Saline County Sheriff Mounted Patrol LEASE AGREEMENT This Lease Agreement is entered into this 27" day of March, 1989 , between the Saline County Sheriff' s Mounted Patrol and Rescue Squad, Inc. , a Kansas non-profit corporation ( "Lessor" ) , and the City of Salina, Kansas, a municipal corporation ( "Lessee") . Lessor hereby leases to Lessee, its facility on West North Street more specifically described as follows : A tract of land in the North Half of Section Eleven (11) , Township Fourteen (14) South, Range Three (3) West, of the 6th P.M. , described as follows: BEGINNING at a point on the West line, 40. 0 feet North of the Southwest corner of the Northeast Quarter of said Section; thence East, to the Westerly right of way line of the Union Pacific Railroad; thence Northwesterly, 318 . 5 feet along said right of way line; thence Southwesterly to a point 77. 6 feet West and 40 feet North of said Southwest corner; thence East to the place of beginning ("Premises") . Lessor, in consideration of the rents and covenants contained in this Agreement, does hereby lease the Premises to the Lessee, for a temporary fire station during the demolition and construction of the Broadway Street overpass project, according to the following terms and conditions: (1) Rent. (a) Lessee agrees to pay to Lessor, as rent for the Premises, the sum of One Thousand Dollars ($1,000.00) per month, for each month or portion thereof that the facility is occupied by the Lessee, payable in advance on the first day of each month. (b) The Lessee also agrees to pay all insurance coverages , utilities and taxes due on the property on a pro-rated basis for the term of this lease. (2) Lease Term. (a) The term of occupancy by Lessee shall commence on the 1st day of May, 1989 , and shall continue on a month to month basis until the earlier of (i) completion of the overpass project to a stage which will allow the passage of emergency traffic or (ii) or April 30, 1990. (b) Lessee and its authorized contractors , agents , and . employees shall have reasonable access to the Premises commencing with the date of execution of this Lease Agreement for purposes of making the improvements outlined in Section (3) below. (3) Improvements. (a) The Lessee agrees to make the following additions and modifications to the premises at no cost to the Lessor: (1) Install a central air conditioning unit in the living quarters. (2) Pay the cost of materials and labor to make necessary changes to kitchen cabinets to allow for the installation of a 30" electrical range. (3) Install a garbage disposal unit for the kitchen sink. (4) Install electric garage door openers on both garage doors. (5) Pay for the fencing materials and labor needed for a lock-up area located in the garage area. (6) Pay for the materials needed to install area lighting to be mounted on the south side of the building. (7) Install levolor blinds on the three (3) windows on the west side of the training room. (8) Pay for any outside dirt work or paving that is deemed necessary for operation by the Fire Chief. (b) Upon termination of this Lease Agreement any and all equipment permanently installed in the building by the Lessee will become the property of the Lessor. (4) Maintenance. (a) The City shall be responsible to maintain the building and grounds in their present conditions . (b) The parties agree that a joint inspection of the Premises shall be made by the Salina Fire Chief' s designee and the Commander of the Saline County Sheriff' s Mounted Patrol and Rescue Squad just prior to the Lessee occupying the Premises and just prior to the Lessee vacating the Premises. (5) Use of the Premises . The Lessee agrees that the -2- Premises shall not be used or occupied for any purpose other than a temporary fire station during the demolition and construction of the Broadway Street overpass project. (6) Default. In the event either party fails to perform any of the promises and covenants under this lease, the non- defaulting party shall give notice of such default in writing to the other party specifying the nature of the default. In the event such default remains uncured for ten (10) days after delivery of the notice specifying the nature of the default, this Lease Agreement shall terminate at the sole option of the non- defaulting party. In the event of termination based upon default of the Lessee, the Lessee shall immediately discontinue operations and shall be required to restore possession of the premises to the Lessor within with ten (10) days from the date of termination. (7) Time is of the Essence. It is mutually agreed to by the parties that time is of the essence of this Lease Agreement, and all the terms and conditions of this Lease Agreement, including the payment of rent, must be performed and paid as specified in this Agreement. Staff has completed favorable negotiations with Saline County Mounted Patrol and Rescue Squad for the temporary lease of the facility on West North Street for a period of six (6) to twelve (12) months. Preliminary Cost Estimates: Lease - $1,000 per month, maximum of $12,000 Insurance on building 1,200 Utilities - $300 per month 3,600 Modifications required to building 5,000 $21,800 It is our intentions to have the terms of this agreement drawn up in a formal lease agreement when we have more information concerning exact starting dates on the project. Recommended Action: The Commission give staff approval to move forward with this agreement. Resolution No. 89-4073 Authorizing an agreement with the Saline County Sheriff' s Mounted Patrol and Rescue Squad, Inc. Background: As previously reported to and approved by the Commission (2/27/89) , staff has been able to negotiate a lease agreement with the Rescue Squad for use of their building located at Broadway and North Streets as a location for a temporary fire station during demolition and reconstruction of the Broadway Overpass. This temporary station is deemed advisable for public safety during the bridge construction, since the Broadway overpass normally serves as the backup route for emergency vehicles in the very rare circumstance that all "at-grade" railroad crossings would be blocked. Fiscal Note: Staff estimates the cost of this agreement at a maximum of $22,000, with actual costs likely to be lower, dependent on the time of completion of the bridge project. These monies were approved in the budget for the bridge project. Recommendation: Approval of Resolution.
