Backqround This application has been filed by South Ohio Land, L.L.C. requesting approval of a final plat of a 135 acre tract located at the southwest corner of Schilling Road and Ohio Street. The subject property is part of a larger 146 acre tract that the applicant owns at this corner. On March 18,2003, the Planning Commission approved one lot plat for Liberty Addition in the northwest corner of this property to allow development of that 8.66 acre site to move ahead with the understanding that South Ohio Land, L.L.C. would plat and annex the remainder of their 146 acres in the near future. The Liberty Addition was annexed into the city on April 14, 2003. The remaining 135 acres was annexed into the city on June 9, 2003. The right-of-way for Schilling Road and the Schilling Road Ditch was annexed into the city in 1999. The Salina City Planning Commission considered a preliminary plat of this 135 acre tract at their September 2,2003 meeting. The Planning Commission voted 9-0 to approve the proposed preliminary plat of Liberty Addition No. 2, subject to the following conditions: 1. Preliminary design plans for the street, water, sanitary sewer and drainage improvements needed to serve this subdivision shall be reviewed and approved by the City Engineer prior to Planning Commission consideration of a final plat. Needed rights-of-way and easements shall be shown on the final plat. 2. A phasing plan for proposed public improvements shall be reviewed and approved by the City Engineer prior to Planning Commission consideration of a final plat. 3. All corner ties, subdivision and block corners shall be identified on the final plat. The applicant's design engineer, Pete Earles, has completed a preliminary layout and cross-sections of the sanitary sewer network that must be extended from south to north to serve this 135 acre tract and this preliminary desiQn confirms that all of the proposed lots in this subdivision can be served by CITY OF SALINA REQUEST FOR CITY COMMISSION ACTION DATE 12/22/03 TIME 4:00 P.M. Page 2 a gravity sewer connection to the main lateral lines on either side of the north-south drainage ditch. The locations of needed utility easements have been identified and are shown on the final plat. 1 BY: BY: Nature of Current Request The proposed final plat of Liberty Addition No.2 is substantially unchanged from the preliminary plat reviewed by the Planning Commission and consists of 19 lots and 5 separate blocks. The proposed plat layout shows a looped street (Cortland Circle) providing access to 13 commercial lots and an east-west street (Braeburn) providing access to two lots facing Ohio. The 3 industrial zoned lots would be accessed from a looped street (Mcintosh) that would extend west from Ohio and connect with Commerce Street which serves the Crestwood plant area. The plat includes 120 ft. of dedicated right-of-way for the proposed north-south drainage ditch. South Ohio Land is proposing to rezone and plat this 135 acre tract to allow a mixture of commercial uses in the northern portion of the tract and light industrial uses in the southern portion. Street Access This proposed commercial/industrial subdivision has 1,576 ft. of frontage on Schilling Road. However, the Schilling Road Ditch serves as a barrier between the proposed lots and Schilling Road. When the Schilling Road Ditch was constructed two box culvert crossings were constructed to provide access across the ditch into this tract. The roadways on these crossings were designed to meet City street standards. The applicant is proposing to utilize the easternmost crossing and to extend a public street (Cortland Circle) south of Schilling Road then west and then back north connecting with Schilling Road at the western ditch crossing which provides access to the Kennedy & Coe site. This would create a looped street and access to all lots along this street would be internal with restricted access along the Schilling Road frontage. Because of the ditch and restricted access on Ohio, the applicant is proposing an east-west street (Braeburn) 400 ft. south of Schilling Road that would connect Ohio and Cortland Circle and provide access to the two proposed commercial lots at the corner of Schilling and Ohio. Access to the three large industrial lots would be from an east - west public street (Mcintosh) that would loop south to align with and eventually connect with Commerce Street which serves the industrial area owned by the Salina Economic Development Corporation. This connection would provide a means of access to Water Well Road and would greatly improve circulation in this industrial area, particularly for truck traffic. Page 3 1 BY: BY: Although this subdivision would have 2,485 ft. of frontage on Ohio Street, access to all 19 proposed lots would be from internal streets. There would be no individual driveways onto either Ohio Street or Schilling Road. Proposed Street Names Cortland Circle* Braeburn Street Mcintosh Street *Staff would note that Cortland Circle was inadvertently named Courtland Street on the Liberty Addition plat and an action to correct that error was taken by the City Commission on September 22, 2003. A resolution adopting this street name change was recorded in the Register of Deed office as a correction to the Liberty Addition plat. It does not appear that any of these proposed street names would create confusion or duplicate an existing street name. Lot Desiqn The proposed final plat shows 16 lots for commercial development and 3 large lots for future industrial development. All lots and blocks shown on the plat are numbered. All lots shown have adequate frontage on and access to a public street. As noted, every lot in the subdivision would have its only access from internal public streets and not from driveway openings on Schilling Road or Ohio Street. A companion request for PC-5, PC-6 and 1-2 zoning has been filed for this subdivision. The minimum lot size in C-5 and C-6 is 7,500 sq. ft. and proposed lots range in size from 2.5 to 6.8 acres so all of the proposed commercial lots contain more than adequate in size and buildable. The proposed industrial lots are 13, 13 and 28 acres. Individual lots that abut each other could be combined in the event that a large land user requires more acreage. Lots could also be divided once by deed without replatting. There does not appear to be any foreseeable difficulties due to topography or other conditions that would prevent a building permit from being issued for any of the proposed lots once utilities are extended to the site and streets are built. Page 4 Utilities / Drainaqe 1 BY: BY: This 135 acre site can not currently be served by the city's utility system. Major water line and sanitary sewer improvement projects need to be completed to make this site fully developable. The City has worked with Wilson & Co. to develop a utility and drainage master plan for this area. The utility improvements needed to allow full development of this 135 acre tract include: 1. Improvements to the City's Water Distribution System The installation of a new 12" water line connection to the existing 16" line near the intersection of Magnolia Road and Ohio Street, the extension of a new 12" water line along the east side of Ohio Street south to Schilling Road, the extension of a new 12" water line west under Ohio Street along the north side of Schilling Road west to the Union Pacific Railroad and connection to the existing system on the west side of the Union Pacific Railroad. This full looped water system must be in place to allow any additional development on South Ohio Land, L.L.C.'s holdings. The first 830 ft. of this 12" water line system is being installed west from the railroad tracks to Cortland Circle to serve the Kennedy & Coe site. The remainder of this looped water line project is in the City's 2004 Capital Improvement Program. The cost of installing the full looped water system will be financed up front through the issuance of general obligation bonds with those costs recovered through a Capital Cost Recovery Charge. Benefiting properties along Ohio Street and Schilling Road will be charged their proportionate share of the equivalent cost of a 6" water line. A "benefit area" will be established and the proportionate share of each benefiting landowner will be based on the acreage of the benefiting property that can be served by this line. This fee will be collected when a building permit is issued for a lot or tract of land. The Magnolia / Ohio / Schilling water line loop will make public water available to this site for domestic use and fire protection purposes but will not fully serve the entire 146 acre site. The Director of Utilities has determined that proposed Lots 2 and 5 along Ohio Street and the 3 large industrial lots can not be adequately served by the Phase I water system and that Phase II of this water line project, extension of a 12" line from Schilling Road to the 24" line in Water Well Road, is needed to allow development of those lots. Improvements to the City's Sanitary Sewer System 7 APPROVED FOR AGENDA: BY: BY: To provide South Ohio Land, L.L.C.'s property with sanitary sewer service, Wilson & Company recommended that gravity sewer lines be utilized which would discharge south to an existing pump station (Pump Station 35) located east of the railroad tracks, north of Crestwood Cabinets. The applicant's design engineer is recommending that two 15" gravity sewer lines be installed starting at the north end of the center of the tract and extend south parallel to and on either side of a proposed north-south drainage ditch. These 15" gravity lines would extend south into the property owned by the Salina Economic Development Corporation and connect to a single 15" gravity pipeline which would extend west to the east right-of-way of the Union Pacific Railroad and then south to the existing pump station. The reason for the twin sewer lines is the depth of the proposed drainage ditch (7-8 ft.). The profile of the ditch would not allow sewer lines to cross the ditch without being exposed above the bottom elevation of the ditch. The reason for the larger diameter lines is that it allows the lines to be laid flatter with less slope. The cost of installing this sanitary sewer system could be a combination of benefit district and capital cost recovery charge financing. The Salina Economic Development Corporation property would be subject to a Capital Cost Recovery Charge payable at the time building permits are issued, unless their property is annexed prior to benefit district establishment. The portion of the twin 15" sewer lines that are located on and serve South Ohio Land L.L.C.'s property could be financed privately by South Ohio Land L.L.C. or publicly financed over 15 years through the creation of a special assessment benefit district. South Ohio Land L.L.C.'s share of the cost would be in proportion to its benefit, as calculated under state law for special assessment benefit district. Other benefiting properties between Schilling Road and Water Well Road would also pay a proportionate share based on benefit. The applicant will be responsible for extending needed utility lines (both water and sewer) into the remainder of the site to serve individual building lots. The layout and design of these internal improvements will be resolved during the plat review process. These internal public lines could be financed privately by South Ohio Land, L.L.C. or public financed over 15 years through the creation of a special assessment benefit district. 3. Drainaqe Lots in this proposed subdivision would be subject to the Schilling Road Ditch Capital Cost Recovery Charge because it drains directly into the Schilling Road Ditch. The drainage fee would be $.12/cu. ft. of additional runoff. "Additional runoff" means the difference between the CITY OF SALINA REQUEST FOR CITY COMMISSION ACTION DATE 12/22/03 TIME 4:00 P.M. Page 6 volume of stormwater runoff that comes off the property today in its agricultural state and the amount of runoff generated by this property upon full development (see attached Benefit Area map.) 1 BY: BY: To allow runoff from the south to get to the Schilling Road Ditch, Wilson & Co. is recommending the construction of a north-south storm drainage ditch that would eventually run from Water Well Road to Schilling Road. The proposed Wilson & Co. design calls for a large, deep relatively flat ditch with a bottom width ranging from 10ft. to 20 ft., 4:1 side slopes, a .10% longitudinal grade, and 1 ft. of freeboard. The storm drainage ditch from Water Well Road north to the next anticipated street crossing is designed to have a 10ft. bottom width. The last stretch of the proposed storm drainage ditch would have a 20 ft. bottom width before discharging into the existing Schilling Road Ditch. In order to accommodate the inclusion of a dual-purpose easement for the proposed sanitary sewer improvements and a buffer/maintenance area on both sides of the proposed storm drainage ditch, 120 feet of right-of-way is required. This will include an area approximately 20 feet wide on both sides of the proposed storm drainage ditch. The size and width of the drainage channel is based upon a 25 year storm design, developed conditions north of Water Well Road and undeveloped conditions south of Water Well Road. The 25 year storm design is the minimum requirement of the City of Salina for storm water systems. A 120 ft. wide drainage / utility right-of-way running from the southern boundary of the property to the Schilling Road ditch is shown on the preliminary plat. Drainage right-of-way means that this 120 ft. strip and the ditch itself would be publicly owned and maintained. In the Annexation Agreement between South Ohio Land L.L.C. and the City of Salina, the City agreed that in exchange for this dedication right-of-way on the plat the City would design and construct a drainage ditch within this dedicated right-of-way, design and pay for the cost of constructing two (2) street crossings over the ditch and take full responsibility for maintenance of the ditch in perpetuity as a public improvement. Future building lots within Liberty Addition No.2 subject to the Schilling Road Drainage Impact Fee would not have to provide their own stormwater detention facilities and would be permitted to discharge their additional runoff into the ditch without the payment of a drainage impact fee. In addition, the City agreed to make the excavation material from construction of the ditch available to Owner at no charge for use as fill material for building pads within Liberty Addition. South Ohio Land as developer will be responsible for the design and construction of internal storm drainaqe improvements associated with the public street system within this subdivision. Page 7 These internal storm drainage improvement (inlets, pipelines and flumes) could be financed privately or publicly financed over a 15 year period through creation of a special assessment benefit district. 1 BY: BY: Street Access and Improvements Schilling Road between the Union Pacific Railroad tracks and Ohio Street was rebuilt in 1997. Abutting properties were not assessed for the cost of the road at that time. Therefore, this property would be subject to a Capital Cost Recovery Charge for that reconstruction. The charge is set at $.O376/sq. ft. of land area or $1,638/acre. This fee or charge must be paid to the City prior to the development of any land subject to the Capital Cost Recovery Charge. The charge is applicable to the square footage or acreage within the tract that is being developed. For purposes of the Capital Cost Recovery Charge, "development" shall mean either final approval of a subdivision plat by the City, or, if approval of a subdivision plat by the City is not required for any reason, then upon the first to occur of either annexation of the property into the corporate limits of the city or connection to the water or sewer system of the City. When the public interest is served by a reasonable delay in payment of the lump sum Capital Cost Recovery Charge, the governing body may approve an agreement with the owner specifying when the lump sum payment shall be made and any other relevant terms or conditions. In the Annexation Agreement between South Ohio Land, L.L.C. and the City of Salina, the City Commission agreed to allow this charge to be paid at the time a building permit is issued based on the acreage of the parcel for which the permit is issued. As a result of being subject to the Capital Cost Recovery Charge for Schilling Road, property within the Schilling Road Benefit Area will not be special assessed or required to pay a charge or fee in conjunction with the future reconstruction of Ohio Street (see attached Benefit Area map.) South Ohio Land as developer will be responsible for the design and construction of internal public streets serving individual building lots within Liberty Addition No.2. The cost of constructing internal streets could be financed privately by South Ohio Land or publicly financed over a 15 year period through the creation of a special assessment benefit district. Other Utilities This 135 acre tract is within Westar Energy's service territory for electric service and is not part of any rural water district so there are no franchise issues or district boundaries that would need to be adjusted as a result of annexinq this property into the city. This line will need to be extended under the railroad tracks to serve this site. Because this is not a residential subdivision, the developer has the option of underground or overhead power lines. Easements and Dedications The proposed final plat shows dedicated restricted access along Schilling Road except for the one north-south ditch crossing. The plat also shows restricted access along Ohio Street except for two street openings. The plat shows a proposed dedication of 50 ft. of right-of-way west of center line for the west half of Ohio Street and this meets the city's standards for arterial streets. Additional dedications of right-of-way include 60 ft. of street right-of-way for the proposed internal streets (Cortland Circle, Braeburn Street and Mcintosh Street) as well a 120 ft. of public drainage / utility right-of-way for the proposed north-south drainage ditch and utilities parallel to the ditch. Needed utility easements for proposed water and sewer line extensions are shown on the plat. All utility easements shown meet the city's minimum width standard of 20 ft. Westar Energy has requested that an additional 20 ft. east-west utility easement be provided along the north side of Mcintosh Street to matchup with an easement shown across Block 5. A 100' wide easement for a high pressure gas transmission line has already been granted to KPL along the western and southern boundary of this site. No buildings can be placed within the gas pipeline easement. This area can be used for parking, landscaping and green space with some limitations. Required Public Improvements The developer would be responsible for the following public improvements: 1. Streets - Approximately 5,000 ft. of asphalt or concrete paving, 2 lanes, 33 ft. wide with curb and gutter. 2. Sidewalks - 4' sidewalks along both sides of (Cortland, Braeburn and Mcintosh). 3. Drainage - Street inlets and pipes or flumes needed to carry runoff to the north-south drainage ditch and Schilling Road Ditch. 4. Utilities - Design and construction of internal public sewer lines and water mains needed to serve individual building lots. Special Assessments / Impact Fees Property owners along Ohio Street and Schilling Road will be included in the "Benefit Area" for the Magnolia / Ohio / Schilling water line and will be obligated to pay a cost recovery charge when their property develops. The Salina Economic Development Corporation property to the south will be included in the "Benefit Area" for the sanitary sewer system and would be subject to either future special assessments or a cost recovery charge for its share of the sewer system. The unplatted Samuelson property to the south would be included in the "Benefit Area" for Phase II of the water line project (Schilling to Water Well) and would be subject to a future cost recovery charge for its share of the project cost. Otherwise, property owners outside of this development will not be impacted by assessments for internal streets or public utilities that serve only this development. All costs for on-site improvements will be borne by the owner/developer or passed on to lot buyers as a special assessment. Phasinq of Public Improvements The applicant has not submitted a specific plan for the phasing of internal public improvements. Staff would note that the entire sanitary sewer system from Pump 35 north to Cortland Circle must be designed and in place before any lot in Liberty Addition No.2 can be developed. Staff would also not that proposed Lots 2 and 5 on Ohio Street and the three (3) proposed industrial lots on Mcintosh cannot be developed until Phase II of the South Ohio Water line project is complete unless the City's Development Review Team approves an alternate plan for supplyinq water to these lots. Planninq Commission Action The City Planning Commission reviewed this plat at its December 2, 2003 meeting. Following presentation of the staff report and questions, the Planning Commission voted 7-0 to approve your proposed final plat of Liberty Addition No.2, subject to all needed technical corrections being made to the plat drawing and plat certificates prior to City Commission consideration of the final plat and subject to the following conditions: 1. That the entire sanitary sewer system from Pump 35 north to Cortland Circle must be designed and in place before any lot in Liberty Addition No.2 can be developed. 2. Proposed Lots 4 and 5 in Block 4 on Ohio Street, Lots 1 and 2 in Block 6 and Lot 5, Block 5 cannot be developed until Phase II of the South Ohio water line project is complete unless the City's Development Review Team approves an alternate plan for supplying water to these lots. 3. Application #P03-7A, filed by South Ohio Land, L.L.C., requesting approval of a final plat of Liberty Addition No.2 a proposed 19 lot subdivision of a 135 acre tract located on the south side of Schilling Road west of Ohio Street. Mr. Andrew gave the staff report which is contained in the case file. Mr. Britton asked are there any questions of staff? Hearing none would the applicant care to come forward? James Hall, South Ohio Land, L.L.C., 1525 E. North Street. As Dean outlined we have gone through the last tasks of making sure that the sewer will still be in the ground at the north end of the property when we get there and we have gone through and we have done that. We have looked at the other issues that have been asked of us and I think all the questions have been asked and answered. We certainly do appreciate all the help and time that we have received from staff on this and look forward to going forward with this development. If there are any questions specifically of me I would be happy to try and answer them. Mr. Britton asked are there any questions of the applicant?
