Use of Old Airport for Racingre-t- • ' ADDENDUM TO LICENSE. 'AGREEMENT THIS ADDENDUM, made and entered into this 21st - day of December, 1970 , by and between the CITY OF SALINA, KANSAS , a municipal corporation, hereinafter referred to as the "City" and PAGODA CLUB OF SALINA, INC. , hereinafter referred to as the • "Club" , WITNESSETH: WHEREAS , on the 1st day of January, . 1969 , the City entered into a certain "License Agreement" with the Breakfast Optimist Club of Salina, a Kansas nonprofit corporation , whereby said City •granted it a license to operate drag races on certain property formerly operated by the City as the municipal airport; and WHEREAS , by an Assignment dated March 9 , 1970 , the Breakfast Optimist Club of Salina assigned all of its interest in and to said License Agreement unto the Pagoda Club of Salina , Inc . ; and WHEREAS , the primary term of the above mentioned License Agreement will expire on January 1 , 1971 , and the said Club desires to extend the same for a term of one (1) 'year : • NOW THEREFORE , in consideration of the mutual covenants herein contained the parties hereto mutually agree as follows : (1) . That that certain "License Agreement" entered into by and between the City and the Breakfast , Optimist Club of Salina , dated January 1 , 1969 , and subsequently assigned to the Pagoda , Club of Salina, Inc . be extended for a term of one (1) year from January 1, 1971 . . (2) . That said License Agreement is amended by adding the following paragraph : "That the Club agrees that it will not conduct any organized races , or allow any of its members to use the drag strip at any time the Salina Municipal Golf Course is being used for a tournament or other event sponsored or sanctioned by the manager of the Salina Municipal Golf Course ; provided however , that the City through its golf course manager must notify said Club at least thirty (30) days in advance as to when said golf course will be used for such activities . " • (3) . That all of the terms , conditions and covenants con- tained in the above mentioned License Agreement are hereby ratified and affirmed by the parties . • • IN WITNESS WHEREOF , the said parties have hereunto set their hands the day and year first above written . WHEREAS, the assignor is the holder of a certain license from the City of Salina_as set forth in the License Agreement dated January 1, 1969, a copy of said License Agreement being attached hereto, 'made a part hereof, incorporated herein by reference and marked Exhibit "A"; and, WHEREAS, the assignee is desirous of purchasing said License Agreement from the assignor. NOW, THEREFORE, be it agreed by and between assignor and assignee that for and in consideration of One ($1.00) Dollar and other good and valuable consideration and the performance of the covenants hereinafter set forth, assignor herein sets over, assigns and transfers to assignee all its right, title and interest to the license and License Agreement hereto attached, subject to all of the terms, covenants_and agreements contained in said License Agreement, which the said assignee hereby assumes and agrees to per- form. Said assignee hereby accepts the assignment and transfer herein made and agrees to keep and perform all the obligations on it by the License Agreement attached hereto. _ IT IS SPECIFICALLY AGREED that in the event assignee should for any reason.whatever, .during the term of said License Agreement decide to surrender said license to the City of Salina, the assignee will advise the assignor of such determination_prior to said surrender in order that the assignor may, if it so desires, take over said License Agreement for the remainder of the term of said license. Sec= tion Twenty (20) , Township Fourteen (14) South, Range Two (2) West of the Sixth Principal Meridian hereinafter referred to as the "Premises" ; and WHEREAS; the Club has indicated a desire to use that portion of the Premises indicated on the attached map designated as Exhibit "A" for drag racing; and • WHEREAS, the Club has represented to the City that all of its operations will be conducted under the rules and regulations specified in the then current edition of the "Drag Racing Rules and Technical Manual" as adopted by the American Hot Rod Associ- ation. NOW, THEREFORE, the City, in consideration of the mutual coy enants herein contained on the part of the Club, does by these presents hereby grant a license to said Club to use that portion' of the premises shown on Exhibit "A" for organized drag, races in accordance with the following terms and conditions : (1) : Club hereby -assumes full responsibility for the follow- ing: (a) . To secure and maintain in force from a com- pany authorized to do business within the State of Kansas a policy of liability insurance which will pro- vide liability coverage for personal injuries and prop- erty damages which might result on the Premises as a result of .its operation in an aggregate amount of not less than $500 , 000 : 00 .: (b) . To be responsible for all persons using the Premises -during drag racing events sponsored by the Club. • (c) . To comply with all of the safety standards specified in the then current edition of the Drag Racing Rules and Technical Manual adopted by the American Hot Rod Association. (d) . To hold and save harmless the City from any and all liability for property damage or bodily injury claims which may result from its operation of drag races on said Premises , whether such claims beLmade by persons participating in said drag racing or by specta- tors thereof. (e) . To maintain the premises in a neat and orderly manner and not to allow any rubbish to accumulate about the premises . (f) ; To abide by all laws , ordinances, regulations and restrictions that may be imposed from time to time by the City, state or other governmental authority . (g) . To remove any and all property from the prem- ises on the termination of this agreement and to restore the property to substantially the same condition as it was prior to the commencement hereof. (h) . To construct no permanent structures on that area formerly used as a runway or taxiways . - (i) . To apply no surfacing materials on the runway surfaces . (j) . To remove any obstructions placed on the run- way after each drag racing event. (k) . To provide, install and maintain adequate fences, guard rails and other protective devices which may be necessary or required for the protection of spectators . (1) . To provide, install and maintain on the Prem- ises adequate sanitation facilities for use by participants and spectators. (2) . The Breakfast Optimist Club feels that this activity has been a definite asset to the Salina Community and that there is a large interest in this type of Recreational Sport. We are proud to have had a part in instituting this program and have a . great desire to see it continue. Our club, however; being • involved with many phases of fund raising and boys work, finds a project of this size to be quite burdensom and time consuming when properly staffed. The Pagoda Car Club on the' other hand has as it's onJ.y interest this type of activity and is able to devote it's entire energy and resourses to it's operation. We feel that with last years operation of the Salina Raceway, enough experience was gained that the Pagoda Club should be able to handle the entfre project with a minimum of difficulty. We therefore, request that as indicated above, the City • Commissioners give consideration to assigning the present license agreement to the Pagoda Car Club for the balance of the term of said agreement. This autocross will be one of 3 being run by Wichita Region as the Schlitz • Autocross 13eries. Schlitz Weer is sponsoring several such series around the country through SCUA regions, Wichita Region being one of those selected. The- other 2 events will run in Wichita. Enclosed is a diagram showing what an autocross course looks like. This is I not the exact course design we intend to run but is an idealized sketch of { what such a course is like. It also shows the area of the Raceway we -wish to y use. An autocross is a closed-course event for automobiles, divided into the sale q classes used in SCCA racing. However, speeds generally are much, lower as the premium is placed on handling of an automobile through a tight and twisty i course. . tThe course I intend to design probably will allow smaller cars to' reach 3rd gear and larger ones to get to 2nd gear. .5O or 69 mph would be . . considered high speed in an autocross. Average- speed Will likely be in the I. 20-30 mph range. . • ' This event will be covered by the same SCCA insurance tolicy, through Lloyd' s j of London, which covered the ,: SCUP races here'. The policy covers all $QCA I events and is written to cover any participant, sponsor or property owner in a general statement. If you wish, I can obtain a copy of it (after. our I Squires secretary, who has • it in his possession, returns from vacation) . Also I if you wish, a version of the policy- can be written which specifically names the City of Salina as one of the insured • An autocross generally is run for the benefit of participants rather_ than as a spectator-ori :nted event. Thus there is an entry fee to participate but no admission charge. Anyone who wishes to lust watch may .do so for free. . - - Entry fees go towards trophies, plaques and club expenses . Both the Squires ' and SCCA are non-profit organizations. Schlitz ' s interest, in this case, I • believe is strictly a publicity tie-in. • - . While I am requesting specific permission here for this event, I also would like to be able to run future autocrosses, on a smaller scale, for the . Squires . We have been using the high school parking lot for past events. • While we would like to use the raceway, the Pagoda Car Club has prior claim on the strip which we recd nine and we acknowledge that our opportunities • to use- the Raceway would have. to be contingent on the Pagoda schedule. In visiting with Dick Jennings about this , he assured us that they would coordinate with the Golf Pro on scheduled tournaments , the same as they have been doing on Sundays . He also said they planned to open about 2 : 00 p.m. and would begin their final elimination about 6 :30 . This would give them plenty of time to complete the races and clear the area of spectators and participants before dark.
