Iorv- 7 LEASE AGREEMENT HIS LEASE AGREEMENT , made and entered into this K _ C� w day of , 1964 , by and between THE CITY OF SALINA, KANSAS , a municipal corporation , hereinafter referred to as the "Lessor" and FAITH TEMPLE CHURCH OF GOD IN CHRIST of Salina, Kansas , hereinafter referred to as the "Lessee" , WITNESSETH : WHEREAS the Lessor is the owner of a building located a ' 7th and Decator Streets in the City of Salina, Kansas , and is will ing to lease said building at, such times as it is not required for City purposes ; and, WHEREAS the Lessee desires to use said building for it ' - • meetings ; ' and, NOW THEREFORE, in consideration of the rents , covenants and agreements herein set forth to be paid , kept and performed by the Lessee , the Lessor hereby grants the Lessee the non-exclusive use of the building located at 7th and Decator Streets , Salina, Ka - sas , for a term of nine ( 9) months commencing on April 1 , 1964 , and terminating on December 31 , 1964 , upon the terms and condition- • hereinafter set forth', to-wit : 1. Lessor reserves the right to use the building at an and all times as may be necessary for city purposes. In the event said premises are needed for city purposes , Lessee agrees to remov any and/or all of it ' s property as requested by Lessor. 3 . Lessor reserves the right to lease said building to other organizations for their use provided said use does not inter- fere with the regular or scheduled meetings of Lessee. ' 1 4 . Lessor agrees to make no changes or alterations in jjthe premises without the written consent of the Lessor. The Lessee, "may , at their own expense , after securing approval of the Lessor, 4redecorate or make repairs to said'; premises. A j f .-- etNe r . 5 . Lessee agrees to`•be responsible and to reimburse Lessor for all damage to the leased premises caused by its negli- gence or that of its employees , guests , members , invitees or lic- ensees. • 6 . Lessee agrees that Lessor shall not be liable for . • any loss , damage , injury or other casualty of what ever kind or by . whomever caused to any person or property of anyone arising out of or resulting from Lessee' s use and possession of the above premises and the Lessee hereby agrees to defend, indemnify and hold Lessor harmless from and against all claims , demands and suits for such loss , damage , injury or other casualty. (Even if such claim, de- mand or suit is groundless , false or fraudulent . ) 7 . Lessor reserves the right to terminate this lease at any time upon the giving of thirty ( 30 ) days written notice to . the Lessee. 1. Lessor agrees to pay for all utilities used on the premises. Salmans Sr. Chief of Police Prior to recieveing a notice to check on the loud noise at the voting building at 8th and Decatur, this officer had observed on several evenings, that numerous negro per- sons were gathering in this building for church services. This all started about the time that Rev. Blackman stated in the local Paper, that he was going to have some kind of twenty four (24) hour watch. From that time on and until now, there are meetings in this building each night. While the services are going on in the building, several children are running around the out side playing and hollering. Some of these meeting last until 10:30 PM each night and longer. Along with this there is a loud speaker posted on a post at the Pete Corum Used car Lot, at Santa Fe and De- catur, of which music is played over each night. Sometimes this speaker is quite load and can be heard from some distance.
