners of the City of Salina, Kansas,
or present the same to a court of record.
The right to appeal is not an inherent right,
but is a privilege which may either be granted by the
legislature or by the governing body of any municipal-
ity. In the present case, neither the city ordinance
creating the Board of Appeals nor the Uniform Building
Code make any provisions for an appeal. In view of
this, the general appellate laws of the State of Kansas
would be applicable. K.S.A. 60-2101 provides as fol-
lows:
"(a). District Courts: A judgment ren-
dered or final order made b~ the court or any
other tribunalt bo~rd O~ offIcer exercising
judicial or quasi-judicial functions, and
inferior in jurisdiction to the district court,
may be reversed, vacated or modified by the
district court ..."
In view of this provision of the Kansas Code of
Civil Procedure, I am of the opinion that any appeal,
if any exists, from the Board of Appeals would be to
the district court rather than the Board of Commissioners.
The issues in the "Lott Case" are somewhat clouded
by the fact that on the application :tOr11 executed by
Mrs. Lott the following information was included:
"The appella,nt herein, or his authorized
agent, hereby acknowledges that he has been
advised of his right to appeal of the decis-
ion of the Board of Building Appeals to the
Board of City Commissioners or a court of
record within ten (10) days of the date'of
that decision."

Apparently this provision was included on the
application by the Board of Appeals during the time
that the Board of Appeals and the Zoning Board of
Appeals consisted of the same me~bership; however, I
am of the opinion that the above info~nation, even
though it appears on the application, would not change
the law relative to appeals from said board.

riolation at a CitY' Ord1nance and would have to be moved. He stated that we had
the right to appeal, or that be was sure that it Mr. Cole would contact the Lotts
and agree to the hed.ge, the bouse violation would be forgotten.
June 1 - Lott hearing postponed to June 8.
June 8 - Lott hearing postponed again to June 15.
June 15 - Lott hearing. Tabled until board could go look at hedge, same evening.
June 18 - Neighbors in this neighborhood started cutting hedges down to ordinance
requirements. ,but not Lotts.
June 22 - Lott hearing scheduled tor tOd&T, but postponed again to June 29.
June 29 - Lott hearing postponed again.
