Agr Trash Container Service AGREEMENT SOLID WASTE SERVICES The undersigned hereby certifies that he has fully investigated the location, character and extent of the work to be done in connection with furnishing Solid Waste Services for various Departments of the City of Salina, Kansas. He further certifies that he is familiar with the type of service work involved throughout the scope of the project and understands that, in signing this agreement, he waives all right to plead any misunderstanding regarding same. Scor)e of Work: (a) The Contractor agrees to furnish and service a 2 C.Y. trash container to be located at Carver Center for a sum of $10.50 per trip (weekly or bi-weekly service) and $20.00 per trip for on-call service. This service includes loading, transportation and disposal of the refuse at the Salina Municipal Solid Waste Landfill Facility. (b) The Contractor agrees to furnish and service a 3 C.Y. trash containers to be located at Fire Station No. 1; Memorial Hall; Friendship Center; and Thomas Park for a sum of $11.25 per trip (weekly or bi-weekly service) and $20.00 per trip for on-call service. This service includes loading, transportation and disposal of the refuse at the Salina Municipal Solid Waste Landfill Facility. (c) The Contractor agrees to furnish and service a 4 C.Y. trash containers to be located at Dean Evans Stadium; East Crawford Recreation Area; Ivey Park; and Lakewood Park for a sum of $13.75 per trip (weekly or bi-weekly service) and $22.50 per trip for on-call service. This service includes loading, transportation and disposal of the refuse at the Salina Municipal Solid Waste Landfill Facility. (d) The Contractor agrees to furnish and service a 6 C.Y. trash containers to be located at the Bicentennial Center; Oakdale Park; Sunset Park; Kenwood Pool; and Bill Burke Park for the sum of $15.75 per trip (weekly or bi-weekly service) and $25.00 per trip for on-call service. This service includes loading, transportation and disposal of the refuse at the Salina Municipal Solid Waste Landfill Facility. (e) The Contractor agrees to furnish and service a 8 C.Y. trash container to be located at the Municipal Golf Course for a sum of $17.00 per trip (weekly or bi-weekly service) and $27.50 per trip for on-call services. The disposal fees established at the Salina Municipal Solid Waste Landfill Facility are included in the Contractor's fees ash shown on page A-I. Payment. The City of Salina agrees to pay the Contractor, when, billed, for all Solid Waste Services provided in accordance with the fees indicated on this. Agreement. Indel~endent Contractor. The Contractor is an independent contractor in its performance of the requested Solid Waste Services; and the Contractor shall be responsible for worker's compensation coverage for its employees and all insurance coverage on any of the equipment used in conducting the Solid Waste Service. Contractor's Insurance. Prior to or at the time of execution of the contract, the Contractor shall file with the Owner a "Certificate of Insurance" or other evidence as necessary to show that he and his subcontractors, if any, carry adequate coverage fully to protect themselves against such claims which may arise from operations under this contract, whether such operations be by the Contractor or any subcontractor or anyone directly or indirectly employed by either; said coverage to be in the form and minimum amounts hereinafter specified. Each certificate shall contain a clause requiring the insurer to notify the Owner at least 30 days in advance of any cancellation or change in insurance contracts. All policies shall be subject to approval by the Owner as to insurer and adequacy of protection. The following minimum coverage shall be maintained in full force and effect until completion of the contract and acceptance thereof by the Owner. (a) Workmen's Compensation Insurance. compensation and employer's liability cover all employees. The Contractor shall provide workmen's insurance as required by law fully to (b) Bodily Injury and Property Damage Insurance. A comprehensive general bodily injury and property damage policy, including automobiles, covering the work to be performed, shall be written to provide a coverage of $500,000 (combined single limit policy) covering bodily injury liability; property damage; destruction of property; and automobile damage occurring during the policy period. (c) Automobile Liability. The Contractor shall provide coverage protecting the Contractor against claims for bodily injury and/or property damage arising out of the ownership or use of any owned, hired and/or non owned vehicle. Required minimum limits: $300,000 each accident, combined single limits, bodily injury and property damage. (d) Commercial General Liability Insurance. The Contractor shall provide public liability insurance coverage in an amount no less than $5,00,000 covering the liability of the ~Contractor and any and all consultants, agents, independent contractors, etc. which are employed or retained by the Contractor, on an occurrence 'basis. The insurer must be acceptable to the City of Salina. Upon review of each project, the Deputy City Manger may require higher coverage limits. GC-1 (e) Indemnification Clause. The Contractor agrees to indemnify and save harmless the City, its officials, agents, servants, officers, directors and employees from and against all claims, expenses, demands, judgements and causes of action for personal injury or death or damage to property where, and to the extent that, such claims, expenses, demands judgement or causes or action arise from the Contractor's acts. (f) Notice of Claim. The Contractor, upon receipt of notice of any claim in excess of $1,000 in connection with this contract shall promptly notify the Deputy City Manager (785)309-5715, providing full details thereof, including an estimate of the amount of loss or liability. Contact Deputy City Manager immediately if any bodily injury does occur. Trash Container Summary. The Trash Container Summary (Page S-1) lists the number of trash containers to be serviced at each location. Also, the frequency of service and the service days are listed. The Contractor must contact the Parks and Recreation Department (785-309-5767) to establish optimum hours to service certain trash containers at their facilities. Term of A_(Ireement. This contract shall commence January 5, :2004 and expire on December 31, 2005 unless terminated by either party at any time during its term by giving sixty (60) days written notice to the other party.
