BY: A ,~" '1-- Item Second reading of Ordinance No. 03-10142 annexing the unplatted portion of Mariposa and a portion of Cloud Street into the corporate limits of the city. The request area contains 74.4 acres and is bordered by the Mariposa Addition on the west, the Salina Municipal Golf Course on the north, the Flor De Soil Briargate Additions on the east and the Elks Country Club on the south. Backqround Information A long term development plan I master plan for Mariposa was prepared by the Graves Trust in 1988 and was approved in concept by the Salina Planning Commission and City Commission. One of the major aspects of this long term plan was that it called for Cloud Street to be vacated and closed adjacent to the Elks Club at some point in the future and replaced by a realigned Mariposa Drive connecting Marymount Road with the existing paved portion of Cloud Street. (See attached plan for Mariposa). The first segment of Mariposa Drive has been constructed just east of Marymount Road. Cloud Street is currently owned and maintained by Saline County. The Salina County Commission endorsed this concept in 1988 and adopted a resolution granting conditional approval of the proposed closure and vacation of Cloud Street. In their action authorizing the future closure of Cloud Street, the County Commission stipulated that three things had to occur prior to Cloud Street being closed. Those three conditions are: b. c. The dedication, improvement, and construction of a collector street in accordance with the planning and engineering standards of the City of Salina without cost or expense to Saline County, and the opening of said street for public use, between a point on East Cloud at or near the northeast corner of the golf course of the Elks County Club on the one hand, and, on the other, South Marymount Road at a point located between 400' and 1000' north of the southwest corner of the Southwest Quarter of Section 20-14-2. Annexation by the City of Salina of the Southwest Quarter (SW 1/4) of Section 20-14-2. Approval by the City of Salina of a subdivision plat of the southwest Quarter (SW 1/4) of Section 20-14-2. a. Following the City and County Commission endorsement of their long term plan, the Graves Trust platted and annexed four areas in 1989: - Blocks 1-4 which contains 49 single-family residential lots and is substantially developed. - Block 5 which is directly east of Blocks 1-4 and is platted and zoned for townhome development but is vacant. - Block 6 which is south of Mariposa Road. BY: BY: - Block 7 which is located on the north side of Cloud Street just west of Markley Road. This block was replatted into the Briargate and Flor De Sol Additions by Bob Gile in :2000 Both of these residential subdivisions are under development. The remainder of the Graves Trust holdings is unplatted land that is zoned Agricultural and has remained outside the city limits. Street Access and Maintenance Marymount Road between Mariposa Drive and the Elks Club and Cloud Street west of Valley View are County owned and maintained roads. Neither road meets City public street standards. The short term plan is for Marymount Road to be annexed into the city and to be rebuilt from Mariposa Drive to the Elks Club entrance. These improvements would be financed through the creation of a benefit district with assessments being levied on adjacent benefiting properties which were not assessed for the improvements north of Mariposa Drive. However, only properties located within the city limits may be included in a benefit district. The long term plan is for Cloud Street to be vacated and closed and replaced by a realigned Mariposa Drive connecting Marymount Road with the existing paved portion of Cloud Street. Cloud Street lies within a roadway easement which means that the abutting property owners actually own to the center of the road. The Graves Trust's ownership extends to the centE~rline of Cloud Street except for the far west end of Cloud Street where there is platted right-of-way. Bob Haworth recently purchased a 16 ft. strip of Cloud Street from the Elks Club and has a contract to purchase the Graves Trust property between Mariposa Drive and Cloud Street with plans to plat this area as a residential subdivision. The platted area would include Cloud Street and this annexation application includes the area occupied by the existing roadway. Adjacent Properties The Mariposa Addition (Blocks 1-6) to the west is within the city limits as are the Salina Municipal Golf Course to the north and the Flor de Sol and Briargate Additions to the east. The affect of this annexation would be to square off the city limit line along Cloud Street with everything from Cloud Street north lying within the city and the Elks Country Club on the south side of Cloud remaining outside the city. The annexation of this 74 acre tract will greatly assist with infrastructure planning for this area and provide landowners and the City with more options for financing street and utility improvements. Bob Haworth has a contract to purchase a 34 acre portion of the Graves Trust holdings and a preliminary plat and preliminary zoning approval has been granted for his proposed residential subdivision - Cedar Ridge. Page 3 BY: BY: Comprehensive Plan The city's future land use plan shows this tract as being suitable for low-density residential development and as a Primary Service Area for extension of city services meaning it would bl3 eligible for special assessment financing. Saline County's future land use plan also shows this tmct as being within Salina's Urban Service Area. In addition to the land use plan, the following development policies are relevant to this annexation request: A2 R14 A6 A7 Annexation will be required before facilities and services are provided to any site, except for industrial uses which shall consent to future annexation. No new residential development should be permitted until adequate water and sanitary sewer service are provided. Every effort should be made to discourage growth in locations where provision of these services are not available or planned as part of the City's future urban service growth areas. While county zoning classifications will be considered in annexation, the appropriate classification under the City's zoning regulations must be determined and applied. The City will assist property owners and developers in Primary Service ArHas in taking positive steps toward annexation under the presumption that annexation is in the best interest to property owners as well as to Salina as a community. Assistance includes, but is not limited to, dissemination of city plans and information regarding annexation and making available City staff resources to assist in the coordination of annexation matters. City Commission Action The City Commission approved an ordinance annexing this property on first reading on April 28, 2003. Second reading was be held in abeyance until staff has an opportunity to discuss and reach an agreement on the future maintenance of Cloud Street with Saline County. Those discussions with Jerry Fowler, the County Engineer, have been held and the City Engineering and General Services Department has agreed to take over maintenance of Cloud Street until such time as it is closed to traffic. Staff would recommend that the attached ordinance be approved on second reading.
