1998 Concession Agreements
BACKGROUND:
In 1994 the Parks and Recreation Department entered into an agreement with the American
Legion to operate the concession stand at Dean Evans Stadium. Determining this operation
successful for both parties, we looked at similar agreements for the other concessions operated by the
department. In 1997, we entered into agreements with organizations and individuals for operations
at Bill Burke Complex, Kenwood Pool, and the north concession stand at ECRA, located near
diamonds #1 and #2. Staff feels the agreements authorized last year were beneficial to the City of
Salina.
Concessionaires have expressed an interest in returning for the 1998 season. There are
however, several changes that need to be addressed prior to the start of this year. Two of the
changes are related to wording or naming of the individual or group involved; the third relates to a
change in compensation to the City of Salina.
The agreement for the ECRA location identified Vaughn Lambert as the concessionaire. Mr.
Lambert had established a partnership with Daniel Jones and equally shared all financial aspects of
the ECRA location with Mr. Jones. Mr. Lambert has notified us he is no longer interested in operation
of this concession stand. Mr. Jones has expressed a desire to enter into an agreement with the City
of Salina as sole contractor for ECRA concession.
The second change involves the South High School Vocal Booster Club, which has operated
the Bill Burke stand. The Salina School District has asked that the President of the South High Vocal
Booster Club be identified as the sponsor and not the school district employee directly involved with
the vocal music department.
The third recommendation involves revising the compensation Mr. Chuck Culley pays to the City
for the Kenwood Pool operation. The previous agreement specified a flat fee of $1000 and 10% of
the gross sales as compensation. We are proposing to change the agreement to $2500 flat fee for
the right. The flat fee agreement is the preferred financial method by City staff and is the selected
method of all other concession agreements. The flat fee provides a stable base of revenue for the City
as well as the known expenditure for the contractor.
All other components of the agreements remain the same.
RECOMMENDATION:
It is staff's recommendation the City Commission approve resolution 98-5280 authorizing
agreements between the City of Salina and the Salina South Vocal Music Booster Club, Chuck Culley,
& Daniel Jones for operation of concessions at Bill Burke Park, Kenwood Swimming Pool, & ECRA
north concession facility respectively.
