BACKGROUND: Overland Park Group has submitted an application to the Kansas Housing Resources Corporation requesting approval of federal Low and Moderate Income Tax Credits (LIHTC) to help finance construction of an affordable senior housing project in Salina. The Overland Property Group has experience with low and moderate income tax credits and has completed other tax credit projects around the state of Kansas, including two projects within the city of Salina. Overland Property Group constructed and owns and operates the Reserves at Prairie Glen, a 96 unit apartment complex at 2515 South Ohio Street and the Heritage at Hawthorne, a 32 unit apartment complex at 715 N. 91h Street. Phase II of the Heritage at Hawthorne, consisting of 16 additional affordable apartment units is under construction and nearing completion. Overland Property Group has a proven track record of successfully completing projects in Salina and throughout the state. A list of housing tax credit projects approved in Salina is attached. The Reserves at Prairie Glen and Heritage at Hawthorne were designed to accommodate families and individuals of all ages. The Overland Property Group and the Kansas Housing Resources Corporation have identified a need for additional affordable rental housing for seniors. The proposed project is intended to address that need. The conceptual plans submitted with their request for a resolution of support show a 3 story, u -shaped building with 60 apartment units, 45 one bedroom and 15 two bedroom apartments. Each one and two bedroom apartment unit would have a full complement of appliances, including washers and dryers. Other proposed amenities include on-site parking for residents, a library, game room and commons area. The Overland Property Group has not secured the necessary land use approvals for the proposed project in the location that they have in mind. Consequently, consideration of the requested resolution of support must occur without consideration of location specific details to avoid the appearance of predetermination of the land use matters. As you may recall a very similar situation arose from a request for the City to submit a Moderate Income Housing grant application in advance of land use approvals being in place. At that time, the City Commission was advised to avoid consideration of project specific elements in advance of the required land use hearings taking place. Since land use approvals are quasi-judicial matters, decision makers must serve as a fair and unbiased tribunal, which include deliberations occurring within the context of public hearings, all decision makers receiving the same information and avoiding ex parte communications. Additionally, and probably more significantly in this case, every effort should also be made to avoid any indications of predetermination of a matter prior to conduct of the necessary hearings. Statements indicating that individual conclusions have been reached prior to a public hearing can lead to disqualification of the member in question. In this particular case, City Commission adoption of a resolution of support for a specific project and location in advance of the necessary land use approvals being secured could certainly be viewed as redetermination of the land use matters that could result in disqualification of the City Commission from AGENDA SECTION NO: ITEM NO: Page 2 CITY OF SALINA REQUEST FOR CITY COMMISSION ACTION DATE TIME 3/28/2016 4:00 P.M. Consequently, the information that you have been provided as well as the resolution of support intentionally omits location specific information. The resolution states that the governing body is supportive of the use of housing tax credit financing for the described Overland Property Group project but conditions that support on the project site receiving all necessary planning and zoning approvals. CONFORMANCE WITH THE STRATEGIC PLAN: Development of additional multi -family housing for seniors would appear to be consistent with the following strategic goal in the City's Strategic Plan: GOAL: The city will create a community of mixed-use, quality development and redevelopment. The City of Salina Vision Statement states: Salina will be a city that encourages quality, market-driven, mixed-use development that compliments community cohesiveness. This includes an emphasis on affordable housing that appeals to different lifestyles. COMMISSION ACTION: As part of the tax credit application process, KDOCH requires a resolution from the local governing body stating its approval and support for any proposed housing development using housing tax credits. A resolution has been prepared for City Commission consideration based on a format suggested by KHRC. The resolution, while approving and supportive of additional senior housing in the community, includes language that subjects the final plans for the project to final zoning and site plan approval and the city's other regulatory review processes. Staff has identified the following alternatives for the Commission's consideration: 1. Approve the attached Resolution of Support supporting the issuance of housing tax credits for the construction of additional multi -family apartment units for seniors. 2. Postpone consideration of the resolution if the Commission feels it needs additional information about the project or the attached resolution. 3. Decline to approve the attached Resolution of Support for the proposed Gardens at Prairie Glen project at this time. WHEREAS, the City of Salina, Kansas has been informed that the Overland Property Group has filed a housing tax credit application with the Kansas Housing Resources Corporation for the development of 60 additional affordable rental housing units within the City of Salina as part of the project; and WHEREAS, the sixty (60) one and two bedroom units proposed as part of the project will have affordable rents targeted to Seniors 55 years of age and older %Nith loin to moderate income; and WHEREAS, the development will be new construction with hard costs of $5.5 million; and WHEREAS, the development will have certain amenities including a library, game room and commons area and a full complement of appliances, including washer and dryers in each apartment unit; SO NOW THEREFORE, BE IT RESOLVED by the Governing Body of the City of Salina, Kansas: Section 1. The Governing Body supports and approves the development of the aforesaid senior housing project in our connnunity, subject to the project site obtaining all required planning and zoning approvals. Section 2. In the event that any of the characteristics mentioned above should change prior to the issuance of a building permit, this resolution shall become null and void. Section 3.
