SGT Fund or Department S2/ / / "w'0 Account No. Received By ahN/ No. 2575 r rtit LEASE AGREEMENT /" 11N) This lease agreement made and entered into this 31st day of October,1975, by and between THE CITY OF SALINA, KANSAS, a municipal corporation, hereinafter referred to as the "City" and ROYAL TIRE COMPANY, INC. , hereinafter referred to as "Royal", WITNESSETH: The City does by this agreement hereby lease and demise unto Royal, the West Forty (40) feet of that certain boundary wall located on the south boundary of the municipal parking lot located at 133-135 South Fifth Street, Salina, Kansas, for a term of five years beginning on the 22nd day of November, 1975, at a rental of One Hundred Dollars ($100.00) payable in advance. It is further mutually agreed by and between the parties hereto as follows: (1) Royal shall have the right to paint on said wall and/or affix thereto and maintain and/or illuminate, painted and/or poster and/or electrical advertising signs of all kinds and that the sign, structure and equipment placed on said premises by Royal shall remain the property of and must be removed by Royal at the expiration of the term of this lease or any extension thereof. (2) Royal agrees to save harmless, protect and indemnify the City from and against any and all loss, damages, claims, suits or actions at law, judgements and costs, including attorney's fees, which may arise or grow out of any injury to or death of any person or damage to property cuased by, arising from or in any manner connected with the exercise of any right granted or conferred hereby, or the use, maintenance, operation or condition of the premised, whether sustained by Royal, its respective agents, or employees, or by any other persons,or corporations whichh seek to hold the City liable. (3) At the expiration of the term of this lease, Royal agrees to remove any sign, posters, structures and equipment placed on said premises and to restore the premises to the same condition as they were at the beginning of this lease, normal wear and tear excepted. (4) Royal shall have the option to extend this lease at the expiration of the primary term hereof onaa year to year basis at such rental as may be determined by mutual agreement of the parties at that time. (5) City reserves the right to lease the remainder of said wall not included in this lease to any other party for advertising purposes.
