US 40 & US 81 Business Route Projects Agreement S. S. No. 2-174-1 US-40 & US-81 BUSINESS ROUTE PROJECTS SIGNING CITY OF SALINA, KANSAS A G R E E M E N T This agreement made and entered into this 21st day of January, 1974, by and between the City of Salina, Kansas, hereinafter referred to as the City, the Board of County Commissioners of Saline County, Kansas, hereinafter referred to as the County, and the State Highway Commission of Kansas, hereinafter referred to as the Commission. R E C I T A L S: WHEREAS, the said City desires that a business route be signed and marked to wit: US-81 business route beginning on the present traveled way of Highway US-81 and Highway 1-35W, south of Salina, said point being at Station 160+00 on the center line of Ramp A as con- structed by, and shown on plans for Project 35w-85 I-35W-1 (48) , thence extending northeasterly and northerly a distance of 1 .287 miles to a point on the south city limit of Salina, said point being 1320 feet north of the southeast corner of Section 36, Township 15 South, Range 3 West; thence north on Ninth Street; northerly on Broadway Boulevard; north on Ninth Street to 1-70. US-40 business route beginning at the intersection of Ninth Street and 1-70; thence south on Ninth Street to Ash Street; thence east on Ash Street to Ohio Street; thence north on Ohio Street to 1-70. WHEREAS, after an investigation by the Commission, it has been found that such routes can be signed and marked without creating traffic hazards or undue inconvenience to the traveling public, the said Commission approves the above described business routes, and WHEREAS, the Commission has by prior commitment agreed to the initial installation and/or erection of the necessary signs for the business routes at its own expense, and *.. No. 2- 174-1 • WHEREAS, the City has relied upon the Commission fulfilling its commitment, and WHEREAS, the said City and County agree that the Commission will not be responsible for the maintenance of or additional expense beyond the acceptance of the initial installation of the signing in connection with the above described business routes, NOW, THEREFORE, IN CONSIDERATION OF THE ABOVE RECITALS , IT IS MUTUALLY AGREED BY THE PARTIES HERETO: 1 . That the said Commission agrees to install or erect the necessary signs and markings at its own expense. 2. That the said City agrees to maintain all signs, posts and attachments furnished and installed by the Commission, and in the event any sign or signs and/or parts thereof are stolen or destroyed, the said City further agrees to replace any sign or signs and/or parts thereof, including material , labor and transportation at its own expense. 3. That in the event and after approval of the Commission of said signing and marking of the described business routes, the said City or County permits encroachment on the streets or highways so previously approved, which encroachments are found by the said Commission to have created a hazard to the traffic, the said Commission shall withdraw its approval and remove the route signs and markers from said business routes at the City's expense, the route designation signs to become the property of the Commission. 4. That this agreement is made and entered into solely for the convenience of the said City, and that the said business routes are not to be considered, and are not connecting links within said City, and the City an'd County agree that any liability, damage, expense or other cause that may arise out of or by reason of the signing and marking of the described business routes shall be at no expense to the Commission, and if any claims or litigation should arise the City and/or County shall defend the same and hold the Commission harmless from any expense or judgment as a result of the said signing and marking of the described business routes. 5. That any party to this agreement may revoke said agreement upon ten days written notice to the other parties, and said agreement shall be in full force and effect until revoked by such party. 6. That where the business routes entail travel over County roads or streets, the City will be responsible for obtaining agreements with said County for any further responsibilities deemed necessary. - 2 - S.S. No. 2-174-1 f 7. This agreement shall be binding upon and inure to the benefit of the successors and interests of the respective parties hereto. Olson City Manager City Hall 300 West Ash Street Salina, Kansas 67401 Dear Mr. Olson: At the request of the City of Salina, business routes for US 40 and US 81 through the City have been revised and signing plans prepared for these routes. In order that approval for the routes is confirmed by all concerned parties, an agreement form has been prepared. We are transmitting herewith five (5) copies of the agreement forms covering the responsibilities of the City, County and State Highway Com- mission in connection with signing of the designated business routes. If the proposed agreement is satisfactory, three (3) copies should be exe- cuted on the part of the City and County and returned to this office for our further handling with the Highway Commission. Two (2) additional copies are enclosed and may be retained, one each for the City and County, for reference until you receive the fully executed copy. We are also sending you two copies of a vicinity map which indicate the location of the routes. Completed signing plans will be sent to you for your inform- ation in the near future. In connection with the execution of the agreement, the City will no doubt find it necessary to pass a resolution authorizing the Mayor and City Clerk to execute the agreement. We should be furnished a certified copy of such resolution as the City sees fit to adopt in order to complete our files for the project. The agreement forwarded to you on May 23, 1973 does not now apply and should be destroyed. One copy should be made available to the county for their files. You will note that the description of the US-40 route has been altered on Page One (1) of the agreement to include that portion of Ninth Street to the 1-70 intersection. You will , also, note that Section Four (4) of the agreement indicates that the business routes are not to be considered connecting links of the State Highway System.
