Consider request for 30 day extension to submit a site development plan for the rezoning application
filed by Green Lantern, Inc.
Background
On April 16, 1997 the Planning Commission conducted a public hearing on Green Lantern's request
to rezone two (2) lots located at the SW comer of East Iron and Connecticut from R-2 to C-5. At the
conclusion of the public hearing the Planning Commission approved a motion (5-1) to recommend an
amendment of the Comprehensive Plan map to designate this area as commercial and then voted 4-3
to recommend approval of a zoning change to C-5.
The City Commission considered this request on May 19, 1997 and concurred with the Planning
Commission's recommendation to amend the land use map to show future commercial on this site but
did not concur with the Planning Commission's recommendation to approve straight C-5 zoning.
Instead, the City Commission voted to direct the applicant to amend their request to Planned C-5 and
to return this item to the Planning Commission for submittal and review of a site development plan.
The City Commission gave Green Lantern 6 months to submit a site plan to the Planning Commission.
Prior to the expiration of the original 6 month time frame, Green Lantern requested an additional 6
months to prepare and submit a plan for the site. This extension was approved by the Planning
Commission on November 5, 1997.
Nature of Current Request
Green Lantern has again requested a 6 month extension. According to the letter submitted, this request
is due to the inability of the applicant and staff to come to a compromise concerning the layout of the
planned development. This apparently refers to staff's inability to support the applicant's request for
two zoning variances associated with their development plan: 1) a 15 ft. instead of a 25 ft. building
setback from Connecticut Avenue for a 6 bay car wash; and 2) a 0 ft. instead of a 15 ft. landscape
buffer between the development and the residence to the south.
Under the zoning ordinance, the Planning Commission is only authorized to grant the applicant one
extension not to exceed 6 months. Such an extension was granted in November 1997 and expired on
May 19, 1998. In addition, the first 6 month extension was granted by the City Commission.
Therefore, any additional extensions would need to be granted by the City Commission.

Planning Commission Recommendation
The Planning Commission considered this request on May 19. At the conclusion of questions and
comments, the Planning Commission approved a motion to recommend that the City Commission
grant Green Lantern a 30 day extension. If approved, this would mean that the rezoning application
and site plan would be heard by the Planning Commission on June 16, 1998.
Recommended Action
Approve the recommendation of the Planning Commission and grant the applicant a 30 day extension.
