Report on validity'and submittal of engineering feasibility report for Petition No. 4162, filed by Mr.
Danny Huehl and Mr. Monty Montee as owners of the Country Oak Development Corp., requesting
certain street and drainage improvements to Country Oak Estates Addition.
BACKGROUND:
Petition No. 4162 was submitted on May 7, 1998 for these improvements. It is prescribed by
Kansas State statutes that the City Commission consider a petition for street, drainage, and utility
improvements and establish sufficiency on the basis that any one of the following conditions are met:
1. The petition 'is signed by a majority ofresidem owners of record of property liable for
assessment under the proposal.
2. The petition is signed by the resident owners of record of more than one half of the area
liable for assessment under the proposal.
3. The petition is signed by the owners of record, whether resident or not, of more than one
half of the area to be assessed under the proposal.
In this case, the petition signature represents 75% of owners of record in the area liable for
assessments: Therefore, the petition clearly meets the statute requirement for sufficiency2 The
Saline County TreasUrer has indicated there are no delinquent taxes or special assessments on any
property within the benefit district.
The engineering feasibility report is attached for your review. The property owner within the benefit
district shall be assessed 100% of the project costs. The total cost of the improvements is estimated
to be $15,265.00. Each of the lots will pay an equal portion of the total project cost. The petitioners
hawe requested a term of 15 years to pay back the special assessments. This project will be included
in the 1998 Subdivision Improvements Project.
RECOMMENDATION:
It is recommended that the City commission approve the engineering feasibility report for street and
drainage improvements in Country Oak Estates Addition and'adopt the resolution determining the
advisability and authorization for the project.

SCOPE OF WORK
The curbing, guttering, grading, paving and drainage of the Huehl Circle cul-de-sac to serve Lots 12
and 13, Block 1, Country Oak Estates and Lots 12 and 13, Block 1, Replat of Country Oak Estates.

ADOPTION OF ASSESSMENT
The assessment with accrued interest to be levied as a special assessment tax upon the property
included within the benefit district concurrent with the general property tax and shall be payable in
fifteen (15) equal annual installments.
The method of assessment is that 100% of the total cost assessed against the property shall be based
upon an equal assessment for each parcel of land in the benefit district.
