BACKGROUND:
Item #1) The Smoky Hill Museum was transitioned from being a private organization to a division of
Salina Arts & Humanties in 1986 and the permanent artifact collection of the Saline County Historic
Society was tranferred to the City of Salina. Shortly after the transfer the Smoky Hill Museum was
opened. One early and prominent feature of the museum that opened in 1991 was a children's area
called One Keepers Place. While projects and activities within the space have been updated, the area
has not been remodeled in 25 years. The main galleries and exhibit areas of the museum went
through a major renovation and construction in 2006 after a successful fundraising campaign by the
Friends of the Smoky Hill Museum. The children's interactive area was not addressed during the 2006
renovation and is now in need of significant upgrades.
In 2013, the Friends of the Smoky Hill Museum, a private support and advocacy group of the museum,
funded a research trip for two museum staff members to explore current trends, exhibits and
interactive elements in nationally recognized children's museums. All of the museum staff, members of
the education community, Friends board members, and other citizens participated in a two-year
process of exploration and design. More than 630 regional surveys provided feedback on concepts
and prototypes designed and built by museum staff. Various themes for the new space were explored
resulting in the final solution called The Curiosity Shop.
In the museum's Case for Support, a clear statement is made regarding the importance of multi -
sensory experiences for children, especially outside of school. Research shows that children who are
engaged outside of school perform better in school and are more successful as adults. Kids from
affluent homes average 400 more hours in literacy activities than those from economically
disadvantaged homes, making an engaging and free space for 3 to 14 year olds even more important.
The self-directed play designed into the space helps kids develop self-confidence and experimentation
in an engaging environment.
The Curiosity Shop vision statement promises a" dynamic and vibrant space that provides
interconnected experiences to spark curiosity, creativity,and imagination." It will focus on 20th Century
history and encourage intergenerational play and social skill development. The space will include five
distinct areas, each designed to provide a different sensory or intellectual experience. A section for
tots will be filled with fun and unique interactives. The World of Radio allows experimentation
individually or in groups as kids learn about the history of radio. Town Building includes opportunities
for participants to analyze, evaluate, make decisions, and work together as they learn about the
history of Salina. The Dirty 30's highlights the humanities and encourages tactile engagement, critical
thinking, decision making, dramatic play, and more. Kansas Weather includes a wide variety of
science based interactives like a wind simulation unit and a lightning station.
Many of the interactive elements have been concieved, designed, and built by museum staff and other

local resources, making the project something the community can take great pride in seeing complete.
Engaging local resources also has saved more than $50,000 in project costs if prefabricated
commercial products and outside consultants had been utilized. The Curiosity Shop will be filled with
unique interactive elements that participants will not experience at other venues.
Two-thirds of the Museum's 15,000 visitors are families and children ages three and up and the newly
designed space promises to be important in downtown revitalization and will serve as an important
attraction to residents and visitors. Many of the interactive elements are designed to provide a variety
of outcomes each time they are used. Other elements will be changed and updated as the staff
evaluates how the public interacts with the activities.
The newly designed Curiosity Shop will include a mezzanine level and wheelchair lift and an increase
of the current space from 750 to 1500 square feet. Electrical service is being moved and an interior
wall is also being removed to improve the function of the building and increase space.Additional
elements including enhanced electrical, water, and air pipes are also being planned.
If approved, plans to commence construction will take place immediately and the estimated
completion for construction will be in August. Once construction is complete, the musuem staff will
install the interactive elements in September and October.
Bids for the project were solicited in November of 2015 and rejected due to higher than anticipated
construction and finishing costs totalling more than $390,000. Adjustments were made to the
preliminary project scope and the architect prepared new bid documents including four
addition/alternatives. The current round of bids, including all addition/alternatives from four local and
regional contractors, ranged from a high bid of $439,120.83 to the low bid by Harbin Construction of
$264,300. (A bid tabulation sheet is attached to this report.)
The low bid and projected construction schedule by local contractor Harbin Construction meets the
preferred timeline and budget for the museum staff.
Item #2) Architectural Agreement Addendum
The Salina City Commission approved a design contract with DMA Architects in February of 2015 for
concept development and design services for the Curiosity Shop with fees provided by the Friends of
the Smoky Hill Museum. The total of that contract was for $19,000 and up to $5,000 for reimbursable
expense. Since that time DMA has prepared construction bid documents and assisted the Museum
staff with two bid processes. The first round of bids were rejected and staff asked DMA to make
design and interior finish changes as well as seperating three construction items from the main
contract as addition/alternatives. DMA has also been asked to serve in construction administration
now that acceptable bids have been received.
A contract addendum reflecting the above items totalling $11,600 by DMA includes the following
charaes:1) $2,600 for revising and updating project plans for the project; 2) $1,000 for preparation of

new bid documents, answering bidder questions, tabulating and reporting final results and printing all
bid documents; 3) $8,000 for construction administration of of the project
DMA has worked closely with museum staff throughout the process and has significant knowledge of
the building and the proposed project. Overall, DMA's overall contract with the City of Salina funded
through the Friends of the Museum represents less than 10% of the total project cost.
FISCAL NOTE:
The overall construction project budget including staff time, furniture, fixtures, construction, and
fundraising costs is $472,980. A breakdown of the project budget is as follows:
Staff time- $52,910
Demolition, construction cost and 10% contingency $290,700
Fixtures, furniture, exhibits, supplies, replenishment/maintenance $90,770
Architecture/Design/Construction Administration $30,600
Miscellaneous, marketing, administrative, and reimbursable fees $8,000
The Friends of the Smoky Hill Museum budget for the project credits the staffing cost as an in-kind
contribution by the City of Salina. The remainder of the cash raised for this project has come from
individuals, foundations, grants, and business contributions. The entire amount for the project has
been secured. The Friends of the Smoky Hill Museum currently have $350,493.49 on hand and a
majority of pledges for the remainder of the project are held at the Greater Salina Community
Foundation. The furniture, fixture and exhibits line item will be covered by the Friends of the Museum
directly or through cas transfer as expenses are incurred.
The contract with Harbin Construction for $264,300.00 includes all add ition/alternatives* for the project
and a $26,400 (10%) contingency results in a total budgeted cost of $290,700.00. This total amount
has been transferred to the City of Salina by the Friends of the Smoky Hill Museum. No City of Salina
capital improvement funds are being requested for this project. Standard staff and exhibition expenses
already budgeted for normal operations will be utilized as needed.
While an increase of visitors is expected after the project is completed, no additional paid staff is
anticipated because of this project at the current time. Interactive elements, care, and maintenance for
this project can be covered using current budget levels.
*Add iti on/Alternatives included $4,851 for a cherry veneer finish on some interior elements, $3,900 for
a brick veneer finish on select interior walls, $11,088 labor and materials for LVT flooring, and $3,600
for property insurance as specified in the contract documents.

the Friends of the Museum have been fiscally responsible, creative in problem solving, and engaged
with the public as a satisfactory solution was designed for the museum and community.
This project is consistent with Goal 5 to make downtown Salina a thriving and vibrant center of the
community. The improvements to the museum will attract new local and regional visitors and serve as
a strong complement to downtown revitalization.
COMMISSION ACTION:
Regarding the two items presented, staff recommends:
1) Approve the construction contract for $264,300 and a 10% construction contingency of $26,400
with Harbin Construction for a total of $290,400.
2) Approve the architect agreement addendum with DMA Architects for $11,600 as presented.

ARTICLE 1 THE CONTRACT DOCUMENTS
The Contract Documents consist of this Agreement, Conditions of the Contract (General, Supplementary and other
Conditions), Drawings, Specifications, Addenda issued prior to execution of this Agreement, other documents listed
in this Agreement and Modifications issued after execution of this Agreement, all of which form the Contract, and
are as fully a part of the Contract as if attached to this Agreement or repeated herein. The Contract represents the
entire and integrated agreement between the parties hereto and supersedes prior negotiations, representations or
agreements, either written or oral. An enumeration of the Contract Documents, other than a Modification, appears in
Article 9.
ARTICLE 2 THE WORK OF THIS CONTRACT
The Contractor shall fully execute the Work described in the Contract Documents, except as specifically indicated in
the Contract Documents to be the responsibility of others.
ARTICLE 3 DATE OF COMMENCEMENT AND SUBSTANTIAL COMPLETION

ARTICLE 4 CONTRACT SUM
§ 4.1 The Owner shall pay the Contractor the Contract Sum in current fluids for the Contractor's perfoi mance of the

ARTICLE 5 PAYMENTS
§ 5.1 PROGRESS PAYMENTS
§ 5.1.1 Based upon Applications for Payment submitted to the Architect by the Contractor and Certificates for
Payment issued by the Architect, the Owner shall make progress payments on account of the Contract Sum to the
Contractor as provided below and elsewhere in the Contract Documents.
§ 5.1.2 The period covered by each Application for Payment shall be one calendar month ending on the last day of
the month, or as follows:
The cut-off date for payment applications shall be the twenty fifth of the month.
§ 5.1.3 Provided that an Application for Payment is received by the Architect not later than the first (1'i) day of a
month, the Owner shall make payment of the certified amount to the Contractor not lata' than the twenth (20'")
day of the following month following the payment application cut-off date. If an Application for Payment is
received by the Architect after the application date fixed above, payment shall be made by the Owner not later than
twenty ( 20 ) days after the Architect receives the Application for Payment.

§ 5.1.4 Each Application for Payment shall be based on the most recent schedule of values submitted by the
Contractor in accordance with the Contract Documents. The schedule of values shall allocate the entire Contract
Sum among the various portions of the Work. The schedule of values shall be prepared in such form and supported
by such data to substantiate its accuracy as the Architect may require. This schedule, unless objected to by the
Architect, shall be used as a basis for reviewing the Contractor's Applications for .Payment.
§ 5.1.5 Applications for Payment shall show the percentage of completion of each portion of the Work as of the end
of the period covered by the Application for Payment.
§ 5.1.6 Subject to other provisions of the Contract Documents, the amount of each progress payment shall be
computed as follows:
.1 Take that portion of the Contract Sum properly allocable to completed Work as determined by
multiplying the percentage completion of each portion of the Work by the share of the Contract Sum
allocated to that portion of the Work in the schedule of values, less retainage of ten percent( 10 %).
Pending final determination of cost to the Owner of changes in the Work, amounts not in dispute
shall be includedas provided in Section 7.3.9 of AIA Document A201,rm 2007, General Conditions
of the Conti act for Construction;
.2 Add that portion of the Contract Sum properly allocable to materials and equipment delivered and
suitably stored at the site for subsequent incorporation in the completed construction (or, if approved
in advance by the Owner, suitably stored off the site at a location agreed upon in writing), less
retainage of ten percent ( 10 N;
.3 Subtract the aggregate of previous payments made by the Owner; and
.4 Subtract amounts, if any, for which the Architect has withheld or nullified a Certificate for Payment
as provided in Section 9.5 of ATA Document A201-2007.
§ 5.1.7 The progress payment amount determined in accordance with Section 5.1.6 shall be further modified under
the following circumstances,
.1 Add, upon Substantial Completion of the Work, a sum sufficient to increase the total payments to the
full amount of the Contract Sum, less such amounts as the Architect shall determine for incomplete
Work, retainage applicable to such work and unsettled claims; and
(Section 9 8 5 of AL4 Document A201-2007 requires release of applicable retainage upon
Substantial Completion of Work with consent of surety, if any.)
.2 Add, if final completion of the Work is thereafter materially delayed through no fault of the
Contractor, any additional amounts payable in accordance with Section 9.10 3 of AIA Document
A201-2007.
§ 51.8 Reduction or limitation of retainage, if any, shall be as follows:

§ 5.2 FINAL. PAYMENT

Contractor when
.1 the Contractor has fully performed the Contract except for the Contractor's responsibility to correct
Work as provided in Section 12.2.2 of AIA Document A201-2007, and to satisfy other requirements,

,2 a final Certificate for Payment has been issued by the Architect.
§ 5.2.2 The Owner's final payment to the Contractor shall be made no later than 30 days after the issuance of the
Architect's final Certificate for Payment, or as follows:

Dear Susan:
As we discussed at our meetings since the bid opening the complexity of the design evolved during
the construction document phase of the project. 'Phis increase in the complexity was reflected in the
bid amounts received. Per our discussion the City staff has decided to reject the bids, and have the
project scrape revised, and new bids will be solicited from interested contractors.
This letter shall seise as DMA Architects, PA response to the Owner request fur the architect to do
additional sen secs to revise the scope as listed below, pursuant to paragraph 5..5 of the Owner
Ambitect Agreement, crated February 5, 2015. Also listed below are the fees for providing the
described sen ices.
1. Pursuant to the Owner's rejections of the bids received November 13, 2015, the owner had
decided to make some changes to the bid documents and re -bid the project. The fee for the
revision of the bird documents pursuant to the owner's list of changes will be a fixed fee of
$2,600. This fee includes submitting a review set of bid documents to the owner's for
review and approval; making any required revisions.
2. Re -bidding the project including assist the owner with the advertisement for bids;
answering bidder's questions, issuing any required addendum, tabulation of the bid results,
and making a recommendation to the owner for the award of the contract for the project.
The fee f6r the rebidding will be S 1,000 plus the cost of printing of the bid documents and
any related postage cast. The reimbursable expense: will be in addition to the -amount lista
in the contract.
3. "l he construction administration phase of the project, based on project complexity and the
construction time, as included in the revised bid, will be five month period of time. The fee
for the construction administration phase will be increased from $2,000 to $8,000. This fee
is based on one person spending 4 hours a week over a five month period providing the
arclutcetural services during the construction phase as required by the .owner architect
agreement. The increase is necessary due to the increased scope of the project and the
added construction time requiring to administer the project from 20 hours to 80 hours. This
is a fixed fee which will be billed out in equal amounts over the contracted construction
bane. 'I1us is not an hourly rate but rather an estimate of the time that will be spent by the
architect on the project for the construction administration work. The last month's fee will
not be due and payable until the project is completed and all closeout documents have been
submitted and approved.

4. The bid document changes will consist of developing abase bili which will be the minimum
amount of work that will need to be completed, as approved by the owner. Add alternates
will be included to cover additional work that the owner may have the contractor include as
part of the project work. These alternates mainly consist of floor and wall finish options.
If the changes listed above in this ]atter are acceptable to the owner, a signed returned copy of this
letter will be considered an amendment to the Owner :Architect Agreement. Should you have any
