A G R E E M E N T ' '
This agreement, made and entered into this i5ott day of
19 Zj , by and between the City of Salina, Kansas, hereinafter ref-dced to as
the City, and the State Highway Commission of Kansas, hereinafter referred
to as the Commission.
R E C I T A L S:
WHEREAS, The Commission and the said City are empowered by K.S.A.
Chapter 68, Section 169 and Section 412 to enter into agreements for the
maintenance and reconstruction and improvement of city connecting links
of the State Highway System through said City, and
WHEREAS, commitments by the Commission were formulated to repair the
structure on the city connecting link of the State Highway System, prior
to removal from the system which became effective on January 1 , 1973, and
WHEREAS, the City has relied upon the Commission fulfilling its prior
commitment, and
WHEREAS; the- Commission desires to fulfill its prior commitment by
entering into an agreement with the City for a project of major repair
and/or partial reconstruction of the above designated bridge, and
WHEREAS, the Commission and the said City desire that the following
major repair or reconstruction work be done:
• Girder Repairs and other miscellaneous repairs as shown on the
. approved plans to the bridge designated above which is the
structure over Mulberry Creek located about 998 feet south of
the centerline of I-70 highway.
NOW; THEREFORE, in consideration of the premises and to secure the
approval and prosecution of the said project, the parties hereto mutually
agree as follows:
1 . That the said project when approved shall be undertaken, prosecuted
and may be completed for and on behalf of the said City by the Commission
acting in all things as its agent and said City hereby constitutes and

appoints said Commission its agent, and all acts, proceedings, matters and
things hereinafter done by the Commission in connection therewith are hereby
by said City authorized, adopted, ratified and confirmed to the same extent
and with the same effect as though done directly by the said City acting in
its own individual corporate capacity instead of by its agent. The plans
for the said project, when approved by the City and the State Highway Engineer,
are by reference made a part of this agreement.
2. The Commission agrees to let the contract, to perform the work on
the project in accordance with the approved plans and specifications for the
project, to supervise the work and to administer the payments due the con-
tractor, or in the alternative, the Commission may perform the work itself
in accordance with the approved specifications for the project.
3. The Commission agrees to do all the work described and pay all
the costs thereof whether done by contract or with its own forces.
4. The City agrees to adopt the necessary resolution and to take such
legal steps as may be required to give full effect to the terms of this
agreement and such traffic regulations as the Commission deems necessary
to permit the work to be completed. .
IN WITNESS WHEREOF the parties hereto have caused this agreement to
be signed by their duly authorized officers on the day and year first
above written.

this agreement will be furnished if requested within two weeks of

Dear Mr. Olson:
The Highway Commission has prepared plans for an improvement project
involving bridge repair to the southbound structure over Mulberry Creek
located about 998 feet south of the centerline of 1-70 highway on former
Alternate US-81 , We are sending you construction plans (Sheets 1-7) indi-
cating the scope of the proposed bridge repair. We are also sending you in
triplicate the agreement form covering the work to be performed. Will you
please handle these forms with the Governing Body for their review and
action. If the proposed agreement is satisfactory, two copies should be
executed on the part of the City and returned to this office for our handling
with the Highway Commission. The third copy may be retained in your files
' for reference pending receipt of your fully executed copy.
In connection with executing the agreement the City will no doubt find
it necessary to pass a resolution authorizing the City Clerk and Mayor to
execute the agreement. For your convenience we are enclosing one copy of a
typical resolution frequently used by cities on similar projects. We should
be furnished a certified copy of such resolution as the City adopts in order
to complete our files for the project.
We would appreciate your attention to the execution of this agreement
at your earliest convenience. In the event that any questions should arise
in connection with the agreement or the plans, please feel free to contact
Mr. R. W. Wall , Division Engineer, State Highway Commission, Salina, Kansas,
or this office.

RESOLUTION NO. 3144
Be it Resolved by the Governing Body of the City of Salina:
That the Mayor and City Clerk are authorized and directed to execute
for and on behalf of the City of Salina, Kansas, Agreement No. 14-73M
between the City and the State Highway Commission of Kansas, setting forth
the responsibilities of the City and the State Highway Commission in
connection with an improvement project for bridge repairs to the southbound
structure over Mulberry Creek located about 998 feet south of the centerline
of 1-70 highway on former Alternate US-81 highway, in accord with prior
commitments of the State Highway Commission. The improvement project shall
be known as Project No. ALT. 81-85 2992 (2) .
