Crawford Street - Centennial Road to 1-135 W Agreement J Agreement No. 26-63 A G R E E M E N T• • PROJECT NO. 85-US 320 (5) GRADING, DRAINAGE AND SURFACING CITY OF SALINA, KANSAS / / T is agreement, made and entered into this fb day of , 19 lO;, by and between the City of Salina, Kansas, hereinafter ref rred to as the City and The State Highway Commission of Kansas, hereinafter referred to as the Commission. R E C I T A L S: WHEREAS, The State Highway Commission of Kansas and the said City are empowered by the Laws of Kansas to enter into agreements for the construction and maintenance of city connecting links of the State Highway System through said City, and WHEREAS, the Commission is presently constructing Interstate Highway 35W along the west side of the City under a project known as 35W-85 1-35W-1 (50) 128. The plans for the project provide for a traffic interchange at the intersection of Saline County F.A.S. Route 1067 which is an extension of Crawford Street in the City, and WHEREAS, F.A.S. Route 1067 will overpass Interstate Highway 35W and the revised grade will intersect the existing grade at the west corporate limits of the City 851 .8 feet east of the centerline of Interstate 35W, and WHEREAS, the City and the Commission desire to improve that part of Crawford Street from the west city limits , east to the existing pavement near the inter- section of Centennial Road as an urban extension of F.A. S. Route 1067 by means of a project designated as Project No. 85-US 320 (5), hereinafter called project, and described as follows: Beginning at the west corporate limits of the City on the center- line of Crawford Street; thence east on Crawford Street to a point 59.0 feet east of the center of Beverly Drive. Total length of project 0.095 mile. NOW, THEREFORE, in consideration of the premises and to secure the ap- proval and construction of the said project , the parties hereto mutually agree as follows: 1 . That the said project when submitted and approved shall be undertaken, prosecuted and completed for and on behalf of the said City by the Commission acting in all things as its agent and said City1hereby constitutes and appoints • 1 26-63 said Commission its agent, and all acts, proceedings, matters and things herein- after done by the commission in connection therewith are hereby by said City authorized, adopted, ratified and confirmed to the same extent and with the same effect as though done directly by the said City acting in its own individual corporate capacity instead of by its agent. The plans for said project , when approved by the City, the State Highway Engineer and the Bureau of Public Roads are by reference made a part of this agreement. 2. It is mutually agreed that the project will be constructed within the limits of the existing rights of way. 3. The City agrees that it will move or adjust or cause to be moved or adjusted all existing fences, structures , pole lines, meters , manholes, pipe lines, other utilities and encroachments publicly or privately owned, which may be necessary to the construction of the project in accordance with the approved plans. The removal of all encroachments and the relocation or adjustment of utilities shall not be eligible for reimbursement by the Commission. The City will initiate the removal and adjustment of said utilities and encroachments immediately after receiving notice from the Commission that the contract for the construction of the said project has been awarded. 4. The Commission agrees to prepare the plans for the project , to supervise the construction as required by the Bureau of Public Roads, to negotiate with and report to the Bureau of Public Roads and administer the payments due the contractors, including the portion of the cost borne by the City. 5. The City agrees to pay as its share of the cost of the project an amount equal to fifty (50) percent of the cost of all construction items included in the approved plans plus fifty (50) percent of all engineering costs incurred by the Commission in connection with the project. 6. The City agrees that when said project is completed and approved that it will , at its own cost and expense, maintain said project in a manner satis- . • factory to the Bureau of Public Roads and the Commission or their authorized representatives and will make ample provision each year for such maintenance. Upon receipt from the State Highway Engineer of notification of any unsatis- factory maintenance condition the City will begin the necessary repairs within thirty days and will prosecute the work continuously until it is satisfactorily completed. 7. The City agrees that it will require the removal of all encroachments from the limits of the right of way shown on the plans for this project; and that it will require that all gas and fuel dispensing pumps erected, moved or installed along said connecting link be placed no less than twelve feet back of the right of way line. All right of way provided for said project shall be used solely for public highway purposes and no signs, posters , billboards, roadside stands or other private installations shall be permitted within the right of way limits except as provided by state laws. • 8. The City agrees to prohibit the parking of vehicles on that part of Crawford Street covered by this agreement. - 2 • 26-63 9. It is further understood that this agreement and all contracts entered into under the provisions of this agreement shall be binding upon the Commission and the City and their successors in office.
